BACKGROUND: This request includes three petitions for road additions to the State Maintained Secondary Road System as follows: 1. Beechridge Subdivision (Beechridge Ct.): Attachment 1a - map The Town of Chapel Hill approved Beechridge Subdivision as a Planned Development with a Special Use Permit (SUP) dated October 5, 1998. Beechridge Court was designated as a public right-of-way. The SUP includes the following provisions related to the subdivision road in this request: • That Beechridge Court be extended to the south, to be stubbed-out to the Blackwood property, with a sign posted alerting residents about the possibility of future connection. • That the internal street(s) be constructed to public street standards, with a 27-foot back-to-back cross-section with curb and gutter, and with sidewalk on one side. A 50-foot right-of-way shall be dedicated. A petition was submitted to the North Carolina Department of Transportation to accept maintenance responsibilities for the 0.2-mile subdivision road. According to the NCDOT 2 survey, the subdivision road provides access for 13 homes. The subdivision is located south of the NC54 and US15/501 intersection in the Town of Chapel Hill's jurisdiction. This is the second road addition petition for the Beechridge Subdivision. On December 6, 2010 the Board of County Commissioners approved a petition for Copper Beech Court — a 0.17-mile road located in the subdivision. 2. Cedar Pointe (Cedar Pointe Drive and Sam Miller Drive); Attachment 2a — map The BOCC approved Cedar Pointe Subdivision through the major subdivision process on June 16, 1998 with Cedar Pointe Drive and Sam Miller Drive designated as public roads. Lot A of the subdivision is subject to future road extension to allow connectivity and is dedicated as a public road right-of-way. The dedication was recorded in a deed dated March 26, 1998 (Attachment 2c). The property owners of properties adjacent to Cedar Pointe Drive and Sam Miller Drive have petitioned the North Carolina Department of Transportation to accept maintenance responsibilities for the subdivision roads. The subdivision roads provide access for 15 homes: Cedar Pointe Drive — 9 homes and Sam Miller Drive — 6 homes. Cedar Pointe Subdivision is located north of US 70. 3. Meadow Ridge (Spring House Lane and Woodlot Ridge); Attachment 3a - map The petition for addition includes two roads: Spring House Lane and Woodlot Ridge. Spring House Lane is a 0.25 miles paved road that provides access to five households. Woodlot Ridge is a 0.1-mile long, paved road. It also provides access to five households. The BOCC approved Meadow Ridge Subdivision through the major subdivision process on May 13, 1996 with Spring House Lane and Woodlot Ridge designated as public roads. The subdivision is located in the Chapel Hill Township (unincorporated Orange County), west of 1-40. Conclusion All above-referenced applications meet the criteria endorsed by the BOCC for recommending acceptance of a public road into the State Maintained System for roads approved through the major subdivision process. NCDOT has investigated these requests (please refer to Attachments 1 b, 2b and 3b) and has submitted petitions to the BOCC for its review and recommendation. In accordance with North Carolina General Statute §136-62% the Board is required to make a recommendation regarding the petitions to the North Carolina Board of Transportation (NCBOT) before the NCDOT can consider the petitions. FINANCIAL IMPACT: There is no direct financial impact to the County associated with this item. NCDOT will incur additional maintenance responsibilities and costs. ` North Carolina General Statute§136-62 directs that"The citizens of the State shall have the right to present petitions to the board of county commissioners, and through the board to the Department of Transportation, concerning additions to the system and improvement of roads. The board of county commissioners shall receive such petitions, forwarding them on to the Board of Transportation with their recommendations." 3 RECOMMENDATION(S): The Manager recommends the Board: 1. Forward the Petitions for Addition to the State Maintained System to the North Carolina Department of Transportation for subdivision roads in: a. Beechridge (Beechridge Court), b. Cedar Pointe (Cedar Pointe Drive and Sam Miller Drive); and c. Meadow Ridge (Spring House Lane and Woodlot Ridge); and 2. The right-of-way will extend the entire length.of the road that is requested to be added to the state maintained system and will include the necessary areas outside of the right-or-way for cut and fill slopes and drainage. Also, we agree to dedicate additional right-of-way at intersections for sight distance and design purposes and execute said right-of-way agreement forms that will be submitted to us by representatives of the NCDOT.
