PURPOSE: To receive authorization to submit the Quarterly Public Hearing Legal
Advertisement for publication for the May 27, 2003 quarterly public hearing.
BACKGROUND: The next regular quarterly public hearing is scheduled for May 27, 2003.. A
summary of each item proposed for public hearing is provided. Staff is available to research
and answer questions prior to the public hearing.
SCHOOLS ITEM
PROPOSED THIRD HIGH SCHOOL IN THE CHAPEL HILL-CARRBORO SCHOOLS SYSTEM
The Board of Commissioners indicated during its April 24, 2003 work session plans to conduct
a public hearing on several aspects of the proposed third high school in the Chapel Hill-
Carrboro Schools system, immediately preceding the May 27 planning-related items. The
school-related public hearing will commence at 7:00 p.m. Primarily, the intent would be to:
1. Afford citizens the opportunity to comment on the proposal to reallocate $12.8 million in
public school bonds approved by voters in November 2001 from Elementary School #10
to High School #3, and
2. Provide citizens a chance to comment on any other aspect of the proposed high school,
including the CHCCS preferred site near Rock Haven Road. /'sM~~ ~~ ~-
Following the conclusion of the public hearing on the above, the Bo/ard will conduct the public
hearing on the planning items noted below.

allowed upon notification to the County. Sites specified in the Plan will be deemed
preferred sites promoting a master system of towers for public safety use for the
construction of telecommunications towers with an abridged system of .further public
hearings.
FINANCIAL IMPACT: There is no financial impact associated with this decision.
Advertisement costs are included in the budget for County initiated items.
RECOMMENDATION(S): The Administration recommends APPROVAL of the proposed May
27, 2003 Quarterly Public Hearing legal advertisement.

2. Amend Section IV-B-10. Flexible Development -Section C, Open
Space Standards to require that at least 75% of residential lots in a
proposed development be contiguous on one or more sides to the system
of open space.
Purpose: To ensure that at least 75% of residential lots in a development utilizing
the Flexible Development option have direct access to the system of 33%
protected open space requried by Flexible Development.
3. Amend Section IV-B-3. Streets, IV-b-3-b to require that major subdivisions
have access on a paved public road.
Purpose: To ensure a safe and coordinated street system by requiring that major
subdivisions (six or more lots) have access on a paved public. road. This will help
preserve the integrity of the public road infrastructure by not creating traffic
generators that must use unpaved roads, which are harder to maintain than paved
roads and are more likely to exhibit roadway conditions that present safety
hazards.
C. ORANGE COUNTY EROSION AND SEDIMENTATION CONTROL ORDINANCE
REGULATIONS TEXT AMENDMENTS
1. Text Amendments to Sections 3, 6, 6.1 and 7 and other related sections to
define and regulate the open .burning of trees, limbs, stumps and
construction debris associated with permitted activity.
Purpose: To define and regulate and prohibit the open burning of trees, limbs,
stumps and construction debris as a condition of permit approval.
D. ORANGE COUNTY MASTER TELECOMMUNICATIONS PLAN
1. Article 6.18.5, Master Telecommunications Plan ("Plan"), of the Orange
County Zoning Ordinance allows for the development of a "Master
Telecommunications Plan." A tower may be constructed upon issuance of
a building permit and after meeting Zoning Ordinance requirements for
construction of .telecommunications towers. Providers electing to
participate in the Plan shall submit required information and filing fee to
the County for review by a contracted consultant to verify site necessity.
Modifications to the Plan will be considered annually in February of each
year. Applications to participate in the Plan are due prior to December 15
of each year. Withdrawals from. the Plan are allowed upon notification to
the County.
Purpose: To identify sites within the County where an applicant may. construct a
wireless telecommunications facility less than 200 feet in height. Pre-identified
sites can include fire stations, county property, agricultural districts, utility
authorities, etc. Sites specified in the Plan will be deemed preferred .sites
promoting a master system of towers for public safety use for the construction of
telecommunications towers with an abridged system of further public hearings.
