BACKGROUND: This request includes three petitions for road Road System. The roads are as follows: additions to the State Maintained Secondary 1 Beechridge Subdivision (Copper Beech Ct.); Attachment 1a -Map The Town of Chapel Hill approved Beechridge Subdivision as Planned Development with a Special Use Permit (SUP) dated October 5, 1998. Copper Beech Court was designated as a public right-of-way. The SUP includes the following provision related to the subdivision roads: • That the internal street(s) be constructed to public street standards, with a 27-foot back-to-back cross-section with curb and gutter, and with sidewalk on one side. A 50-foot right-of-way shall be dedicated. A petition was submitted to the North Carolina Department of Transportation to accept maintenance responsibilities for the 0.17-mile subdivision road. According to the NCDOT survey, the subdivision road provides access for 8 homes. The subdivision is located south of the NC54 and US15/501 intersection in the Town of Chapel Hill's jurisdiction. 2 Woodlands Subdivision (Nine Gate Rd ,Woodgate Dr., Stonegate Dr., Summergate Cr.); Attachment 2a -Map 2 The Board of County Commissioners (BOCC) approved Woodlands Subdivision through the major subdivision process on May 24, 2001 with Nine Gate Rd., Woodgate Dr., Stonegate Dr., and Summergate Cr. designated as public roads. The subdivision roads provide access for 25 homes: Nine Gate Rd. - 1, Woodgate Dr. - 6, Stonegate Dr. -14 and Summergate Cr. - 4. The subdivision is located on the southern side of Jones Ferry Road. As shown on the map in attachment 2a, Stonegate Drive and Summergate Circle were not designed to allow future extension. In the case of Stonegate Drive, the road was not stubbed out because there was an existing development with exempt and non-exempt lots to the south of the Orange County line. In the case of Summergate Circle, Planning staff had originally made a suggestion to stub out the road; however, it turned out that the adjacent property is dedicated to be conveyed to the Triangle Land Conservancy and, as a result, it will never be developed. The stub out requirement was deleted from the approval conditions. 3 Efland Estates Subdivision (Gregg St.): Attachment 3a -Map The requested road addition is about 0.018-mile long; the rest of the road is already on the Secondary Road State Maintenance System. One house has an entrance to the section of the road submitted for addition. The background research showed that Efland Estates Subdivision was recorded in 1972. The County did not adopt subdivision regulations in the Cheeks Township, where the subdivision was located, until 1978. As a result, this project was not reviewed or approved by the County. However, a review of the plat showed that it meets the policy adopted by the BOCC for recommending roads for addition to the State Secondary Road Maintenance System: a) right-of-way (ROW) extends to the edge of the property to provide connectivity; and b) irons have been set at the edge of ROW. Conclusion All above-referenced applications meet the criteria endorsed by the BOCC for recommending acceptance of a public road into the State Maintained System for roads approved through the governing jurisdiction's major subdivision process. NCDOT has investigated these requests (please refer to Attachments 1 b, 2b and 3b), and has submitted petitions to the BOCC for its review and recommendation. In accordance with North Carolina General Statute §136-62', the Board is required to make a recommendation regarding the petitions to the North Carolina Board of Transportation (NCBOT) before the NCDOT can consider the petitions. FINANCIAL IMPACT: There is no direct financial impact to the County associated with this item. NCDOT will incur additional maintenance responsibilities and costs. RECOMMENDATION(S): The Manager recommends the Board: 1. Forward the Petitions for Addition to the State Maintained System to the North Carolina Department of Transportation for subdivision roads in: ` North Carolina General Statute §136-62 directs that "The citizens of the State shall have the right to present petitions to the board of county commissioners, and through the board to the Department of Transportation, concerning additions to the system and improvement of roads. The board of county commissioners shall receive such petitions, forwarding them on to the Board of Transportation with their recommendations." 3 a. Beechridge Subdivision b. Woodlands Subdivision c.
