PURPOSE: To conduct a public hearing, receive public comment, and make a recommendation
on the North Carolina Department of Transportation's Proposed 2009-2010 and 2010-2011
Secondary Roads Improvement Program for Orange County.
BACKGROUND: Chapter 136-44.8 of the General Statutes of North Carolina (NCGS) requires
that North Carolina Department of Transportation (NCDOT) meet with the Board of County
Commissioners at a public meeting to present and discuss with the Board and residents the
proposed secondary road paving projects (Secondary Roads Construction Program). NCDOT,
in compliance with NCGS 136-44.8, has posted a County map in the Orange County
Courthouse and the Southern Human Services Center showing tentative secondary road paving
projects. NCDOT also published notice of the public hearing in county newspapers (The Chapel
Hill News, The News of Orange, and The Mebane Enterprise).
NCDOT is nearing completion of the program's initial intent of paving all unpaved roads having
public rights-of-way. NCDOT proposes in the 2011-2012 Secondary Roads Improvement
Program improvements to paved secondary roads to upgrade the secondary road system
safety, functionality and overall operational efficiency, without adding capacity.
The 2009-2010 allocation for Orange County secondary roads totals $487,943 and the 2010-
2011 allocation totals $2,556,013 for a grand total of $3,043,956. The allocation includes:
I. Rural Paving Priority (7 road segments - 1.19 miles) $ 327,250
II. General Secondary Road Improvements, Paved Road Improvements $ 2,675,000
IV. Surveying, right-of-way acquisition, additions, contingencies,
overdrafts, etc. $ 41,706
Total $3,043,956

Attachment 1 shows the location of the roads and Attachment 2 lists the specific road segments
and construction cost estimates.
The program is subject to the availability of funds, rights-of-way, and environmental and
historical review. If right-of-way is not available on the specified unpaved roads, or if additional
funds are allocated, other roads will be programmed in order of priority.
In accordance with North Carolina General Statute §136-44.8, "the board of county
commissioners may:
(i) concur in the construction program as proposed, or
(ii) take no action, or
(iii) make recommendations for deviations in the proposed construction program, except
as to paving projects and the priority of paving projects for which the board in order to
make recommendations for deviations, must vote to consider the matter at a later public
meeting ..."
FINANCIAL IMPACT: There is no direct County financial impact associated with this decision
item.
RECOMMENDATION(S): The Manager recommends the Board:
1. Hold the public hearing to discuss and receive comments regarding the 2009-2010 and
2010-2011 Secondary Roads Construction Program for Orange County;
2. Close the public hearing; and
3. Concur with the proposed program.
