BACKGROUND: This authority is time-limited and specific to two projects: Several State and Federal review requirements will be occurring over the next few months related to the Central Efland Phase II and Northern Buckhorn sanitary sewer projects. Due to the summer break, the agencies and activities noted below will require certain actions, correspondence, recorded documents and supporting material. Orange County staff is preparing to begin construction on the Efland-Buckhorn Sewer Project during the fall of 2011. Staff will continue to prepare for this construction through the summer months in the areas of: 1) Railroad and North Carolina Department of Transportation (NCDOT) encroachment permissions and conditions; 2) Necessary sewer easement transactions; 3) Financing agreements (previously authorized by the BOCC); 4) Other regulatory and municipal agreements, including potential agreements with the City of Mebane (for the Northern Buckhorn area); 5) Engagement in a Construction Administration and/or Construction Materials Testing professional services agreement through a request for proposals (RFP) process in excess of the Manager's approved $90,000 limit; 6) Most acquisition of easements are by agreement. However in a few cases, where special circumstances arise (such as `through lot' vs. perimeter easement routes), the approved agreement offer does not comport and an alternate offer may be necessary. In other cases where an agreement cannot be reached, the BOCC on June 7 authorized condemnation of the easement(s). The BOCC has also authorized the purchase of property for the sewage lift station which is a fee simple transfer of ownership. Although this is intended to be accomplished within required timeframes, there is a remote possibility that the acquisition of property may also be pursuant to condemnation as a last resort. These pre-construction activities will require the need for the County Manager to represent the County in these types of Agreements. FINANCIAL IMPACT: Associated costs are appropriated within the Efland Sewer Expansion Capital Project budget. RECOMMENDATION(S): The Manager recommends that the Board authorize the County Manager to execute necessary documents for pre-construction activities necessary for the Central Efland Phase II -Northern Buckhorn Sewer Capital Project, including authorization to engage a Construction Administration and/or Construction Materials Testing professional services firm with costs in excess of $90,000, subject to County Attorney review.
