PURPOSE: To approve School and County capital project ordinances for fiscal year 2005 -06.
BACKGROUND: On June 23, 2005, the Manager presented recommended 2005 -15 Capital
Investment Plans (CIPs) for the County as well as both School systems. While the Board
discussed the plans during budget deliberations throughout June, there were a number of
capital and debt related matters that the Board chose to discuss further at a fall 2005 work
session. To that end, Commissioners approved some Level 1 County and school capital
projects for fiscal year 2005 -06 on June 23, 2005, while delaying action on other capital matters
until fall 2005. Items deferred to the fall work session included additional review of the County's
capital funding policy, revised fiscal year 2005 -06 funding recommendations for County capital
projects, and an updated debt issuance schedule and debt capacity charts.
As a point of clarification, the Board of Commissioners' November 2001 capital funding policy
defines project "levels" as follows:
• Level 1 projects are those that involve a relatively small scope of work — thereby allowing
the Commissioners to approve the entire project ordinance at one time.
• Level 2 projects are major projects that require several phases to complete. For these
projects the Board of County Commissioners approves a four -phase appropriation
process to include:
• -Concept/Pre- Planning Phase - includes preliminary programming and design work
that would result in conceptual drawings and preliminary cost estimates.
• Planning Phase — includes siting and infrastructure
• Design and Construction Approval Phase — includes final design, equipment,
furnishings, non - recurring start up cost, technology and contingency
o Final Accounting Phase — Upon completion of the project, school and county 2
staff
will reconcile actual project expenditures with approved budget and provide the
BOCC with a "final accounting" of the project.
Many of the Level 1 capital project ordinances approved by the Board in June did not involve
new funding appropriations, but merely extended the project timelines through June 30, 2006.
Other County and school projects received new funding for the current fiscal year where
appropriations needed to be in place in order to accomplish work during summer 2005.
At the September 13, 2005 Board work session, Commissioners approved fiscal year 2005 -06
County capital funding appropriations along with 2004 two- thirds net debt reduction bond
allocations for County capital projects. Both school systems have requested Commissioner
approval of the remaining Level 1 projects that the Board deferred in June.
As stated earlier, approval of Level 2 projects, those projects that require several phases to
complete, will be requested at the appropriate times in accordance with the Board's adopted
School Planning and Funding Policy over the life of the major project. Examples of Level 2
projects include OCS Middle School #3 and CHCCS High School #3.
With regard to County owned vehicles and equipment, the County has historically funded those
through its ten year Capital Investment Plan (CIP). Examples of the types of purchases made
with annually appropriated monies include replacement of some portion of the Sheriff's vehicle
fleet and Emergency Services vehicles, including ambulances, as well as replacement of other
County department vehicles and major equipment (not including Information Technology - related
equipment).
For the current fiscal year, the BOCC- approved CIP includes plans to purchase County
equipment and vehicles through a combination of alternative financing arrangements as well as
pay -as- you -go- funding. Over the coming months, the Manager and Budget Staff will work with
individual departments to explore various options for meeting departmental equipment and
vehicle needs. The Manager will approve all individual vehicle and equipment purchases prior
to the items being ordered. At this time, staff anticipates the need to pursue funding
arrangements that include a thirty -six month period and another for a period of fifty -nine
months. The life expectancy and cost of the equipment or vehicle would determine whether it
was financed for the shorter or longer -term period. Staff also plans to explore options for
alternative fuel vehicles and incorporate those options as feasible.
FINANCIAL IMPACT: The financial impact is included on the individual County and School
capital project ordinances.
RECOMMENDATION(S): The Manager recommends that the Board of County Commissioners
approve the attached County and School Capital Project Ordinances.

Be it ordained by the Orange County Board of County Commissioners that pursuant to Section 13.2
of Chapter 159 of the General Statutes of North Carolina, the following capital project is hereby adopted.
Section 1. The project authorized provides funds to remove asbestos from various facilities within the
Orange County School system. Proceeds from the Schools' portion of the one -half cent
sales taxes finance this project.
Section 2. The officers of the County are hereby directed to proceed with the project within the budget
contained herein.

Be it ordained by the Orange County Board of County Commissioners that pursuant to Section 13.2
of Chapter 159 of the General Statutes of North Carolina, the following capital project is hereby adopted.
Section 1. The project authorized provides funds to provide an engineering review of main and internal
branch electrical service for all facilities in the District. Upgrading electrical service at all
facilities is also apart of this project. Proceeds from the Schools' portion of the one -half
cent sales taxes and the 1997 bond referendum finance this project.

Be it ordained by the Orange County Board of County Commissioners that pursuant to Section 13.2
of Chapter 159 of the General Statutes of North Carolina, the following capital project is hereby adopted.
Section 1. The project authorized provides funds to install computer controlled energy management
direct digital systems to heating and air conditioning units at all schools in the District.
Plans include a phased in approach as new boilers and other systems are replaced throughout
the facilities. Proceeds from the Schools' portion of the 1997 voter approved bonds finance
this project.
Section 2. The officers of the County are hereby directed to proceed with the project within the budget
contained herein.

renovations include improvements to the auditorium, science laboratories, tennis

the grounds of Orange High School. The County has had a long standing
contractual arrangement for use of these courts by the public, which stipulates

use- by members of the public, both in formal, programmed settings as well as.
informal use. They are the only tennis courts available for public use in northern
Orange County. The Orange County School District has prioritized this project in

Recreation and Parks Facilities — West Ten Soccer Complex
Capital Project Ordinance
Be it ordained by the Orange County Board of County Commissioners that pursuant to
Section 13.2 of Chapter 159 of the General Statutes of North Carolina, the following
capital project is hereby adopted.
Section 1. The project authorized provides funds for the development of a six -field
soccer complex adjacent to the Orange County Middle School #3 site
through a collaborative effort between Orange County and Orange County
Schools. Proceeds from the 2001 voter approved Soccer Superfund
bonds and 2004 Two - thirds net debt reduction bonds will finance this
project.
Section 2. The officers of the County are hereby directed to proceed with the project
within the budget contained herein.
Section 3. The following revenue is anticipated to complete this project:

The Board approved budget ordinance amendments for fiscal year 2005 -06 for Environment
and Resource Conservation, Countywide Departmental Budget Reductions, and Non -
departmental.
L Board of Commissioners Meeting Calendar for Year 2006
The Board approved the final schedule of regular meetings for the Board of County
Commissioners for calendar year 2006.
K. Change in BOCC Regular Meeting Schedule
The Board amended its regular meeting schedule by adding a meeting on Wednesday,
November 9, 2005 at 5:30 p.m. (prior to the 7:30 p.m. Work Session) at the Government
Services Center in Hillsborough, N. C.

d. Approval of School and County Capital Project Ordinances
The Board considered approving School and County capital project ordinances for fiscal
year 2005 -06.
Commissioner Gordon said that she noticed on the Soccer Superfund that it was $2.5
million, but it is only $2 million.
Budget Director Donna Dean said that Commissioner Gordon is correct and it should be
$2 million. She suggested pulling the Soccer Superfund and the West Ten capital project from
this item. The corrected versions will be brought to the next meeting.
Commissioner Gordon suggested holding the entire list.
A motion was made by Commissioner Gordon, seconded by Commissioner Halkiotis to
approve both school systems' capital project ordinances and to hold the Orange County's
capital projects ordinance over to another meeting.
VOTE: UNANIMOUS
h. Petition for Addition of Subdivision Roads in Eno Woods to the North Carolina
State Maintained System
The Board considered a petition to add subdivision roads in Eno Woods subdivision to
the State Secondary Road System.
Commissioner Jacobs wants to vote against this because there is no money for
pedestrian and bike facilities but DOT is spending money on repaving.
John Link said that they recommend for the County Commissioners to approve this
until such time that the Board of County Commissioners can revisit this issue.
A motion was made by Commissioner Halkiotis, seconded by Commissioner Foushee
to approve a petition to add subdivision roads in Eno Woods subdivision to the State Secondary
Road System and to revisit this issue.
VOTE: Ayes, 4; No, 1 (Commissioner Jacobs)

a. Certificate of Achievement for Excellence in Financial Reporting
The Board was to consider recognizing the staff of the Orange County Finance
Department for earning the Government Finance Officers' Association (GFOA) Certificate of
Achievement for Excellence in Financial Reporting for the fiscal year ended June 30, 2004.
