BACKGROUND: Under Board of County Commissioners unwritten policy, the BOCC approves the Quarterly Public Hearing legal advertisements prior to publication. Due to the level of specificity required in a legal ad, it is challenging for staff to have work substantially complete in early June for the August Quarterly Public Hearing each year since there are no July or early August BOCC meetings. Work must be substantially completed in early June when other precursor amendments may still be in process in order to meet agenda deadlines for the last June BOCC meeting prior to the summer break. Staff is requesting that the BOCC allow staff to work with the Chair, Vice-Chair, and Manager over the summer to approve the August Quarterly Public Hearing advertisement prior to submission to the newspapers in early August. At this time, the following items are expected for the August 22, 2011 Quarterly Public Hearing. All are government-initiated and none are overly complex: 1. Unified Development Ordinance (UDO) Text Amendment to ensure connectivity between parcels, consistent with adopted access management plans, in situations that do not involve subdividing property. Currently, the County may require connectivity between parcels only through the subdivision process. Staff believes it is in the public's best interest to require connectivity between parcels through the site plan approval process in circumstances where the subdivision regulations are not applicable. The amendment will likely be to Article 2 of the UDO but may include other Articles staff determines to be necessary when further processing this amendment. 2. UDO Text amendment to uncouple Class II Kennels and Riding Stables as a use and to have separate Standards sections for each use. At this time, staff is suggesting only the uncoupling and the use of existing Standards as they pertain to each use. Staff is not suggesting an overhaul of standards or processes for these uses at this time. The 2 amendments will be primarily to Article 5 but may include other Articles staff determines to be necessary when further processing this amendment. 3. UDO Text Amendment to update the "Commercial-Industrial Transition Activity Node Land" definition in Article 10 to be consistent with the definition update in the 2030 Comprehensive Plan scheduled for adoption on June 21, 2011. Additionally, the new "Land Use and Unified Development Ordinance Amendment Outline" forms the Planning Department began using in April informs the BOCC and others of upcoming amendment topics. This was one of the purposes of the unwritten policy concerning the BOCC approving the legal advertisement - to inform the BOCC of upcoming public hearing items. In the future, the Planning Department intends to have the Amendment Outline forms completed and approved even earlier in the amendment process, which would keep interested parties even more up-to-date about upcoming amendments than past practices. FINANCIAL IMPACT: There is no financial impact with allowing staff to work with the Chair, Vice-Chair, and Manager over the summer break on the August Quarterly Public Hearing legal advertisement. Advertising costs for the legal advertisement are included in the Recommended FY 2011-12 Budget. RECOMMENDATION(S): The Manager recommends the Board forgo formal Board approval of the August 22, 2011 Quarterly Public Hearing legal advertisement and allow staff to work with the Chair, Vice-Chair, and Manager over the summer break on the legal advertisement which will be sent to the newspapers on August 5 for publication on August 10 and 17, 2011.
