PURPOSE: To consider correction of a text error in the EDD Design Manual and to
consider adoption of proposed amendments to the Permitted Use Table for the 1 -85/
Buckhorn Road Economic Development District ( Buckhom EDD).
BACKGROUND:
Correction of Text Error
The heading on each page of the Permitted Use Table (see Attachment 2) in the EDD
Design Manual contains the following text regarding special use permits: "...or by the
Board of Adjustment as a Class A Special Use ( "B')." "Class A" should be amended to
read "Class B" since this is the type of permit issued by the Board of Adjustment.
Review of Permitted Uses and Approval Processes
A proposed amendment to Article 6.29.3 of the Zoning Ordinance in the Buckhorn
EDD was presented at the November 25, 2002 quarterly public hearing. The EDD is
comprised of 845 acres; all classified as Primary Development Area. The amendment
(which was not adopted) was examining approximately 530 acres south of 1 -85.
The Permitted Use Table in the Economic Development Districts Design Manual
contains an extensive list of "Primary" land uses, which depending on their intensity,
are permitted by:
• County staff following review and approval;
A
• the Board of Adjustment (Class B) following a public hearing; or
• the Board of County Commissioners (Class A) following a public hearing
Inactivity in the EDD over the past eight years prompted re- examination of all uses in
the Buckhorn EDD area, by a Planning and Economic Development Staff Team. A use
not listed in Primary EDD is "Schools, elementary, middle, and high." However,
vocational schools are permitted as a Class A use in the Primary EDD. A finding was
that public schools are also similarly compatible.
Geographically, the portion of the EDD south of 1 -40/85 is independent of areas in the
Efland village area. The lack of development activity in this portion of the EDD,
coupled with the possible extension of water and sewer to the area, warrants
reconsideration of the permitted use table to add important public service uses such as
schools and to improve the compatibility of potentially adjacent uses in a liberal use
Primary EDD area.
The Planning and Economic Development Staff Team developed a set of proposed
amendments to the Buckhorn EDD Permitted Use Table (see Attachment 1) which
were reviewed by the Planning Board on August 6, 2003 and BOCC on August 19,
2003.
The proposed amendments were subsequently presented at the Quarterly Public
Hearing on August 25, 2003. Attachment 2 summarizes questions /comments and
responses from the public hearing.
The Planning Board considered the proposed amendments on September 3, 2003 and
unanimously recommended approval.
FINANCIAL IMPACT: None.
RECOMMENDATION: The Administration recommends approval of the proposed
amendments consistent with the Planning Board recommendation.

Buckhorn EDD Proposed Amendments to Permitted Use Table
(Presented at August 25, 2003 Quarterly Public Hearing)
Question: Why motor vehicle maintenance and repair proposed to be deleted?
Response: Entire use is not proposed for elimination, just the paint and body
work component
Comment: Concerns with adding schools to primary EDD; compatibility issues.
Response:
• Schools need to be where there is water and sewer to support them
(reference to rural schools traditionally served with well, septic and /or sand
filters and ultimate failure of such systems).
• As with the Hillsborough Area EDD, there is an opportunity here to refine the
Buckhorn EDD so that adjacent uses are compatible.
• An assessment of EDD uses in this area is needed as elapsed time since
implementation is approaching 10 years and there has been no activity.
• Example given of newest charter school in Orange County being located in
the Meadowlands.
Comment: Air quality concerns related to proximity of Interstate corridor.
Response:
• Prevailing winds from southwest, thus helping to keep pollutants associated
with Interstate away from this portion of EDD.
• Weigh station contributes to air pollution in area due to stop- and -go nature of
heavy truck traffic; new scanning technology will ultimately do away with need
for trucks to stop resulting in improved air quality.
• Air quality likely to be more of an issue in summer (ozone alert days) when
school is out; fairly good mixing of air layers in fall, winter, and spring.
Comment: Golf driving and practice ranges consume considerable acreage.
Response:
• Acreage requirements are high, but use requires few buildings and little in
way of supporting infrastructure; "re- development" of property to more
intense, permanent use is not that difficult.
• Fills a recreational need until such time as more desirable employment
generating use is put on property.

encompass a broad range of specific uses or activities. Orange County recognizes that application of the standards set forth in this manual'may
limit the feasibility of specific uses within the broad range of categories due to land area and design feature requirements. Where one or more

377 Craig Benedict stated the Planning Board heard this in August at the Public Hearing. The
378 Commissioners heard this at a work session on August 19, 2003 as a preview so when they went
379 into the Public Hearing meeting they were able to make comments.

381 Ted Triebel asked about the word "urbanization" and why it was attached to Hillsborough and
382 Buckhorn but not to Chapel Hill.

384 Craig Benedict answered by using an attached map and stated that growth boundaries already
385 have been agreed to around Chapel.Hill and Carrboro. He and discussed the attachment entitled
386 "Proposed Amendments to Permitted Use Table for I- 85Buckhorn Road EDD. He stated three
387 uses were suggested to be eliminated. 1) Motor freight terminals were a permitted use by right.
388 2) Storage and distribution of petroleum products. 3) Motor vehicle maintenance and repair shop
389 (body shop).

391 Craufurd Goodwin asked about putting a school in an industrial development. He asked if this
392 was to get water and sewer there.

394 Craig Benedict answered that it may prompt water and sewer to be brought to the area in a faster
395 time frame, which would support other economic development efforts.

397 Renee Price asked if this was actually trying to change the original intent of the Economic
398 Development District. Was it to scale down to being more residential friendly?

400 Craig Benedict answered that it was not intended for any residential use now. In the 2 other
401 development districts there was a primary and secondary areas but this Economic Development
402 District was the only one that did not have secondary.

c. Buckhorn EDD — Proposed Amendments to Permitted Use Table 9 c
The Board considered correction of a text error in the EDD Design Manual and to Consider
adoption of proposed amendments to the Permitted Use Table for the 1 -85 /Buckhorn Road Economic
Development District (Buckhorn EDD).
Craig Benedict said that the correction of the text error was mentioning that class A goes to
the Board of Adjustment. Class B actually goes to the Board of Adjustment. The more substantive
correction to the EDD was adding additional uses to the 1 -85 /Buckhorn Road EDD. These were discussed
at a public hearing, and it included the addition of schools into the district as a class A special use permit.
Also, allowing golf driving and practice ranges as a permitted use. Other uses were deleted such as water
freight terminals, storage of petroleum products, and body shops.
Also, the Planning Board did not unanimously approve this as it was stated. The Planning
Board approved the special use standards for schools within the Buckhorn EDD. They approved this on a
6 -3 vote.
A motion was made by Commissioner Jacobs, seconded by Commissioner Carey to approve
the proposed amendments consistent with the Planning Board recommendation.
Chair Brown asked about the motor vehicle maintenance body shops and why they are
going to be eliminated. Craig Benedict said that the existing use category for this is a class A special use
permit.
Chair Brown asked if our design standards for the EDD are strong enough or sophisticated
enough to allow these types of businesses to have a good design. Craig Benedict said that our standards
are elaborate and good. He thinks that any project like this would be scrutinized enough.
Commissioner Halkiotis suggested allowing these shops and putting restrictions on outside
storage. The motion included this revision.
Commissioner Gordon said that she does not think public schools should be in the primary
EDD. She thinks, if anything, they should be in a new secondary EDD category, modified so there is no
residential. She also thinks that putting public schools in the primary EDD could be a problem with respect
to economic development. However, she has been convinced that the Orange County Schools want to site
their school in this area. She will vote for it even though she has reservations about it because she wants
to support the school board in their choice.

d. Mill Creek II Subdivision (Section Two) — Preliminary Plan (9:40- 10.00)
The Board considered the Preliminary Plan for Mill Creek II Subdivision (Section Two).
Craig Benedict said that this is a 42 -lot tract in Cheeks Township. The tract is on 98 acres
and involves 41.5% open space. It is on Mill Creek Road near High Rock Road. The area will be designed
with a central spine road. The creek is being preserved with the open space. Also, a pocket park has been
added. There is also transportation connectivity. Administration recommends approval in accordance with
the resolution. There is a requirement for a left turn lane and a right turn lane on Mill Creek Road.
A motion was made by Commissioner Halkiotis, seconded by Commissioner Gordon to
approve the subdivision in accordance with the Resolution of Approval.

The Board considered a resolution authorizing staff to: officially begin the RFP process for
expanding the remaining part of the 1997 Efland Sewer Bond and Buckhorn Economic Development
District (EDD) utility systems, and begin the negotiation process with the City of Mebane to become the
water & sewer system utility for the Buckhorn EDD.
Craig Benedict gave a PowerPoint presentation. He said that this was a resolution to initiate
the project to expand the Efland sewer system part of the 1997 sewer bond area, and also to extend water
and sewer utilities to serve the Buckhorn EDD. He explained the color -coded maps. The second part of
