CONTRACT
This contract is made and entered into this 1St day of July, 2004, by Orange County,
North Carolina, a body politic and corporate, a political subdivision of the State of North
Carolina (hereafter "the County'), and the Chapel Hill-Carrboro City Board of Education,
a body corporate (hereafter "the Board of Education").
WITNESSETH
Whereas, the County is member county of the Hyconeechee Regional Library,
Incorporated, and the operator of the Orange County Public Library (hereafter "the
Library"), which operates under Art. 14, Chapter 153A, of the North Carolina General
Statues to give library services to the residents of Orange County; and
Whereas, the Library operates to give library service to the residents throughout the
county and by this contract provides additional library service in southern Orange
County.
THEREFORE, IT IS AGREED THAT:
1. Term. The County and the Board of Education agree to enter into this Contract
for a period of one year beginning July 1, 2004.
2. Organization. The library located in the McDougle Middle/Elementary Schools is
a Branch of the Library (hereafter "the Carrboro Branch of the Library") and the Library
employees working there are employees of the County and report to the Library Director.
The Board of Education provides office space and utilities for the Carrboro Branch of the
Library.
3. Operation. The Carrboro Branch of the Library will be open to the general public
throughout the year for a maximum of twenty-six hours per week, said hours being 3:30
pm to 8:00 pm Monday through Thursday, 10:00 am to 2:00 pm on Saturday and 1:00 pm
to 5:00 pm on Sunday. In no case will the Carrboro Branch of the Library operate during
school hours. Patrons of the Carrboro Branch of the Library will enter and exit only
through the main entrance of McDougle Middle School. When open to the public, the
policies and procedures of the Carrboro Branch of the Library, including selection of
materials, Internet use, and material challenges, will conform to the policies of the
Hyconeechee Regional Library, Incorporated. To supplement materials already owned,
the Carrboro Branch of the Library may borrow materials upon special request. The
County in its operation of the Carrboro Branch of the Library, agrees to undertake the
following responsibilities:
(a) The Carrboro Branch of the Library will assume all duties associated with
overdue materials from public patrons, including sending overdue notices.

(b) The County shall furnish books, periodicals and other library materials to the
Carrboro Branch of the Library in such quantities as the Library Director may
determine in consultation with the Carrboro Branch of the Library Librarian.
(c) The Library provides borrower cards for all patrons of the Library, and such
cards will be honored in the Carrboro Branch of the Library according to
established policies and procedures.
(d) The County shall provide weekly delivery service to the Carrboro Branch of
the Library and emergency delivery as soon as possible following a special
request.
4. Revenue and Expenses.
(a) Revenue collected for lost or damaged materials is the property of the County
or the Board of Education, whichever purchased the materials lost or
damaged.
(b) The County shall maintain, repair, and insure all furnishings and equipment
belonging to or purchased by the County for the Carrboro Branch of the
Library.
(c) The School Board shall maintain and repair so much of McDougle
Middle/Elementary Schools and its furnishings as is associated with the
Carrboro Branch of the Library except as otherwise provided for in this
Contract.
(d) The County shall appropriate $1500 to the Board of Education for media and
technical support related to the function of the Carrboro Branch of the Library
and $1500 per year each and every year this Contract is renewed.
(e) The County will fund one hour of custodial support for every five hours the
Carrboro Branch of the Library is open. The Board of Education agrees to
hire and supervise the person providing this support and to invoice the
County, based on the County's share of the expense for this service. The
County's responsibility for custodial services will not exceed $5250 for the
term of this Contract. This cap will increase 5% per year each and every year
this Contract is renewed.
5. Liability. The Board of Education is responsible for repairing or replacing the
Board of Education equipment damaged or stolen. The County is responsible for
repairing or replacing the County equipment damaged or stolen.
6. Breach. The failure of either party to fulfill any of its herein listed obligations
shall constitute a material breach if not cured within thirty days of written notice.
7. Amendment and Renewal. This Contract will be reviewed at any point at the
request of either party. As needed, policies and procedures may be changed by written
agreement between the Board of Education Director of Instructional Technology and
Media and the Library Director. This Contract shall automatically renew for successive
one year periods unless the Library Director or the Board of Education Director of
Instructional Technology and Media provides written notice of intent not to renew this
Contract within thirty days of the expiration of the then current contract term.
