Notification Materials PURPOSE: To held a public hearing are a County initiated amendment to the 2030 Comprehensive Plan Land Use Element Map affecting 423 -acres bounded by Ben Wilson Rd., } Bowman Rd., west Ten Rd., and lnterst tes 85/40, which is also adjacent to the City of Mebane. BACKGROUND: The form in Attachment ent 1 contains additional information and analysis regarding this County initiated Land Use Element Map amendment CP -2011- 1 (Area "A" located in the u khorn- Mebane Utility Study Area. The maps in Attachment 2 show the location of the parcels, the current classifications and the extent of the proposed Commercial Industrial Transition Activity Node. No project is proposed at this time. One of the fundamental planning tools used to achieve the stated goals and objectives of the Comprehensive Plan Land Use Element is the design and application of a Lard Use Plan and Map. The Land Use Flan and Map reflect Orange County's vision for future land uses and is implemented primarily through the application of zoning. Rezoning onin in this area is not proposed at this time but could occur in the future through developer or County initiated amendments, which would also require public hearing. Notification Procedural Requirements In accordance with Section 2.3.6 of the Unified Development Ordinance, the public hearing for this item was advertised consistent with the requirements of the Ordinance. Legal ads were placed in two newspapers of general circulation in the County for two 2 successive weeks; notices were mailed to affected property owners and property owners ers within 500 -feet of affected properties; and a total of 12 signs were posted in strategic areas of the affected area. Attachment 3 includes the following: o Affected property owner notification letter 33 property owners) 318 Notification postcards 5.5" x 8.5") for property Dinners within 500 -feet of affected properties individual owners) The proof of the notification signs (sign is 24" tall x 32" wide, mounted on a wire "H" frame) FINANCIAL IMPACT: See Section C.3 of Attachment 1 RECOMMENDATION: The Planning Director recommends the Board: I . Receive the proposal to amend the Comprehensive Plan Land Use Element Map, 2. Conduct the Public Hearing and accept public, BOCC, and Planning Board comment on the proposed amendments. 3. Refer the matter to the Planning Board with a request that a recommendation returned to h County Board of Commissioners in time for the June 21, 2011 BOCC regular meeting. 4. Adjourn the public hearing until June 21, 2011 in order to receive and accept the Tannin Board's recommendation and any submitted written comments. UDO Minor Text Changes RATIONALE 0 Purpose/Mission T In accordance with the provisions of Section 2.3 Comprehensive Plan Amendments of the Unified Development ordinance, the Planning Director has initiated an amendment to the Land Use Element Map located within Chapter 5: Land Use Element of the Comprehensive Plan. The purpose of the amendment is to implement recommendation included in the County's adopted Efland-Mebane Small Area Plan} which will prepare area near the Bu i horn Economic Development District (EDD) for public water and surer infrastructure and economic development. This amendment is consistent with the water and Serer Management, ent, Planning and Boundary Agreement. WASMP A The proposed Land Use Element Map amendment is approximately 423_ acres. The area hounded by Ben Wilson Rd., Bowman fed., west Ten Rd., and Inter t tes 86/40 which is also adjacent to the City of Mebane. AMENDMENT IMPLICATIONS This amendment will provide consistency among the County's Land Use Element Map, water and Sewer Management Planning and Boundary Agreement, and water and sewer engineering design that is currently taking place for potential future service within the amendment area. Rezoning for economic development purposes cannot occur in this area unless a Land Use Element Map amendment is pr•o ed. This amendment wound also be consistent with proposed Burlington Graham MPO roadway plans and a future l-- interchange on Mattress Factory Road. Page 3 of 322 An � As required under Section 2.3.9 of the Orange County Unified Development Ordinance, the Planning Director is required to: "cause are analysis to be made of the application arid, based upon that analysis, prepare a recommendation for consideration by the Planning Board and the Board of County Commissioners. In analyzing this proposal, the following information is offered: 1. Staff has been authorized by the Board of County Commissioners to pursue small area plan implementation with a focus on economic development priorities. This proposed Land Use Element Map amendment conforms to the intent of the adopted Efland-Mebane Small ►r Plan which recommends this area for anon- residential and mixed use development and is consistent with economic development and land use objectives of the Comprehensive Plan. 2. The request for the amendment has been deemed complete in accordance with the requirements of Section 2.3.8 of the Unified Development Ordinance. 3. The properties subject to this amendment are currently located within the Agricultural Residential land use category as denoted on the Land Use Element flap of the Comprehensive Plan and proposed for Commercial-Industrial Transition Activity Node classification. 4. This notification is occurring in accordance with the provisions of Section 2.3 Comprehensive Plan Amendments of the Unified Development en Ordinance. This land use category could allow mix of office, retail, light industrial, and limited residential. Your property, or a portion thereof, is proposed to be included in the expanded Commercial - Industrial Transition Activity Node land use category. This action, if approved by the Board of County Commissioners, would create future rezoning potential from a low - density residential district to non-residential and higher density residential districts. This action does not affect the present use of your property and its zoning.
