ORANGE COUNTY
AMENDMENT TO THE ANIMAL SERVICES
AGREEMENT BETWEEN ORANGE COUNTY
NORTH CAROLINA AND ANIMALKIND, INC
THIS AMENDMENT, made and entered into this the day of June 2011, by and
between the County of Orange County, a body politic and corporate entity of the State of
North Carolina, ("County"), and AnimalKind; Inc., a North Carolina Non-Profit
corporation (the "Provider"), (collectively "the Parties") shall amend Section 4.a. of the
Performance Agreement FY 2010-11 entered into on July 1, 2010 by the Parties.
WITNESSETH:
WHEREAS, the County and Provider entered into a Performance Agreement FY 2010-
11 ("Original Agreement") effective July 1, 2010 to provide reduced or no cost
spay/neuter program to qualified residents in the County thereby enhancing the
availability of the services to residents which meets a community need as identified by
the Board of Commissioners;. and
WHEREAS, the County and Provider desire to amend the Original Agreement, while
keeping in effect all terms and conditions of the Original Agreement not inconsistent with
the terms and conditions set forth below.
NOW, THEREFORE, for and in consideration of the mutual covenants and agreements
made herein, the Parties agree to amend Section 4.a. of the Original Agreement as
follows:
4.a. The County agrees to appropriate for the provision of services described in Scope
of Services up to a maximum sum of 20 000. In addition, the County will
provide up to $7,500 in matching funds to the Provider, if the Provider receives
additional funds designated to perform low income spay/neuter surgeries to
qualified residents of Orange County.
Except for the changes made to Section 4.a. herein, the Original Agreement shall remain
in full force and effect to the extent it is not inconsistent with this Amendment. In the
event that there is a conflict between the Original Agreement and this Amendment, this
Amendment shall control.
IN WITNESS WHEREOF, Orange County and the Contractor have signed this
Amendment, effective this the -day of June, 2011.
