BACKGROUND: This request includes two petitions for road additions to the State Maintained Secondary Road System. The roads are as follows: 1. Efland Estates Subdivision Section 2 Cain Drive -- Attachment 1a - Ma The requested road addition is about 9.12 -mile long. Ten houses have entrances to the road submitted for addition. The background research showed that Efland Estates Subdivision was recorded in 1972. The County did not adopt subdivision regulations in the Cheeks Township, where the subdivision is located, until 1978. As a result, this project was not reviewed or approved by the county. However, a review of the plat shows that it meets the policy adopted by the Board of County Commissioners (BOCC) for recommending roads for addition to the State Secondary Road Maintenance System: a) right-of-way (ROW) extends to the edge of the property to provide connectivity; and b) irons have been set at the edge of ROW. County Planning Department staff will work with NCDOT on installing a sign at the end of Cain Drive stating that the road is a subject for future extension for connectivity purposes. The Cain Drive petition is the second road addition petition for the Efland Estates subdivision. The BOCC approved a petition for Gregg Street -- a 0.018 -mile long road addition located in the subdivision as a part of a December 5, 2919 consent agenda. 2. Hi h Rock Village Subdivision (Virginia Lee Lane Sun low Court Stacy court -- Attachement 2a- Map Z The BOCC approved High Rock Village Subdivision through the major subdivision process on January 31, 2003 with Virginia Lee Lane, Sunglow Court, and Stacy Court designated as public roads. The subdivision roads provide access for 25 homes: • Virginia Lee Lane —14 homes (0.53 -miles long, paved, 50 feet right -of -way) • Sunglow Court — 4 homes (0.09 -miles long, paved, 50 feet right -of -way) • Stacy Court— 7 homes (0.16 -miles long, paved, 50 feet right -of -way) The subdivision is located east of the High Rock Road /Mill Creek Road intersection, Cnnaliminn All above- referenced applications meet the criteria endorsed by the BOCC for recommending acceptance of a public road into the State Maintained System for roads approved through the governing jurisdiction's major subdivision process. NCDOT has investigated these requests (please refer to attachments lb and 2b) and .has submitted petitions to the BOCC for its review and recommendation. In accordance with North Carolina General Statute §136 -62 *, the Board is required to make a recommendation regarding the petitions to the North Carolina Board of Transportation ( NCDOT) before the NCDOT can consider the petitions. FINANCIAL IMPACT: There is no direct financial impact to the County associated with this item. NCDOT will incur additional maintenance responsibilities and costs. RECOMMENDATION(S): The Manager recommends the Board: 1. Forward the Petitions for Addition to the State Maintained System to the North Carolina Department of Transportation for subdivision roads in: a. Efland Estates Section 2; and b. High Rock Village Subdivision 2, Recommend the Department of Transportation accept the roads for maintenance as State Secondary Roads. * North Carolina General Statute §136 -62 directs that "The citizens of the State shall have the right to present petitions to the board of county commissioners, and through the board to the Department of Transportation, concerning additions to the system and improvement of roads. The board of county commissioners shall receive such petitions, forwarding them on to the Board of Transportation with their recommendations."
