HomeMy WebLinkAbout1988 Engineer - Sewer Billing and Collecting Agreement.0 _r• NORTH CAROLINA ORANGE COUNTY SEWER BILLING AND COLLECTING AGREEMENT THIS AGREEMENTy made and entered into this 24th day of March , 1988 r by and between ORANGE COUNTY, NORTH CAROLINA hereinafter referred to as County p and O AN E- ALAMAN E WATER SYSTEM, INC.F hereinafter referred to as Contractor WTTNESEETH WHEREAS, the County is the owner of wastewater collec- tion and pumping facilities serving the Ef land /Cheeps area of Orange County, hereinafter referred to as "the System; and WHEREAst the Contractor is a non profit corporation rouiding grater service to customers in the same area of Orange County ; and WHEREAS, the County and the Contractor are authorized by law to enter into agreements pertaining to the provision of waiter and wastewater facilities and services* and WHEREAS, the County has requested the Contractor to perform billing and collectinc se rvices r i n d by the County for its operation of the System; and WHEREAS, the Contractor has the ability-to and is will- ing to perform these billing and collecting services pursuant to the terns a.nd conditions of this ag rems nt . NOW THEREFORE., for and in consideration of the mutual terms and agreements hereinafter set forth, the County and the Contractor do agree as follows f�k_MdW 1. This agreement shall be effective as of the date first above written and shall continue in full force and effect until June 30, 1 8 J . It may be renewed the r of ter, upon such terms and conditions as the County and the Contractor aq ree , for one year periods commencing on July 1 of a year and ending on June 30 of the next year 2. The Contractor shall perform billing and collect- ing services for the County for customers that are served by the System. These customers shall include those that are served by the Contractor's water system as well as those that are not O 3 . The rates to be charged for use of the System shall be provided to the Contractor by the County. 4. The Contractor shall pay to the County by the 15th day of the month following each month for which collections are made for the County the gross amount of such collections* The Contractor shall also provide an aged list of delinquent accounts to the County at the time e the monthly collections are forwarded to the County. 5* The County shall pay to the Contractor $1.25 for each account billed by the Contractor each month for County sanitary sewer services. The Contractor shall provide an invoice to the County which indicates the number of accounts billed for the month. Payment shall be made by the County by the last day of the month following each month for which an account is billed* The Contractor shall collect -a deposit for each account established for the System. Accounts shall be estab- lished by the Contractor upon receipt of a copy of an approved application for service from the County and the re e ipt of the required deposit from the customer& The amount of the deposit hall be two months of the pro i ect d sewer bill to be calculated by the Contractor. The deposit shall be kept by the Contractor for the county and applied toward settlement of the. account upon disconnection from the System. Any balance of the deposit after settlement of the account shall be refunded to the customer by the Cunt rac for 7o The contractor shall bill and collect any addi- tional charges made by the county related to are account of the System upon notification by the County of such additional charges i 8 + The Contractor shall follow its normal policies tor returned checks related to the accounts of the system. Any fees collected by the Contractor related to returned checks shall belong to the Contractor, provided these fees do not exceed in amount that authorized by law* 9.9 The contractor shall discontinue water and sewer service for those accounts served by both the Contractor's water system and the System when payment in full for sanitary sewer service is not made within 20 days of the date the meter is read by the contractor., The Contractor agrees that it will bill each account and mail the bill to each account on the date the meter is read and in no event later than the next business day follow-- ing the meter reading day. The Contractor shall follow its normal policies relating to complaints and adJustments to bills for sanitary sewer services. Provided, however, payment of a statement under protest shall not prejudice the claim of the protestor in the event an error is discovered as provided in the system Rules and Regulations of the County. 11, The County shall pay to the Contractor, upon receipt of an invoice, a one -time set -up fee of $100.00 for the purpose of establishing a billing and collecting system for the system,. 12. The Contractor's records of billings and collec- tions for the system shall be and it.ed annually by an independent certified public accountant provided by the County and at the County's expense.
