OF THE
ORANGE COUNTY BOARD OF COUNTY COMMISSIONERS
TO APPROVE A
RENEWAL OF SPECIAL USE PERMIT, CLASS A
FOR.
REBA & ROSES, Inc.
Date: January 16, 2002
Owners: Reba & Roses, Inc.
The Board of County Commissioners hereby approves an application submitted by Reba &
Roses, Inc. to renew a Special Use Permit, Class A for property located at the northwest
intersection of St. Mary's Road (SR 1002) and Baldwin Road (SR 1554) being further identified
in the Orange County Land Records Office by Parcel Identification Numbers, 9885-02-4491 and
9885-01-5067 and containing 56.24 acres more or Less. The property is identified by the
following legal description:
All of that tract located in Orange County, North Carolina, and recorded in Deed Book 661 Page
373. BEGINNING at an iron stake, said stake being located in the eastern property line of John
Graham, Jr. land and Sandy Graham land and the northwesternmosteorner of the property of Guy
H. Baldwin and being located North 06° 47' S 1" East 912.42. feet from the center ofthe
Hillsboro-Oxford Highway near Nancy Creek; thence North 06° 47' S 1" East 2626.10 feet to an
iron stake in the line of land conveyed by the North Carolina Joint Stock Land Bank to Frederick
Reid Roberts and wife, be deed dated September 6, 1939; thence along and with the lines of the
Roberts tract the following courses and distances: South 80° 12' 49" East 709.50 feet to an iron
stake; thence South 03° 17' 11" West 650.10 feet to an iron stake; thence South 10° 17' 11"
West 634.26 feet to an iron stake; thence South 02° 47' 11" West 854.70 feet to an iron stake;
thence south 66° 13' 12" West 893.46 feet to the point and place of BEGINNING, containing
40.24 acres, more. or less, according to survey by Alois Callemyn, Registered Surveyor, dated
January, 1980 and being a portion of the Guy H. Baldwin tract of land situated near Hillsborough,
North Carolina; and
All of that tract located in North Carolina, and recorded in Deed Book 1374 Page 599.
BEGINNING at a point in the center of the Hillsboro-Oxford Road neaz Nancy Creek and corner
with property known as the John Graham, Jr. land and also Sandy Graham land; thence along and
with the eastern line of said Graham tract of land North 06° 47' S 1" East 912.42 feet to an iron
stake; thence North 66° 13' 12" East 893.46 feet to an iron stake in the western property line of F.
Reid Roberts; thence South 11° 17' 11" West 450.78 feet to an iron stake; thence South 10° 49'
02" East 403.82 feet to a stake in the center of the said Hillsboro-Oxford Highway; thence along
and with. the center of said highway South 64° 54' 36" West 1008.31 feet to the point and place
of BEGINNING, containing 16 acres, more. or less, according to survey by Alois Callemyn, _ --
Registered Surveyor, dated January 1980, and being a portion of the Guy H. Baldwin tract of land
situated near Hillsborough, North Carolina.
The Special Use Permit is approved with the following eight (8) conditions.
1. Assessment of structural integrity of all structures shall be conducted by a registered
engineer. This assessment shall be provided to the Orange County Inspections Division for
its review. This assessment maybe relied upon by the Orange County Inspections Division

in its permitting of the structures. This condition must be met within sixty (60) days after this
Special Use Permit is renewed.
2. All structural and physical handicapped accessibility improvements to the structures shall be
made in accordance with Federal requirements and State Building Codes and must be
approved by the Orange County Inspections Division. This condition must be met within
sixty (60) days after this Special Use Permit is renewed.
3. A Certificate of Occupancy must be issued by the Orange County Inspections Division
following the necessary inspections of all structures for federal and Code compliance. This
condition must be met within sixty (60) days after this Special Use Permit is renewed.
4. The final site plan and narrative of the project incorporating all changes, deletions, and
additions to the project are included herein and made a part of the Class A Special Use
Permit. A copy of the final site plan and narrative are on file with the Orange County
Planning and Inspections Department.
5. The landscaping described in the approved site plan and approved narrative shall be
complied with, showing existing and proposed trees and other vegetation serving as a buffer
on all sides. No trees will be cut down along Baldwin Road except at the location of the
driveway as specified in the landscaping plan. All trees and other vegetation not removed as
provided in the approved site plan and approved narrative shall be protected and maintained
as required by Article 12 of the Orange County Zoning Ordinance.
6. Outdoor storagelstockpiling of materials for the area along Baldwin Road shall be of natural
(i.e. not manmade) materials and shall not be of a malodorous or redolent nature.
7. A 75-foot Type E Buffer shall be provided along Baldwin Road along the width of the area
used for outdoor storage of materials.
8. This Special Use Permit will expire and become null and void at 12:59:59 p.m. on the last
day of the sixth (6~') year after it is issued as provided in Section 8.8.24.2 of the Orange
County Zoning Regulations.
This renewed Special Use Permit, Class A shall become effective upon approval.
NOW THEREFORE BE IT RESOLVED by the Board of Orange County Commissioners that
the Class A Special Use Permit for Reba & Roses Inc. is renewed in accordance with the
above mentioned conditions and attached Site Plan dated September. 25, 1995 and updated
November 17, 200 L
