PURPOSE: To approve Level 1 capital project ordinances for Chapel Hill Carrboro City
Schools ( CHCCS) and Orange County Schools (OCS).
BACKGROUND: In accordance with the Board of Commissioners approved Policy on Planning
and Funding School Capital Projects, approved by the Board in November 2001, school capital
projects are defined by "levels ".
• Level 1 project are those that involve a relatively small scope of work - thereby allowing
the Commissioners to approved the entire project ordinance at one time.
• Level 2 projects are major projects that require several phases to complete. For these
projects the Board of County Commissioners approves a four -phase appropriation
process to include:
o Concept/Pre- Planning Phase - includes preliminary programming and design work
that would result in conceptual drawings and preliminary cost estimates.
o Planning Phase - includes siting and infrastructure
o Design and Construction Approval Phase - includes final design, equipment,
furnishings, non- recurring start up cost, technology and contingency
o Final Accounting Phase - Upon completion of the project, school and county staff
will reconcile actual project expenditures with approved budget and provide the
BOCC with a "final accounting" of the project.
On June 26, 2003, the Board of. County Commissioners approved some Level 1 project for both
school systems. Many of those capital project ordinances did not involve new funding
appropriations but merely extended the project timelines through June 30, 2004. Other projects
received new funding for the current fiscal year and each school system needed funding
appropriations in place in order to accomplish work prior to the beginning of the new school
year. A list of projects approved by the BOCC in June is included in Columns C and D of
Attachments 1 and 2 of this abstract.
CHCCS has requested that the BOCC approve the remaining Level 1 projects that were
deferred in June (see column E of Attachments 1 and 2 of this abstract). For OCS the only
Level 1 project receiving new non -debt funds for this fiscal year is Information Technology. The
Board approved funding for that project on June 26, 2003; therefore, Commissioners are not
being asked to approve additional pay -as- you -go capital project ordinances for OCS for the
current year.
As stated earlier, approval of Level 2 projects, those projects that require several phases to
complete, will be requested at the appropriated times in accordance with the Board's adopted
School Planning and Funding Policy over the life of the major project. Examples of Level 2
projects include OCS Middle School #3 and CHCCS High School #3:
FINANCIAL IMPACT: As noted on individual capital project ordinances.
RECOMMENDATION (S): The Manager recommends that the Board adopt the accompanying
Level 1 capital project ordinances.

Capital Project Ordinance
Be it ordained by the Orange County Board of County Commissioners that pursuant to Section
13.2 of Chapter 159 of the General Statutes of North Carolina, the following capital project is
hereby adopted.
Section 1.The project authorized provides funds to bring the Chapel Hill- Carrboro City
Schools system into compliance with the Americans with Disabilities Act (ADA)
standards. Proceeds from the Schools' portion of the one -half cent sales taxes
finance this project.
Section 2.The officers of the County are hereby directed to proceed with the project within the
budget contained herein.

13.2 of Chapter 159 of the General Statutes of North Carolina, the following capital project is

regulations related to removal of hazardous building materials such as asbestos
flooring and ceiling tiles. Proceeds from the Schools' portion of the one -half cent

hardware replacements at Culbreth Middle School, Phillips Middle School, and
Chapel Hill High School. Funding for the project comes from the District's share of

Indoor Air Quality Improvements

Capital Project Ordinance
Be it ordained by the Orange County Board of County Commissioners that pursuant to Section
13.2 of Chapter 159 of the General Statutes of North Carolina, the following capital project is
hereby adopted.
Section I.The project authorized provides funds for the specialized cleaning of old HVAC
equipment, classrooms, offices, and air ducts. Exterior brick pointing and building
fagade repairs are also included. Proceeds from the Schools' portion of the one -
half cent sales taxes finance this project.

gL Criminal Justice Partnership Program Grant Acceptance 8i1
The Board accepted Criminal Justice Partnership Program (CJPP) implementation grant funds
totaling $165,221 from the NC Department of Correction, and authorized the Chair to sign contingent
upon staff review.
h. Criminal Justice Partnership Program 2003 -2004 Contracts
The Board approved service delivery contracts for the Criminal Justice Partnership Program
(CJPP) and authorized the Chair to sign contingent upon staff review.
1. Agreement Renewal Between UNC Hospitals and Orange County for the Senior Wellness
Program
The Board approved an agreement renewal to receive $50,000 from the University of North
Carolina (UNC) Hospitals for its co- sponsorship of the Department on Aging's Senior Wellness Program
from July 1, 2003 through June 30, 2004 and authorized the Chair to sign.
L Continuation Agreement with the Town of Chapel Hill for Senior Recreation Services
The Board approved a continuation Agreement with the Town of Chapel Hill to provide funding
in the amount of $46,697 for senior recreation programs on behalf of the Town's Parks and Recreation
Department; and authorized the Chair to sign.
k. Joint Planning Area Land Use Plan Amendments to Correspond with the Town of Chapel
Hill's Comprehensive Plan
The Board adopted the following amendments to the Joint Planning Area Land Use Plan
resulting from the Chapel Hill Comprehensive Plan adopted by the Town in May 2000.
1. Changing the designation of the Greene Tract from "Landfill Pending Further Study" to
'Housing /Recreation /Open Space /County Use
2. Changing the designation of land south of Eubanks Road from "Open Space" to "Low
Residential."
3. Changing the designation of land north of Eubanks Road, between the existing landfill and
Millhouse Road, from "Mixed Use, Office Emphasis" to "Open Space."
4. Changing the designation of parcels between Millhouse Road and Interstate 40 from "Mixed
Use, Office Emphasis" to "Rural Residential."
5. Changing the designation of the parcel northwest of the Greene Tract and southeast of the
existing landfill (parcel known as the "Neville Tract ") from "Open Space" to "Non- landfill County
use."

Boundary Agreement and Map

(prior to the JPA meeting at 7:30 p.m.) and to add a meeting on Tuesday, October 21, 2003 at 5:00
p.m. at the Southern Human Services Center in Chapel Hill, North Carolina (prior to the BOCC regular
meeting at 7:30 p.m.) and to add a joint meeting with the Town of Hillsborough on Thursday, October
