BACKGROUND: The Board directed that it review all intergovernmental agreements. Provided below are a -list of Agreements and brief synopsis of each that have been reviewed by the County Attorney's Office and staff is asking the Board to approve. 1. Parties to Contract: The Town of Chapel Hill (the "Town") and Orange County (Department on Aging) a. Services: The Senior Lunch Program through the Department on Aging operates the lunch program for senior citizens in the Town. Through this program, meals, social interaction activities, educational activities, and support services are provided. b. Amount: The Town has appropriated $18,900 to the Senior Lunch Program for fiscal year 2011-12. 2. Parties to Agreement: The Town of Carrboro ("Carrboro") and Orange County (Department on Aging) a. Services: The Senior Lunch Program through the Department on Aging provides 1,500 meals to Carrboro's older adults, age sixty and older eating lunch at the Robert and Pearl Seymour Center. b. Amount: Carrboro has approved an Lunch Program for fiscal year 2011-12. appropriation of $5,892.42 to the Senior 3. Parties to Contract: The Town of Chapel Hill (the "Town") and Orange County (Department on Aging) a. Services: The Department on Aging operates a comprehensive program targeted toward Chapel Hill and Orange County residents aged 55 years and older for fiscal year 2011-12. b. Amount: The Town shall pay an amount not to exceed $50,000. 4. Parties to Contract: The Town of Chapel Hill (the "Town") and Orange County (Department on Aging) a. Services: The Department on Aging provides services (RSVP 55+ Volunteer Program) to match individuals over 55 years of age with volunteer opportunities in the Chapel Hill community. b. Amount: The Town has appropriated $12,300 to the RSVP 55+ Volunteer Program through the Department on Aging for fiscal year 2011-12. 5 6. Parties to Amended Agreement: The Town of Carrboro, the Town of Chapel Hill, the Town of Hillsborough and the County of Orange a. Services: This is an amendment to the HOME Investment Partnership Program Consortium Agreement approved by the BOCC on May 3, 2011. HUD requested that the County amend the Agreement to comply with the HOME requirements. Section III, Paragraph A of the July 1, 2011 HOME Investment Partnership Program Consortium Agreement is amended as follows: i. The term of the Agreement is from July 1, 2011 to June 30, 2014, the period necessary to carry out all activities funded during fiscal years 2011, 2012, and 2013. ii. That all members of the Orange County Home Consortium (the "OHC") will remain in the OHC for this term. iii. The Agreement remains in effect until the HOME funds are closed out. b. Amount: These amendments do not affect any other terms of the original Agreement. Parties to Partnership: The State of North Carolina, Department of Health and Human Services, Division of Vocational Rehabilitation Services and Orange County a. Services: The Division of Vocational Rehabilitation Services ("VR") will make use of American Reinvestment and Recovery Act monies to fund On-the-Job Training service as well as paid internships for employers, including Orange County, who hire or train a qualified job candidate referred by VR. VR has the option to advance funds to Orange County for both of these programs. b. Amount: Depending on the County's participation in the On-the-Job Training and the paid internship opportunities offered by VR. The County will be reimbursed for the actual cost of employing the interns. 7. Parties to the Memorandum of Understanding: The Department of Homeland Security and Orange County a. Services: On June 23, 2011 the Governor signed into law a bill that requires cities, counties, and business with more than 25 employees to use the federal E- Verify system for all new employees. The County is required to begin using the E- Verify on October 1, 2011. This MOU allows Orange County to participate in the Employment Eligibility Verification Program (E-Verify). E-Verify electronically confirms all newly hired employees' eligibility to work in the United States after completion of the Employment Eligibility Verification Form (Form I-9). The Social Security Administration and the Department of Homeland Security will provide the resources necessary for the County to participate in the E-Verify program. b. Amount: None. 8. Parties to the Agreement: The Town of Carrboro ("Carrboro") and Orange County (Department on Aging) a. Services: The Department on Aging through the RSVP 55+ Volunteer Program will provide contract support of the Volunteer Income Tax Assistance (VITA) and Senior Education Corp. b. Amount: Carrboro has approved an appropriation of $1,400 for these services for fiscal year 2011-12. 9. Parties to the Agreement: The United States Department of Agriculture Animal and Plant Health Inspection Service (the "USDA APHIS") and Orange County (Environment, Agriculture, Parks and Recreation) a. Services: A wildlife specialist from the USDA APHIS will trap and remove beavers from the County's Blackwood Farm. Several months after the removal of the beavers, the wildlife specialist will return to inspect the site and provide further consultation as needed. b. Amount: The cost of services is $630, which will come from DEAPR contractual funds budgeted for FY 2011-12. 10. Parties to the Memorandum of Understanding Renewal: The State of North Carolina, Department of Environment and Natural Resources and Alamance, Guildford, Chatham, Rockingham, and Orange counties (Environment, Agriculture, Parks and Recreation), the City of Greensboro, the Town of Haw River, the Town of Pittsboro, and the Town of Swepsonville. a. Services: In March 2006, Orange County entered into a memorandum of understanding ("MOU") with the State of North Carolina and 11 local governments to plan for a Haw River Trail Corridor. The renewal term of the MOU is for 2011- 21 and can be terminated at any time with 60 days notice. i. Note: Only one public access facility is being considered for the 2.5-mile segment of the Haw River that borders Orange County. The Haw River Trail Coordinator (based in Alamance County) has developed detailed plans for acanoe/kayak access facility on NCDOT property adjacent to Old 4 Greensboro Highway. Alamance County is prepared to construct, operate and maintain the facility unless Orange County would prefer to take on some or all of those duties. Those plans are being reviewed by Orange County and will be brought to the Board fQr consideration as a separate matter from this MOU. b. Amount: There is no cost associated with signing the MOU. FINANCIAL IMPACT: Financial impact is listed in each section above. RECOMMENDATION(S): The Manager recommends that the Board authorize the County Manager to sign the above listed agreements and any amendments or renewals of those Agreements.
