At joint meeting of Town and County boards, Mayor proposes
annexation of Fairview Park. Expansion of Fairview Park is
discussed.
1999 -2000
Fairview resident James Stewart constructs baseball field
( "Field of Dreams ") atop portion of abandoned landfill.
2000
County hires engineering firm to conduct
environmental /geotechnical analyses of the property. New
areas of landfilling identified, soils analyzed.
2001
County voters approve Parks and Open Space Bond,
including funds for county and town parks. Bond includes
$850,000 for Fairview Park
2002 -03
County improves ballfield, local teams play until concerns are
raised about health and safety as some landfilled materials
emerge during grading and dragging of field.
2002
Town of Hillsborough constructs new police substation
(including meeting room used by community) next to
playground on County property.
2004 -05
Improvements to playground and picnic area. Ballfield
maintenance is increasingly a problem — no further organized
play.
2004
County and Town adopt a Memorandum of Agreement to
work together on a master plan to use both properties and
create a park and potential joint public works facility on
adjoining land.

County and Town jointly apply for Parks and Recreation Trust
Fund ( PARTF) grant of $500,000 to augment available funds
for the park, but grant is not awarded. Conditional Use Permit
for the park is submitted and ultimately approved by Town.
2008
Town and county agree to cost -share for portion of sidewalk.
2009
Town and County staff meet to outline a possible MOU for
park operation. Proposed MOU is discussed at February joint
meeting, no action taken.
2009
Town and County jointly reapply for PARTF grant, and are
awarded $500,000 in summer. County proceeds with plans to
bid construction of park.
2009
Groundbreaking ceremony held with Town and County
officials and community residents, along with plant rescue.
2010
Construction of Fairview Park begins. Town and County both
appropriate funds in budget for Fairview Park operations and
maintenance. The need for an additional Interlocal Agreement
(ILA) regarding operations and maintenance, safety and other
logistical concerns is identified, and management/staffs from
the two jurisdictions develop a draft. A revised version of the
ILA is proposed, deleting Town funding contributions, and is
agreed to by both boards in November.
2011
Construction continues and is now substantially complete,
pending good weather. Possible grand opening considered for
April.

MEMORANDUM OF AGREEMENT
TOWN OF HILLSBOROUGH
COUNTY OF ORANGE
REGARDING PLANNING FOR FAIRVIEW PARK, COUNTY
PARKS OPERATIONS BASE AND
TOWN AND COUNTY PUBLIC WORKS FACILITIES
THIS AGREEMENT, made and entered into between the Town of Hillsborough, North
Carolina, a North Carolina municipal corporation, 101 East Orange Street, Hillsborough, North
Carolina 27278 (hereinafter referred to as the `Town'), and Orange County, a body politic and
corporate, a political subdivision of the State of North Carolina, 200 South Cameron Street,
Hillsborough, North Carolina 27278 (hereinafter referred to as the "County'% for the joint
development of a park and public facility campus.
WHEREAS, the parties to this agreement are public bodies, politic and corporate, under the laws
of the State of North Carolina; and
WHEREAS, the parties are vested. with the power and authority to own and improve real estate
for recreational and other public purposes; and
WHEREAS, the Fairview area of Hillsborough has a designated park site (hereafter "the
Fairview park site) that was established as part of the Community Revitalization effort funded
through Community Development block Grants in the 1980s, and identified in both the County
and Town Comprehensive Plans; and
Vf at.EAS, limited facilities have been constructed at the Fairview park site, including a
playground and playing field; and
WHEREAS, the 2001 Park and Open Space Bond for Orange County included $850,000 for
planning and construction of the Fairview park site; and
WHEREAS, the Town and County both own property including and in the immediate vicinity of
the Fairview park site, including the Orange County Public Works facility, totaling 92 acres; and
WHEREAS, the Town and County recognize. the mutual benefit and interest of the parties
hereto, and to the public generally, in the construction of park and community facilities on the

Fairview park site and other Town and County owned property in the vicinity of the Fairview
park site; and
WHEREAS, it is recognized by both parties that there are limitations imposed by safety
considerations caused by the Fairview park site's previous use for waste - disposal purposes, as
addressed in part by a geo-technical report ( "Report of Geotechnical Evaluation, Closed
Hillsborough Landfill Site, July 19, 2000") in 1999; and
WHEREAS, the parties recognize the mutual benefit in the County aching as the lead entity m
the construction and financing of facilities at the Fairview park site (but not the Town's proposed
Public Works facility), to be Built with funds from the 2001 bond amount of $850,000; and
WHEREAS, the laws of the State of North Carolina provide that the parties hereto may contract,
for the joint design, construction, development and use of facilities for the stated public
purposes; and
WHEREAS, the parties hereto agree to allow master planning for the future construction and use
of all of the three properties identified on the map in Attachment 1 to be developed and
programmed for public activity as one unit meeting mutual needs contingent on future approval
of plans for the properties by the entity or entities having jurisdiction to approve such plans; and
WHEREAS, the funding for any additional facilities or activity at the Fairview park site (beyond
the $850,000 currently appropriated by the County for Phase II of the park) will be addressed by
the County and Town in a mutually-agreeable fashion at a later date:
NOW, THEREFORE, in consideration of the foregoing and of the mutual promises and
obligations set forth herein, the receipt and sufficiency of which is hereby acknowledged, the
parties agree as follows:
I. PROCESS FOR PLANNING & DESIGN OF PARK. COUNTY LARKS
OPERATIONS BASE AND TOWN AND COUNTY PUBLIC WORKS FACILUM
Ilm process for planning and designing the Fairview park site, County Parks Operations Base
and Town and County Public Works facilities will encompass the Iand currently owned by
both the Town and County in the immediate vicinity of the Fairview park site (as shown in
the map in Attachment 1). Together these parcels represent gWximately 92 acres and are
hereinafter collectively referred to as "the Site." The Planning for the Fairview Park and
County Parks Operations Base will focus on the parr but will also consider and address, to
the extent possible, the interests of both the Town and County, to locate additional, facilities
on the property, such as the County Parks Operations Base and Town and County Public
Works facilities.
The County and Town will appoint, as soon as practical, a Master Plan Committee to develop
recommendations for the design and use of the Site. The Committee shall be appointed by
approval of both County and Town Boards of Commissioners, and shall consist of the
following charge and membership:

A. CHARGE to the Master Plan Committee:
Develop a Master Plan for the Site, within the fiamework of any operating guidelines or
other instructions as offered by the elected Boards, to include tho following.
1. A map of the Site with the design for the Fairview Park, including proposed
buildings, playing fields, roads, parking, trails, other facilities, amenities,
infrastructure locations, vegetative cover, hydrology and other components that
are commonly included in a park or public facility concept plan. The map of the
Site shall include existing and planned buildings of the County Parks Operations
Base and the Town and County Public Works facilities. Planning of the County
Pafs Operations Base and the Town and County Public Works facilities is
limited to the location of buildings, roads, parking and other infrastructure.
2. A written report outlining the proposed uses, the design rationale, description of
work group process, nataaal and cultural features, means of soliciting community
input, the potential future phases, and construction cost estimates. If needed, the
report should also include a phasing plan, showing how the Fairview Park and
other public facilities could be developed over time -in a cost - efficient fashion.
The report should include a recommendation concerning which facilities should
be constructed, utilizing the fiords remaining from the $850,000 allocated for the
project after the planning, design, and survey work (estimated to cost $200,000)
have been completed
3. The report should address and recognize the limitations imposed by safety
considerations caused by the Fairview park site's previous use for waste - disposal,
as addressed in part by a goo- technical report prepared in 1999 ("Report of
Geotxchnical Evaluation, Closed Hillsborough Landfill Site, July 19, 2000'x.
Further recommendations may be needed to address phased remediation of
portions of the Fairview park site.
4. The Master Plan should address co- location of existing and future public facilities
and provide for a synergy and compatibility of uses between park functions and
other public fimctions wherever possible. The rights of neighbors should be
respected by buffering incompatible uses.
5. The Committee should review the "old" 1988 Fairview Park Concept Plan as part
of the Master Plan and determine its validity, if any.

Final Steps: Once completed, -the Master Plan will be submitted to both' Boards of
Commissioners for approval. The Boards may approve the Plan, remand it back for farther
work, identify revisions and alternatives, or decide not to pursue the Master Plan.

Directors, and other staff members as shall be deemed necessary.
Operating principles for the Master Plan Committee should include the following.
1. The Committee should review and consider the 1988 Concept Plan and determine its
validity and usefidness
2. The Committee should consider impacts on the County Parks Operations Base and
the Town and County Public Works facilities in developing the Master Plan,
incorporating these facilities into the scheme of the Master Plan as far as practical.
3. The Committee is asked to address and site the following as part of the Master PIan:
Active and Iow- impact recreation facilities
• Provision of buffers for adjoining neighborhoods
• Protection of sensitive natural resource lands.
• Reflect existing and proposed County Parks Operations Base and Public
Works facilities and the infrastructure necessary for these facilities
4. The Committee should not address the following facilities as part of the Master Plan:
Y Orange County Public Works expansion or a Town of Hillsborough Public
Works facility — beyond the Site infrastructure design and designating the
areas for such activities on the Master Plan
County Parks Operations Base — beyond the Site infrastructure design and

3. PROCESS FOR CONSTRUCTION. OPERATION AND MAINTENANCE, AND

The Master Plan Committee shall recommend the following with respect to a further
interlocal. agreement between the Town and County.
I. the roles and responsibilities of the park and facility construction process;

2. The roles and responsibilities for operation & maintenance of the parr -including
contributions for operation and maintenance;
3. The roles and responsibilities for programming of the park
4. If desired, mechanisms for finding of additional facilities in Master Plan beyond
the County's $850,000 for the park
5. Process for deciding how to embark on next phases, joint agreement, etc.
4. AMENDMENTS
This agreement may be amended by mutual written agreement of the Town and County.
S. TERM
This agreement shall terminate '(a) upon the decision by time Boards of Commissioners of the
Town and County on the Master Plan, adoption of a Town and County construction and
operations interlocal agreement and the "sunsettmg" of the Master Plan Committee, or (b)
sixty (60) days after either party serves written notice on the other of its intention to terminate
the agreement.
6. GOVERNMENTAL APPROVALS
Nothing in this Agreement shall be construed as waiving, modifying or granting any local
government permits or approvals which may. be necessary for the development and/or
construction of any facilities or improvements, nor shall it be construed as creating any
additional permit or approval process beyond that provided in the applicable local-land use
regulations. It is contemplated that the County will be responsible for seeking and obtaining .
such local government approvals as may be necessary for any work undertaken pursuant to an
approved Master plan. The party responsible for this work shall be identified in a subsequent
interlocal agreement.

This Agreement constitutes the entire Agreement of the parties hereto.

Recommendations of the Committee
Note: In reviewing the master plan and the following recommendations, it may be useful
to think of the master plan for the site as having three sections, or pods.' The southern
pod' includes the majonly of proposed park facilities and would be accessed from Torain
Street or the connector tral (see below) - or for persons outside of the neighborhood,
from the NC 571 NC 86 intersection. The "wastem pod' is kbcated adjacent to the existing
community porting station and is adjacent to Rainey Avenue. The eastern pod'
contains the County Public Works site and future Town Pubrc Works site, a" with
other planned future County facififies. The reason for the 'pod' design approach is
explained in the rationale section on page 6.
After considering all of the above information and discussing the
possibilities, the Committee recommends the foll owing actions as
facility improvements for Phase 2 of the park:
1. That the following facilities be constructed as Phase 2 of the
Fairview Park as the top priorities (as shown on the attached
Master Plan map on page 4). These facilities are listed in
priority order, with the understanding that some facilities may
need to be deferred based on available funds:
• Two hard- surface lighted basketball courts, located the
"southern pod."
• A full-size ,youth baseball/softball field, located in the
southern part of the site.
• Two new Rlaygrounds, one near the new ballfield in the
"southern pod," and a replacement playground in the
"western pod" near the existing structure and police
station.
• A picnic shelter with concessions bay (and possible
restroomsI located near the new ballfield in the
"southern pod"
• Walking trails of approximately % mile in total, with a
main trail connection between the ballfield ( "southern
pod"). and the police station / playground ( "western
pod "). There would also be a trail around the new
ballfield, with spur to the southern parking lot and Torain

Street, and a connection to Rainey Avenue at Homemont
Avenue.
• Three tennis courts, located adjacent to the new balltield.

While not a park facility per se, amain parking lot and access
road is also proposed from the east and the NC 86 / NC 57
intersection. A smaller parking lot would be located on Torain
Street, and the existing parking at the "western pod" police
station /playground would also be retained.
2 It is proposed that the former landfill areas on the northern part
of the site be maintained in grass and allowed to be used
informally for non-structured activities (dog-walking, open
meadow, bird- watching).
3. Opportunities for integrating environmental education and
habitats in conjunction with the former landfill should be
considered, including signage.
4. Interest exists in both a community room and use of the former
landfilled areas for subsequent phases of the park as
opportunities arise and Town /County funds permit.
5. The Town and County may wish to pursue additional funding
through grants (Parks and Recreation Trust Fund, US tennis
Association, for example) and future bonds, to enable the
construction of more facilities at the park.
6. Once the master plan is finalized and a construction schedule is
identified, a copy of both should be placed at the Fairview
Community Policing Substation for community information. A
sign noting "Future Site of Fairview Park" would also be
helpful.
7. The facilities planned for the "eastern pod" (the Public Works
and County Facility portions of the site) have been sketched in

on the master plan. as per the Committee's charge. It is our
understanding the exact location of these future activities wfll
be addressed at a subsequent time.
Master Plan Rationale
As the master plan design unfolded, the Commidw became aware that the
majority of the proposed.acirvity would need to be located.in two `pods' of the
park This was made apparent by the uncertainty surrouncling use of the former
ianditlled areas • and the existing plans for the County and municipal future uses
on the eastern part (eastern pod) of the site. Therefore, the fatuities were
designed to avoid these areas, work around the existing stream buffer, and try to
protect as much of the mature hardwood forest in the southem part of the site as
possible.
However, the remaining best usable land was largely located in the 'southern
pod' near the hardwoods area. The master plan sites most of the facilities of the
park in this area, while preserving a block of the hardwoods. The design attempts
to keep as much of this area Mad as posslbK and sites only a picnic shelter
and playground (which can be nestled among the trees). The larger facilities are
located to the north and west of the best part of the hardwoods. Specimen trees
of large caliper or age were also protected. The retention of this forested area will
also serve as a troffer for residents along Torain Street. The Town of
Hillsborough plans to construct a 10.000 to 12,000 square foot Public

The second pod of activtty ts- smaller and would be located near the existing
Hillsborough Community Policing Station. The group recognized that there is an
arbor and history of using this area, termed the 'western pod'. as a gathering
spot, and while the available or usable land is limited, some facilities would be
retained here. These facilities are also easily accessed from Rainey Avenue.
To facilitate greater accessibility between the two pods of park activity, a
connector trail is proposed that offers a direct way of moving from the ' westem
pod' (police station/picnic/playground area) to the `southern pod' (ballfield and
other fac lutes). This 1000 -foot trail also allows persons entering the park from

either Torain Street or Rainey Avenue to access the other portion of the park. In
addition to this trail, trails around the ballfiield and a connector trail to the
intersection of Rainey and Homemont Avenue are also reflected. Thus,
pedestrians could enter the park from Rainey Avenue, Torain Street or
Homemont Avenue, as well as from other intersections with Rainey Avenue.
Access for non - pedestrians would come via three possibilities. The primary
entrance for persons coming to the park from outside of Fairview would be via an
extension of the existing Public Works Drive. This road would be continued west
and then curve northwest into the main parking area of the park (adjacent to the
ballfield and large 'southern pod'). This will discourage park traffic from outside
of the neighborhood from putting more vehicles on community streets to reach
the park. For persons driving from within Fairview, there are two parking
opportunities — the existing lot off Rainey Avenue at the 'western pod; and a
new small lot along Torain Street near the ballfield and 'southern pod.'
The committee remains interested in the future possibilities for the northern
(former landfilled) portion of the site, but understands that addressing the actions
needed to make this area usable might siphon away some or all of the funds to
build the park. The focus of the master plan is thus to create a design that
provides for good pedestrian and vehicular access to the park, using the best
areas for facilities and leaving the uncertain open areas for future consideration.
It is proposed that the former landfill areas (shown as open lands on the master
plan) be planted in grass for now, to provide an open meadow area, with
birdboxes and areas for unstructured activities (such as dog - walking, bird -
viewing and other non - facility use).
In designing the park, the group developed a list of possible facilities and then
selected preferred facilities based on community needs and interests, as well as
cost estimates for the facilities. The cost estimates used in this effort and the
priority listing, are shown as Appendix 3. The budget for the park is $850,000,
and the Committee attempted to design a park in this range.
CONCLUSION
Citizens in Fairview have looked forward to the creation of the community park at
this site for many years. The Committee has attempted to design a park within
the parameters of the group's charge.
There were a number of limitations that affected the flexibility for park design,
largely due to the former landfilled areas and the challenges of retaining the
needed lands for future County/Town use and protecting the mature hardwood
areas and a buffer along the southern boundary. Given these constraints, and
the stream buffer, the areas that remained for potential park use were limited and
led to the "pod' design approach - to attempt to make the most out of the areas

of the site that were usable. The pod design also helps promote pedestrian
access to different portions of the site, and directs traffic to the park away from
the residential streets in Fairview.
The Committee thanks the Orange County and Town of Hillsborough Boards of
Commissioners for the opportunity to develop this master plan design, and
eagerly looks forward to seeing Fairview Park come to fruition. In this spirit, the
Fairview Master Plan Committee commends this report to the Town and County
Boards of Commissioners.

REGARDING FAIRVIEW PARK OPERATIONS AND RESPONSIBILITIES
THIS AGREEMENT, made and entered into between the Town of Hillsborough,
North Carolina, a North Carolina municipal corporation, 101 East Orange Street,
Hillsborough, NC 27278 (hereinafter referred to as the "Town "); and Orange
County, a body politic and corporate, a political subdivision of the State of North
Carolina, 200 South Cameron Street, Hillsborough, NC 27278 (hereinafter
referred to as the "County "), for the.joint and /or assigned operations and
responsibilities of Fairview Park, located in Hillsborough, NC.
WITNESSETH
WHEREAS, the parties to this agreement are public bodies, politic and corporate,
under the laws of the State of North Carolina and are vested with the power and
authority to own and improve real estate for recreational and other public
purposes; and
WHEREAS, the Fairview neighborhood of the Town of Hillsborough adjoins a
designated park site that was identified as part of the Community Revitalization
effort funded through Community Development Block Grants in the 1980s, and
identified in both the County and Town Comprehensive Plans; and
WHEREAS, the 2001 Orange County Parks and Open Space Bond included
funding for planning and construction of Fairview Park; and
WHEREAS, the Town and County both own property within the said Fairview
Park site (hereinafter "Fairview Park "), and the Town's corporate limits abut the
site on three sides; and
WHEREAS, the County and Town recognized the mutual benefit and interest of
the parties hereto, and to the public generally, in the construction of park facilities
on Town and County owned property for Fairview Park, with the Town agreeing
to donate its land toward this purpose; and
WHEREAS, the Town and County entered into a Memorandum of Agreement in
2004 regarding use of both Town and County lands together for Fairview Park,
and a process for creating a master plan for the park, as shown as Attachment 1
to this Agreement; and

WHEREAS, it is recognized by both parties that there are limitations imposed by
safety considerations caused by the site's previous use for waste - disposal
purposes, as addressed in part by a geo- technical report ( "Report of
Geotechnical Evaluation, Closed Hillsborough Landfill Site, July 19, 2000 ") that
have affected the potential locations within the site for a park; and
WHEREAS, a Fairview Park Master Plan was created by a committee of County
and Town representatives in 2006 and was subsequently adopted by both the
Town and County Boards of Commissioners; and
WHEREAS, the County and Town jointly applied for and received grant funding
for park construction from the N.C. Parks and Recreation Trust Fund in 2009;
and
WHEREAS, the laws of the State of North Carolina provide that the parties
hereto may contract, for the joint design, construction, development and use of
facilities for the stated public purposes; and
WHEREAS, construction of park facilities began in early 2010 upon awarding of
a construction bid following open bid solicitation procedures, and is currently
underway located on both Town and County -owned portions of the site; and
WHEREAS, the parties hereto agree to address needed property exchanges for
public safety and liability concerns, Town contributions to park operations and
potential annexation into the Town of Hillsborough, among other matters:
NOW, THEREFORE, in consideration of the foregoing and on mutual promises
and obligations set forth herein, the receipt and sufficiency of which is hereby
acknowledged, the parties agree as follows:
1. PROPERTY EXCHANGES AND ACCESS EASEMENTS
a. In order to address potential liability issues and simplify ownership
boundaries which find facilities located on or across property lines,
the Town and County agree to an exchange of properties within the
Fairview Park site (please see Map 1 -a and 1 -b).
i. The County will convey to the Town approximately one (1)
acre of land along Rainey Avenue including the existing
Town of Hillsborough Police Department, Fairview
Substation and its adjoining parking area, as shown in Map
1 -b.
ii. The Town will convey to the County its portion of land
containing the facilities for Fairview Park, along with a
connecting strip of land as shown in Map 1 -b.
iii. Three easements will be executed as part of this land swap:

1. The County will grant an access easement to the
Town for use of its private road serving the County's
Public Works facility to NC 86.
2. The County will grant an unspecified easement to the
Town to cross the County's property to access the
Town's storm debris site as shown on Map 1 -b.
3. A third one, from Town to the general public and
Orange County specifically for use of and access
across the substation parking lot (for access to the
remainder of the park)
iv. The Town and County will share the costs of surveys for
these land conveyances, and will be responsible for their
own legal expenses related to same.
2. TOWN CONTRIBUTIONS TO OPERATING EXPENSES
a. The Town will provide for water and sewer service at no cost to the
park restrooms, picnic shelter and water fountains.
b. The Town will be responsible for the opening and closing of any
gate to the park, if such is deemed necessary, on a mutually -
agreeable schedule and at the Town's discretion.
3. PUBLIC SAFETY COVERAGE FOR THE PARK
a. The Orange County Sheriff's Department will be the initial primary
provider, with the Town Police Department supporting and assisting
in this capacity. It is anticipated that over time the Town and County
will review response to calls in the park and make adjustments to
responsibilities as needed and prudent.
4. AMENDMENTS
This Agreement may be amended by mutual written consent of the Town and
County. The Agreement will be reviewed at least once every five years for
needed changes and updates.
Any future improvements to the Park after the date of this agreement will be
considered by both the Town and County.

5. TERM
This Agreement shall terminate upon mutual agreement of the Town and
County Boards of Commissioners; or on December 31, 2015. The parties
commit to review and consider renewal of the Agreement on or before
December 31, 2015. This agreement is renewable with mutual agreement of
the two governing bodies.
6. GOVERNMENTAL APPROVALS
This Agreement is subject to the review and approval of the Town and County
Boards of Commissioners.
7. ENTIRE AGREEMENT
This Agreement constitutes the entire Agreement of the parties hereto.

Justification for the Project
Fairview Park Development (Phase 1)
Orange County / Town of Hillsborough
Orange County is working in cooperation with the Town of Hillsborough on the development
of Fairview Park —a community park that has been in the planning stages for 25 years. The
park will be constructed on a site owned by the two jurisdictions, and will be managed by the
Orange County Parks and Recreation Department consistent with an interlocal agreement..
The idea for the park was conceived in 1983 when Orange County acquired 42 acres from
the Town as part of a Northern Fairview Community Redevelopment Plan. A conceptual
plan for a community park was completed in 1986 and was included in the County's 1988
systemwide parks and recreation plan. A small picnic area with playground and gravel
parking was developed in 1990. Further construction of the park was halted, however, when
a series of severe storms struck Hillsborough over a 10 -year period (1990 Tornado, 1996
Hurricane Fran, 2000 ice storms). A portion of the park property was used as a staging area
for the storage and handling of storm debris (organics only). The Fairview community would
have to continue their long wait for the construction of their park.
In 2001 Orange County and the Town of Hillsborough decided to collaborate on the planning
and design of Fairview Park. They formed a Master Plan Committee that included elected
officials from both local governments and residents from the Fairview community. The
committee held a series of public meetings in 2005 -06 to develop a park master plan, which
would locate new facilities on the adjoining government parcels. Both the Town and County
elected boards adopted the Fairview Park master plan in late 2006.
Fairview Park will feature a combination of active and passive recreational facilities that
were selected based on a survey of community needs and residents' participation in the
master plan. The park will be co- located with an existing Hillsborough police substation,
which is already used for community meetings. Fairview Park will be an easy walk for many
Fairview residents and easy biking distance from downtown Hillsborough. It will also help to
implement the Town of Hillsborough's Parks and Recreation Master Plan (adopted 2007).
The estimated cost for completing Phase I construction is $1,213,500. The requested
PARTF grant of $500,000 would be matched with County bond funds budgeted specifically
for Fairview Park development. The County has completed a cultural /archaeological survey
of the.property and has received development permits from the DENR Division of Land
Resources (November 2008) and the Town of Hillsborough (December 2008).
The Fairview community has waited a very long time for the development of this park.
Residents have urged County and Town officials and staff to make every effort to proceed
with park construction. The park will establish a new gathering place for leisure, exercise
and organized recreation. it will also strengthen on -going community.building activities by
the town, county, Habitat for Humanity, and others in this lower- income section of the town.
Local churches and civic groups have also offered their volunteer services to help with the
project in any way that they can. Volunteers might be used for help with the nature trails.
The County and Town commissioners both have identified Fairview Park construction as a
high priority, and they are hoping to begin Phase I of the park development in FY 2009 -10.

Introductions were made. Commissioner Gordon expressed appreciation
that Catherine Martin is well after her car accident. Mayor Johnson said
that hopefully this is the beginning of a good relationship to enhance all
the lives of everyone in Orange County with joint efforts on parks and
recreation. The Town has the will and hopefully funds will be
available.

Director of Economic Development Ted Abernathy distributed
colored maps of the proposed park. He summarized the components of the
park. They have applied for grant monies from the Kirby Foundation and
the Hillsborough Tourism Board. The plan for Stillhouse Creek will go to
the two governing boards upon completion in a few weeks.
Commissioner Gordon noted that the plan utilizes all of the land
and does not reserve any space for future county needs, including parking,
as the Commissioners had requested.
Commissioner Carey agreed and suggested that perhaps the section
marked "open field" would be appropriate. The County Manager is to revigw
the plans and provide a recommendation concerning space that should be
reserved for Orange County needs.

Town Commissioner Chavious asked about the plan for a parking
deck which would serve as parking for the courthouse and for downtown
Hillsborough.
In answer to a question about the bridges over the creek, Ted
Abernathy said that they have not yet been designed. Two of these bridges
will be substantial.
While they have identified money for site preparation, they have not
identified funds for the bridges.
Chair Crowther mentioned that this park does not have a name
which is awkward when applying for grants. He would like to see a process
for determining a name for this park -- maybe a contest to name this park.
Discussion ensued on funds allocated by the Town and the County.
Commissioner Halkiotis suggested listing-the total value of this piece of
land. Unless that is done, the contribution by Orange County is
underestimated. Right now only the original purchase price of•a piece of
land in the center of the tract is included, whereas the value of the
whole tract that the County is allowing for use as a park is much greater.
Even though the County is not donating the land, the accurate value should
be used. The chart showing dollar amounts will'be redone to show the
status of each item.

Town Manager Eric Swanson said that the Town and Eurosport want
to work together to provide additional opportunities to play soccer. They
looked at the 20 acres along the Eno River that was part of the Cone Mill
facility. Because of utility easements and flood issues, they cannot use
this property for this purpose.
They then looked at Fairview Park. The County owns some of this property
and the town owns about 20 acres. They have talked with County Manager
John Link and Parks and Recreation staff about using this area jointly for
soccer fields. They feel that the first step is to. proceed with a
feasibility study of this site. This property is in the extraterritorial
transition area but not in the city limits.
Recreation and Parks Director Bob Jones said that the county
owns 41 acres and the town owns 20 acres. The proposed plan was to build
ballfields and to develop a community park.
Eric Swanson said that they would like to work with the County
in their programming needs for soccer fields. They want to proceed with
the feasibility study as soon as possible.
Commissioner Carey feels that it is desirable to have more
soccer fields but it needs to be considered in the Recreation and Parks
plan that is being updated at the present time. He feels that a public -
private financing plan could be considered.

Commissioner Gordon expressed opposition doing anything on this
at this time that would require an expenditure of County funds. If
Hillsborough just needs the land, the County may be able to make the land
vailable.
Commissioner Halkiotis said that he is totally in support of
this concept. He wants to know how this could fit-into the County's
master recreation and parks plan. He feels the County should look at this
area and if there is an opportunity to do something with the Town, he
would be very supportive of moving ahead. He noted that the playground
equipment i.s already outdated.
Commissioner Carey feels that the public private piece is
significant. Everyone knows that the need for recreation activities and
space is increasing in this county.
Mayor Horace Johnson said that they recognize the need for
recreation. The population is increasing and the needs for recreational
activities has increased.
Commissioner Halkiotis commended Sports Endeavors (Eurosport)
for hiring from the community and thanked them for contributing to the
community. He wants them to build soccer fields in Orange County.
The representatives from Sports Endeavors said that they are
u talking about contributing funds for this endeavor as well as helping to
work with the youth.
Commissioner Halkiotis said that he heard that a task force is
looking at the possibility of locating soccer fields in this area. Eric
Swanson said that he will work with John.Link and look at formalizing this
group with a representative from the County serving on this task force.
Commissioner Halkiotis would like"to know exactly what the Town
would like from the County.

Eric Swanson said that the Town has received a letter of
interest from the owner and developers of the proposed Scotswood project,
a mixed -use development on 330 acres at the intersection of U.S. 70 E. and
St. Mary's Road. This, letter of interest will follow the process they
have in place for annexations.
Commissioner Halkiotis made reference to the Capital Needs Task
'once because this development would mean one more elementary school for
Orange County Schools. If the annexation is approved and water and sewer
is extended to that area, it will have a big impact on Orange County
schools. .

30 A. Identification of Parcels to be Annexed by Hillsborough
31 Town Planning Director Margaret Hauth used a map to show the parcels of land that the Town has
32 annexed. Part of the agreement of the annexation was that the owners would not expect services to be
33 provided by the Town. If services are provided, the property owners will pay the cost. These were effective
34 April 10. They will have zoning hearings the end of this month. Fox Meadow requested R -20 for a total of
35 190 acres. The Town still has another 70 or 80 acres that they can annex. The Hines -Liner property was
36 24 acres.
37 In answer to a question from Chair Margaret Brown, Mayor Johnson said that the purpose for
38 annexing one of these areas was the threat of the County locating a landfill in that area. Both of the areas
39 they annexed will provide growth areas for the Town of Hillsborough.

41 Possible Annexation of Fairview Community Park
42 Mayor Johnson said that they have a law enforcement problem in the Fairview Community because
43 part of this area is in the Town's city limits and part is in the County. Also, the County does not keep up the
44 maintenance at Fairview Park.
45 Commissioner Gordon said that she would be willing to sell this land to the Town for $1.00. The
46 County Commissioners will discuss this option and let the Town know its decision.
47 Horace Johnson said that they have provided water to the park. He said that they would be willing to
48 take the park for $1.00. The Town Board will also further discuss this issue.

50 @) PROPOSED FAIRVIEW PARK COMMUNITY CENTER
51 Horace Johnson said that funds are in the budget to upgrade this facility. This will provide the
52 presence of law enforcement officers for that neighborhood and also provide a facility for community
53 meetings and activities.

1 POSSIBLE EXPANSION OF FAIRVIEW PARK
2 Horace Johnson said that funds are available to expand this facility. They are considering locating a
3 community center at the park.
4 Mr. Simpson asked if bond money is available to use for this park.
5 Town Commissioner Ken Chavious said that there are two issues. One is a community center which
6 would house a substation for the police. He does not agree with this concept. The second issue is a mobile
7 van which is a vehicle prepared and developed to combat crime. The Town has receive a COPS grant but
8 has not decided what to do at this point. Regarding expansion of the park, they were approached by
9 Eurosport to build soccer fields in this area.
10 John Link said that they made a trip to Charlotte to see a soccer field which had been built on top of a
11 landfill that had been closed. Charlotte officials indicated that they were having constant problems with the
12 ground sinking.
13 Chair Margaret Brown said that she is working on a recreation task force and they are doing an
14 inventory of park needs throughout the County.
15 Ken Chavious feels that they could control the problems associated with the landfill. Eurosport is
16 really interested in helping the Town finance soccer fields.
17 Chair Margaret Brown feels that the property needs to be evaluated to determine if it will be feasible to
18 locate soccer fields in this area. She said that the task force will have a report by late fall.
19 John Link said that the County does have $60,000 in the budget for Fairview Park. Some of this
20 could be used to test the ground in that area. The County Recreation and Parks Board supports testing the
21 ground before spending additional money to extend the park.
22 Commissioner Carey suggested contacting NC State to see if someone in their Environmental
23 Department can help with testing the ground for gases.

26 E. RIVER PARK STEERING COMMITTEE APPOINTMENTS
27 Margaret Hauth made reference to the original committee for the River Park. She said the plan is
28 finished and they need to decide on specifics and responsibility for the day to day use of the park. The
29 committee would include an elected official from each jurisdiction and a representative from each recreation
30 and parks board and three at -large members. All have been appointed except for the elected officials. This
31 steering committee will also look into the availability of grant money for developing the park.
32 Commissioner Gordon would like for the committee charge and composition to come before the Board
33 as an agenda item for their discussion and input.

35 F. NAMING OF RIVER PARK
36 Commissioner Crowther said that the original task force did a survey and asked for possible names
37 for the park. They came up with four recommendations. These two governing boards will need to name this
38 ` park. The four names suggested by citizens are River Park, Eno Will Park, Heritage Park and River Green.

40 G. SOLID WASTE ENFORCEMENT ISSUES
41 John Link said that this is in response to a letter from Mayor Johnson in which he expressed
42 concerns about various enforcement issues within Hillsborough's Extraterritorial Planning Jurisdiction. .
43 John Link said that he has indicated to Mayor Johnson that if there is a problem with accumulated waste,
44 that the Town contact the County's Public Works Department which will send someone out with a Sheriffs
45 Deputy to investigate and hopefully identify who has thrown out this trash. The Town is responsible within its
46 own city limits. The County's responsibility is the County and the ETJ.
47 John Link made reference to animal control issues and said that the County does enforce the Animal
48 Control Ordinance within the Town of Hillsborough but has no contract to do so. The managers will work
49 together to clarify the situation and determine the level of service.
50 Mr. Simpson said that he feels the level of service is adequate. The County's Animal Control officers
51 have responded every time he has called them.

53 H. ZONING ENFORCEMENT OF PROPERTY AT CORBIN /CHURTON STREETS
54 John Link said that the County does issue building permits within Hillsborough and soil and erosion
55 permits but the County has no authority to enforce zoning regulations within the Town limits.

Commissioner Jacobs said that when the park plan was done, the community prioritized
the different components. He suggested replicating the priority list. He agreed with
Commissioner Gordon about the walking track.
Dave Stancil said that, with the current timetable, construction could begin this summer.
Commissioner Gordon said that she would like.to see the answer to the question about
the priority list prepared by the community and see how it tracks with the options.
Dave Stancil said that the priorities were already reflected in option 1.
Commissioner Jacobs said that if the walking trail is the only thing missing and it is only
$40,000, then it could be included anyway.
This will come back for approval on April 24tH
West Ten Soccer Center
To move the project along, steps are currently underway to get the field construction
underway on an aggressive timetable. Field construction bids will be advertised soon, with a bid
opening proposed for May 8th. A Site Plan has also been submitted to the Planning Department
for approval. Current plans would have a construction bid award before the Board on May 15tH
Direction provided by the Board at the work session would be incorporated into a subsequent
decision on the April 24th or May 3`d Board agenda.
Recreation and Parks Director Lori Taft said that the projection is that the field surfaces
would be finished in August.
Commissioner Nelson said that there is some concern from the soccer community that
this has morphed into a larger facility with a bigger scope (buildings, bathrooms, etc.), and there
were questions about eliminating some of the items like bleachers and a scoreboard and
moving the money toward fields at Twin Creeks, turfing the field at Smith, or fields at Southern
Community Park. He asked for input on this.
Laura Blackmon said that the estimate for the building was $700,000. Some of the
building will have to be built because there must be some equipment storage. She said that the
direction she got from the Board was to do West Ten. The initial concern right now is the fields
and getting them done in time for them to grow. The approval for the funding is on the April 24th
agenda.
Commissioner Gordon said that she is a little disappointed that more of an effort was not
made to coordinate with Gravelly Hill Middle School, because there are adjacent facilities which
could also be used, thereby reducing the need to construct them for the soccer center. She
said that she was also concerned that the bond showed soccer fields that would be dispersed
around the County. She thinks that there are transportation and emission issues with this
complex. She made reference to an email from a citizen to Lori Taft that was copied to her
about where the sanctioned soccer players are. It shows that there area about 10 times as
many of these players in the southern part of the county. She said that she thinks that the
County should be maximizing the number of soccer fields and that they should be near the
players. She agrees with building some fields at West Ten, but she is skeptical about a
complex. She made reference to a letter from Triangle United Soccer about the possibility of a
public /private partnership. She asked if there has, been any discussion with Triangle United
Soccer about this. Lori Taft said that she spoke with some representatives.
Commissioner Jacobs said that this is a decision item at the next meeting, and this
debate should be postponed to that meeting.
Fairview Park, Phase I
A Request for Proposals for the engineering and plan approval work has been issued.
An interview team would be formed to recommend a firm for this work, and a contract for the
work is anticipated to come before the Board for action in May. Playground replacement is
underway.

The staff would like to proceed to develop a selection team to evaluate the firms and
make a recommendation to the Board for a contract, which would come back before the
summer break. The staff'would like direction on the makeup of this team. The County owns
part of the land and the Town of Hillsborough owns part. Staff would suggest including
representatives from the Town of Hillsborough for this team. The Board agreed.
Commissioner Gordon said that she would like to see this move forward expeditiously
because the County has. been promising a park here for a long time.
Twin Creeks Park, Phase
With Elementary School #10 underway on the schools campus portion of this 193 -acre
site, a staff team and the design /engineering firm have been working to prepare the extensive
Conditional Use Permit application materials to submit to the Town of Carrboro for approval of
phase I of the park. Several preliminary development meetings have been held with Town staff
and attorney, as have discussions with adjacent property owners about shared infrastructure.
Carrboro staff has suggested several components to be included in the application, outlined in
the attached summary. Updated cost estimates for Phase I of the park have been developed,
however available funding is insufficient to build Phase I at this time. An alternative scenario to
continue with the design work and use these funds temporarily toward soccer fields elsewhere
is proposed.
There could be some economies of scale by building all four fields at one time. This
would save $275,000. As a result of this, and in light of some recent discussions, there is an
alternative scenario to continue with the plan to submit the Conditional Use Permit (CUP)
application for the four -field complex, continue the infrastructure negotiations, address the
financing needs for the larger four -field complex as part of the CIP discussions later this fall, and
in the short term borrow (on a temporary basis) from some of the funds to look at creating
soccer fields using artificial turf at a location such as Smith Middle field in the interim.
Laura Blackmon said that she needs to look at what the County is producing with regard
to parks throughout the entire community. She said that there are many parks on the books and
many promises, and there is no outline for the funding on how the parks are going to be
produced. She does not want to do this piece meal. She said that it would really make sense to
do the four fields at Twin Creeks. She would like to look at addressing the two current fields
that could have artificial turf. She said that, if this approach were taken, she would like to use
the funds that are currently available, which is about $1.6 million, to look at providing artificial
turf and do it as a partnership with the other soccer entities. This would provide at least two
fields that could be used year round and they are in the southern part of the County.
Commissioner Nelson commended Laura Blackmon on her recommendation. He thinks
that this recommendation is trying to find a win -win situation. He asked about the costs for Twin
Creeks and it was answered that $1.9 would be the bare minimum for two fields without
irrigation or lighting, and the infrastructure.
Laura Blackmon said that her concern is that this is creating Smith Middle School all
over again — no irrigation, two fields, and limited use.
Commissioner Nelson said that his other concern is that money would be taken from
Twin Creeks to turf the fields at Smith. He asked what this would do to Twin Creeks. Laura
Blackmon said that it probably would not slow down the timeline. The ten -year capital plan has
not been done yet and things can be shifted around. She does not know the entire amount to
turf the fields, but she thinks it might be around $1 million. The hope is to get some partners to
help.
Commissioner Nelson said that if the Smith fields and the four fields at Twin Creeks
could be done, he would be comfortable going ahead with West Ten. He would like to sit down
with the soccer community and flesh this potential partnership out. He is a little uncomfortable
