Harvey, Planner III, 245-2597 PURPOSE: To continue review and comments on the first draft Unified Development Ordinance (UDO). BACKGROUND: At the August 23, 2010 work session, the BOCC received a staff presentation on the UDO and began its review and comment on the document. During the course of the evening, the Board provided comments on Articles 1 through 5. Comments were received in roughly three categories: 1. Rephrasing and grammar 2. "White Paper" staff research on a few topics before a decision on whether to incorporate the comment into the UDO 3. Noted for future UDO phases} At the end of the evening, the Board decided a second work session would be necessary to review and comment on the remainder of the document (Articles 6 through 10). September 17, 2010 was the date chosen and approved for the second work session. Since some Commissioners were absent from the August 23 work session, staff may collect any comments they have on Articles 1 through 5 for discussion after review of Articles 6 through 10 is completed. SCOPE: At the August 24, 2009 BOCC meeting, staff was authorized to begin the process of developing the UDO. Specifically, staff was tasked with the following: • Incorporate all land use development regulations (i.e. Zoning Ordinance, Subdivision Ordinance, Soil Erosion and Sedimentation Control, and Floodplain Ordinance) into one document, 2 • Correct any identified inconsistencies that exist within the individual regulatory standards, • Begin updating the following sections of the Zoning Ordinance: Article 9 - Signage, Article 10 -Parking, Article 12 -Landscaping, and Article 6 -Dimensional Requirements including, but not limited to: Section 6.31 Lighting and Section 6.27.11 Stream Buffers, • Revise existing subdivision regulations to incorporate recent changes to State law and eliminate identified inconsistencies, • Develop a Conditional UselConditional zoning process for review and comment, • Update existing graphics and tables detailing development standards, and • Provide recommendations for subsequent phases of UDO amendments and 2030 Comprehensive Plan implementation. SUBSEQUENT PHASES: Naturally, during development and review of the initial UDO there will be tendencies to provide comments and ideas in areas where changes are not being made during this project phase. In these cases, comments and ideas will be documented for consideration in the next phase of UDO amendments. It is a primary task of the County's Consultant, Clarion Associates, to document comments and provide formal recommendations tothe County on subsequent phases of UDO amendments. FIRST DRAFT UDO: The first draft UDO is approximately 750 pages and combines all existing land development regulations under one cover. Although a sizeable document, staff has "tracked" changes to enable the reader to identify new text from existing as quickly and easily as possible. Furthermore, a comparative table (distributed in the August 23, 2010 work session packet and available on-line} has been prepared as a tool for anyone interested in knowing where existing regulations are located within the new UDO format. The first draft does not contain graphics the Consultant will insert for the public hearing draft and most of the tables contained in the first draft will be reformatted by the Consultant. Notations of where graphics will be inserted and tables are to be reformatted are highlighted in the document. The draft UDO is available to the public on the Planning Department's website and upon request, can be provided on CD. WRITTEN COMMENTS: Planning Staff encourages BOCC, advisory board, and public review and comment on the first draft. It would be helpful if individuals would please submit comments digitally. A form has been prepared for this purpose and is available on the Planning Department's website (www.co.oran ~ e.nc.usllannin ~ /UDO.asp). This form will also be included on any CD copies of the UDO that are provided. In order to be considered for inclusion into the draft document that will be presented at the November 22, 2010 public hearing, comments must be received no later than 9:00 a.m. on Monday, September 20, 2010. Planning staff will review comments and incorporate them as appropriate before sending the document to our Consultant to format the tables and insert graphics. FINANCIAL IMPACT: The BOCC provided $32,600 in the 2009-2010 budget, Departmental Contract Services Account, to complete this BOCC priority. The costs of consulting services, as outlined in the executed contract, are not to exceed $30,000. The additional $2,600 was budgeted for advertising, copying and printing expenses. RECOMMENDATION: The Manager recommends the Board: 1. Review and provide comments on the remaining Articles (6 through 10).
