HomeMy WebLinkAboutORD-2003-119 Land Use Plan Amendment to Incorporate Water and Sewer Management, Planning and Boundary Agreement and MapL An Ordinance Amending the Land Use Element of the Orange County Comprehensive Plan Be it ordained by the Board of Commissioners of Orange County that the Land Use Element of the Orange County Comprehensive Plan inhere by amended as follows: ------------------------------------- Bold =Amended Language Section 1. Amend Section 2.3 WATER RESOURCES, Charge 4 to the Long Range Water Management Strategy Committee, to read as follows: 4) Work cooperatively with the various water and sewer service providers and municipalities in the County, including Mebane and Durham, to identify and develop a joint agreement on service area boundaries (a task force composed of elected officials and staff from Orange County, Chapel Hill, Carrboro, Hillsborough, and OWASA developed over a period of seven years, a Water and Sewer Management, Planning and Boundary Agreement and Map that depicts primary service areas and long-term interest areas. The Board of County Commissioners adopted the agreement in its final form on December 3, 2001. The Agreement and Map are incorporated as Appendix G to this plan); and, Section 2. Amend Section 3.5 LAND USE GOALS AND DRAFT POLICIES, GOAL NINE: The provision of water and sewer lines in those areas which can be practically and efficiently served by these facilities, to read as follows: 9.1. Develop and implement a cooperative joint planning process among the County municipalities and those organizations responsible for water and sewer lines to guide the extension of lines in accordance with the land use plans and policies of the affected jurisdictions. A task force composed of elected officials and staff from Orange County, Chapel Hill, Carrboro, Hillsborough, and OWASA developed over a period of seven years, a Water and Sewer Management, Planning and Boundary Agreement and Map that depicts primary service areas and long-term interest areas. The Board of County Commissioners adopted the agreement in its final form on December 3, 2001. The Agreement and Map are incorporated as Appendix G to this plan. 9.2 Establish Urban Service Areas for Chapel Hill, Carrboro, Hillsborough, Mebane and Durham which will correspond with the 10-year and 20-year Transition Areas. Water and sewer lines should be directed to those areas which contain and are appropriate for higher density levels of residential, commercial, and industrial development. Amend Section 3.5 LAND USE GOALS AND DRAFT POLICIES, GOAL ELEVEN: Adequate and appropriate sewer disposal facilities for all current and future residents, to read as follows: 11.2. Identify service by centralized water and sewer service systems (Towns of Hillsborough and Mebane, Orange-Alamance Water Systems Incorporated and Orange Water and Sewer Authority) as most appropriate at the higher-density levels which occur in the Urban and Transition Areas. Amend Section 4.1 OVERVIEW OF IMPLEMENTATION STRATEGIES, Sewer and Water Extension Policy, to read as follows: A water and sewer extension policy refers to an official or unofficial policy or policies regarding the expansion of centralized sewer and water systems into previously unserviced areas. The presence or absence of water and sewer facilities significantly affects location and intensity of development in a given area. Without the provision of centralized sewage collection and disposal land can only be developed for rural uses at rural densities. The provision of public services and facilities should not seek to follow private development, but should occur simultaneously with planning efforts to channel development over time in a manner consistent with the goals and policies outlined in the Land Use Plan. Public facilities should be designed to serve a specific purpose given a desired location, density and form of private development. Orange County is presently involved in efforts directed at formulating water and sewer extension policies in coordination with economic and industrial development policies and plans for the County. Amend APPENDIX by incorporating as APPENDIX G, the Water and Sewer Management, Planning and Boundary Agreement and Map, adopted in its final form by the Board of County Commissioners on December 3, 2001. Section 6. That this ordinance be placed in the file of published ordinances. Section 7. .This ordinance is effective upon adoption. NOW THEREFORE BE IT ORDAINED by the Board of Orange County Commissioners that this ordinance entitled "An Ordinance Amending the Land Use Element of the Orange County Comprehensive Plan" be adopted. A motion was made by Commissioner Jacobs, seconded by Commissioner Carey to approve renewal of employee health insurance plans with the NCACC Health Insurance Trust and CIGNA for coverage effective January 1, 2004 and to adopt the attached health insurance rates for coverage effective January 1, 2004 including continuing the dependent subsidy at 52 percent. Land Use Plan Amendment to Incorporate Water and Sewer Management Planning and Boundary Agreement and Map The Board considered adoption of a proposed amendment to the Land Use Element of the Orange County Comprehensive Plan to incorporate the Water and Sewer Management, Planning and Boundary Agreement and Map. Craig Benedict said that this map has been incorporated into the joint planning agreement with Chapel Hill and Carrboro. This item will insert the map into the countywide land use plan, which would apply to other areas of the County (Hillsborough, Efland). Commissioner Gordon asked for clarification on siting the Central Public Facilities. She wants to know whether you can site a school within the interest areas. Geof Gledhill said that a school could be sited within the interest areas. She said that the way she reads this is that a school could go outside the water and sewer boundary. Geof Gledhill said that this is exactly right and that public schools can be located in interest areas pursuant to this agreement. There would be a process to develop criteria for doing that. A motion was made by Commissioner Jacobs, seconded by Commissioner Carey to approve the proposed amendments consistent with the Planning Board recommendation. VOTE: UNANIMOUS o. Whitted Human Services Center Renovation -Progress Report and Request for Authorization for Additional Debt Funding to Complete the Project The Board considered the status of the Whitted Human Services Center (WHSC) renovation project and authorization for additional $475,000 debt funding to complete the project; and directed staff to include this amount in the updated five year plan for the issuance of County bonds and alternative financing, to be presented during the October 27, 2003 Capital investment Plan work session; and authorize the Manager or his designee to contract with vendors for the referenced renovation work (painting, flooring, etc.) when that work exceeds the $20, 000 threshold for Board approval, except that amounts exceeding $50,000 would need Board approval. Commissioner Gordon said that this has been worked on by staff at her request to give a project cost summary. She said that the amount of money went down a little, but it does show where the costs were exceeded. The only other question is if there is any other source of funding besides alternative financing. Budget Director Donna Dean said that there is no other available money. A motion was made by Commissioner Halkiotis, seconded by Commissioner Carey to approve the expenditure of an additional $475,000 to cover costs associated with the completion of the Whitted Center renovation; and direct staff to include this amount in the updated five year plan for the issuance of County bonds and alternative financing, to be presented during the October 27, 2003 Capital Investment Plan work session; and authorize the Manager or his designee to contract with vendors for the referenced renovation work (painting, flooring, etc.) when that work exceeds the $20,000 threshold for Board approval, except that amounts exceeding $50,000 would need Board approval. VOTE: UNANIMOUS ~ Percent for Art for Southern Community Park and Homestead Aquatics Center The Board considered confirming Orange County's plans to designate 1 % of funds allocated for Southern Community Park and the Homestead Aquatics Center for public art and also authorizing the Orange County Arts Commission to work collaboratively with the Chapel Hill Public Arts Commissions on the public art aspects of these two projects funded jointly by Orange County and the Town of Chapel Hilt.
