ORANGE COUNTY BOARD OF COMMISSIONERS
RESOLUTION IN CONCEPTUAL SUPPORT OF CONGESTION MITIGATION
AND AIR QUALITY FUNDING ALLOCATION TO ORANGE COUNTY, NORTH
CAROLINA FOR A TRANSIT CENTER INCLUDING A PARK AND RIDE
FACILITY AND NEW ORANGE PUBLIC TRANSPORTATION INTRA-
HILLSBOROUGH ROUTE
WHEREAS, the United States Congress included requirements in Section 176(c)
of the 1990 Clean Air Act Amendments, Public Law 101-549, November 15,
1990, for federally assisted transportation programs to ensure the timely
implementation of transportation control measures as specified in the state air
quality implementation plans and to provide the highest priority for funding to
implement these transportation control measures; and
WHEREAS, the United States Congress assured the compliance with these
transportation control measures through the provision of the Congestion
Mitigation and Air Quality (CMAQ) Program and Categorical Funds in the
Intermodal Surface Transportation Efficiency Act (ISTEA), Public Law 102-240,
December 18, 1991, and through its reauthorization of the CMAQ Program and
Categorical Funds in the Transportation Equity Act of the Twenty First Century
(TEA-21), Public Law 95-198, June 6, 1998; and
WHEREAS, the CMAQ program has been officially transcribed into federal
surface transportation regulations and policies under Title 23, Chapter 1, Section
149 of the United States Code; and
WHEREAS, the primary purpose of the CMAQ Program has been to fund
transportation projects and programs in air quality non-attainment and
maintenance areas which will reduce transportation related emissions; and
WHEREAS, the Federal Highway Administration and the Federal Transit
Administration have been directed through federal programs to recommend to
state transportation departments and local transportation planning organizations
the identification of transportation control measures and related projects to
provide alternatives to single occupancy vehicle use and to reduce vehicle miles
of travel; and
WHEREAS, these transportation control measures may include projects for
improved public transit, high occupancy shared ride services, employer based
transportation management plans and flexible work schedules, and other
appropriate projects to reduce vehicle miles of travel in air quality impacted
areas; and

WHEREAS, the eligibility provisions under TEA-21 allow any area designated as
non-attainment or maintenance for carbon monoxide, ozone, or fine particulate
matter (PM2.5) after December 1, 1997 to be eligible for CMAQ federal funds;
and
WHEREAS, Orange County, North Carolina was designated as non-attainment
for the national eight hour ozone standard on April 15,.2004.
NOW, THEREFORE, BE IT RESOLVED, that the Orange County Board of
County Commissioners conceptually endorses the attached Congestion
Mitigation and Air Quality (CMAQ) Program grant application for a Transit Center
at the Durham Tech satellite campus site at Waterstone, including a Park and
Ride Facility and new Orange Public Transportation Intra-Hillsborough service,
for submittal to the Transportation Advisory Committees of the Durham-Chapel
Hill-Carrboro Metropolitan Planning Organization and the Triangle Area Rural
Planning Organization.
FURTHERMORE, BE IT RESOLVED, that Orange County, subject to any
additional information and review, commits to providing the required local match
for each year's allocation of these CMAQ grant funds for capital and operating
costs and future operating expenses -for the Intra-Hillsborough route.
