7 The Orange County Board of Commissioners met on March 22, 1999 at 7:30 p.m. in the
8 Government Services Center, Hillsborough, North Carolina.

10 COUNTY COMMISSIONERS PRESENT: Chair Alice M. Gordon and Commissioners Margaret W.
11 Brown, Moses Carey, Jr., Stephen H. Halkiotis and Barry Jacobs
12 COUNTY ATTORNEY PRESENT: Geoffrey Gledhill
13 COUNTY STAFF PRESENT: County Manager John M. Link, Jr., Assistant County Managers Rod
14 Visser and Albert Kittrell and Clerk to the Board Beverly A. Blythe (All other staff members will be identified
15 appropriately below)

21 Chair Gordon welcomed everyone to the meeting.

23 1. Resolution Regarding Carrboro's Proposed Amendments
24 Geoffrey Gledhill said that what he is recommending is that the Board of County
25 Commissioners adopt the resolution on the pink sheet which objects to the proposed amendments
26 because "Orange County has not been able to determine that the proposed amendments are
27 consistent with the adopted Joint Planning Area Land Use Plan." The second part of the resolution
28 would make it take affect immediately prior to the commencement of the March 23, 1999 public
29 hearing on the proposed amendments but only if Carrboro does not extend the time within which
30 Orange County has to review the proposed amendments to a date beyond May 4, 1999. What this
31 says is that if Carrboro does not give us an extension, this would take affect.

33 Chair Gordon said that we are just asking for more time to comment on the proposed
34 changes. She made reference to the two letters in the packet.

36 Geoffrey Gledhill said that the Joint Planning Area (JPA) agreement requires the Board of
37 County Commissioners to object or not object prior to the commencement of the public hearing if
38 the entity which presents the proposal gives 30 days notice prior to the public hearing. Carrboro has
39 given us 30 days notice prior to the public hearing so the County Commissioners must object prior
40 to the public hearing. The letter in the agenda triggers the timeline on the JPA agreement.

42 Chair Gordon said that Orange County asked for 60 days and May 4 is shorter than that but
43 it is a meeting date.

45 Geoffrey Gledhill said that Carrboro has to give us more time before they open the public
46 hearing in order for this resolution to take affect.

48 Commissioner Brown asked what would be our schedule for reviewing it?

50 Chair Gordon said that this will be discussed on March 30. The only basis for objection is
51 conformance to the Land Use Plan (LUP). The staff will work up some talking points for that

1 meeting. No decisions will be made at this meeting but it would come back to the Board of
2 County Commissioners on April 20 for review.

4 John Link said that the staff would respond in terms of compliance of the proposed
5 amendments to the JPA agreement. Staff will make suggestions on these amendments.

7 The Board discussed transfer of development rights (TDRs) and how it would work in high-
8 density areas in those areas which are part of the master plan for Carrboro.
9
10 On March 30, the Board of County Commissioners will meet with the Carrboro Board of
11 Aldermen and will discuss the public hearing and when it will be held.

13 John Link said that there will be talking points sent out with the March 30 agenda.

15 Commissioner Brown said that she would like to have the comments from the Planning staff
16 reflect what the Northern Transition Area working group did over several months to determine what
17 they thought the area would be like, and what the plan reflects of that understanding.

19 Chair Gordon asked to have the agenda sent to the list of people from Carrboro who spoke at
20 a BOCC meeting before Christmas.

22 Chair Gordon said that she feels it is important that the Board of County Commissioners
23 decide before the March 30 meeting on areas of agreement and disagreement.

25 Commissioner Halkiotis said that he supports TDRs but feels that the citizens need to be
26 educated on what this really means. He feels that the County will be perceived as wanting
27 something different from what Carrboro wants. He feels it would be good to work toward this but not
28 if it will take a lot of staff time.

30 John Link said that he would come up with talking points that are doable and list some others
31 that may be long-range.

33 The County Commissioners indicated that they feel that TDRs could benefit everyone. The
34 Board decided to talk with Carrboro about the concept of TDRs at this time and not wait. The
35 County Commissioners feel this is an opportunity that should not be delayed.

37 Commissioner Jacobs feels it is important that Geoffrey Gledhill has some clarity on whether
38 or not Orange County has the legislation to do TDRs.

40 A motion was made by Commissioner Brown, seconded by Commissioner Halkiotis to
41 approve the resolution regarding Carrboro's Proposed Amendments to the Town's Land Use
42 Ordinance to Implement the Small Area Plan for Carrboro's Northern Study Area within the Joint
43 Planning Agreement as attached to these minutes as pages 4 and 5.

A motion was made by Commissioner Jacobs, seconded by Commissioner Carey to go
into closed session "To consider the qualifications, competence, performance, character, fitness,
conditions of appointment, or conditions of initial employment of an individual public officer or
employee or prospective public officer or employee;" NCGS 143-318.11(a)(6).
VOTE: UNANIMOUS
ADJOURNMENT
A motion was made by Commissioner Halkiotis, seconded by Commissioner Carey to adjourn
the meeting. The next regular meeting will be held on March 30, 1999 at 7:30 p.m. at the Southern
Human Services Center in Chapel Hill, North Carolina.
