Qualified Schools Construction Projects
Chapel Hill -Carrboro City Schools and Orange County Schools
Capital Projects Ordinance
Be it ordained by the Orange County Board of County Commissioners that pursuant to Section
13.2 of Chapter 159 of the General Statutes of North Carolina, the following capital project is
hereby adopted.
Section 1. The project authorized provides funds for the construction of various Qualified
School Construction Bonds projects of Chapel Hill-Carrboro City Schools and
Orange County Schools. Proceeds from the Qualified School Construction Bond
Program fund these projects.
Section 2. The officers of the County are hereby directed to proceed with the project within
the budget contained herein.
Section 3. The following revenue is anticipated to complete this project:

Section 5. This ordinance shall remain in effect until the Board of County Commissioners
takes action to amend the ordinance or close the project ordinance upon
completion of the project.

PURPOSE: To approve a Capital Projects Ordinance for the Qualified School Construction
Bond (QSCB) projects of the Chapel Hill -Carrboro City Schools and Orange County Schools.
BACKGROUND: The Board of Commissioners has previously approved proceeding with the
issuance of Qualified School Construction Bonds (QSCB) as authorized under Section 160A-20
of the North Carolina General Statutes. The issuance of the QSCB will finance various
construction projects of the Chapel Hill -Carrboro City Schools (CHCCS) and Orange County
Schools (OCS) not to exceed and totaling $9,899,440. The cost estimate for the CHCCS QSCB
projects is $4,630,000. The cost estimate for the OCS QSCB projects is $5,269,440.
In January 2011, the Board of Commissioners approved the necessary fact-finding and held the
required public hearing concerning the projects of both school systems, and proposed financing
as prescribed under the guidelines of the Local Government Commission. Additionally, the
Board of Commissioners directed staff to proceed with the financing, execute the appropriate
documents, and complete the closing of the financing through the adoption of a resolution dated
January 20, 2011.
FINANCIAL IMPACT: The financing proposal will require debt service of $659,963.60 for Fiscal
Year 2011-12. The tax rate equivalent for FY 2011-12 debt service is estimated at
approximately .43 cents.
RECOMMENDATION(S): The Manager recommends that the Board approve the attached
QSCB Capital Project Ordinance.

The Board approved a contract with the NC Department of Agriculture and Consumer Services
for a$79,950 Specialty Crop grant for equipment for the Piedmont Food and Agricultural
Processing Center and authorized the Manager to sign.

The Board approved budget, grant, and capital project ordinance amendments for fiscal year
2010-11 for Department on Aging, Health Department, Department of Social Services, Library
Services, Sportsplex Enterprise Fund, Twin Creeks Park (Phase 1).

The Board approved a Capital Projects Ordinance for the Qualified School construction bond
projects of the Chapel Hill - Carrboro City Schools and Orange County Schools.
k. Interlocal Aqreement with the Town of Hillsborouqh for Plan Review Inspection
Buildinp Official and Related Services
The Board established a formal agreement between Orange County and the Town of
Hilisborough to provide enforcement of the North Carolina Building codes including plan
review, building official and related services pertaining to the North Carolina State Building
Codes and authorized the Chair to sign.
I. Proposal to Ooerate Smart Start Subsidv at Social Services
The Board approved a request by Social Services to submit a proposal to the Orange County
Partnership for Young Children for operation of the Smart Start subsidy program.
m. Bid Award: Whitted Health and Dental Renovations
The Board awarded a general construction contract to H.M. Kern, Greensboro, NC in the
amount of $763,800 for the Health and Dental renovations, including the structural repairs to
Building A and authorized the Chair to sign; and authorized the installation of a sprinkler
system in Building A; and authorized the Manager to sign the change order.

a. Unified Development Ordinance (UDOI - Report on Planninq Board
Recommendation
The Board considered a report on the Planning Board's recommendation regarding
adoption of the entire Unified Development Ordinance (UDO).
Planning Director Craig Benedict said that this item is a report on the Planning Board
recommendation. On November 22, 2010 there was a public hearing on the Unified
Development Ordinance. At that meeting, the County Commissioners asked the Planning
Board to come up with a new schedule on how to address some of the comments that came
from the public hearing. In early December, the Planning Board came up with a new schedule
of how to address the changes and comments. This schedule was brought back to the County
Commissioners on December 14~'. At that meeting, the County Commissioners approved a
schedule of events that the Planning Board has followed. The schedule included having a
report on the progress on February 15"'. The continuation of the public hearing will be
February 28t". He said that the Planning Board reviewed two primary issues of concern from
