PURPOSE: To consider approving a resolution authorizing the sale of the County property
located on Highway 49 (Old ABC Store), Cedar Grove.
BACKGROUND:
Hwy 49-Old ABC Store
On September 2, 2010 the Board of Commissioners authorized staff to begin the upset bid
procedure on the property located on Highway 49 in Cedar Grove. Pursuant to North Carolina
General Statutes the upset bid was advertised for 10 days. No upset bids were received.
The County currently has three additional properties offered for sale: 129 East King Street and
112 N. Churton Street, Hillsborough; and 1914 New Hope Church Road, Chapel Hill. Future
bids, if any, will be presented to the Board at the appropriate time.
FINANCIAL IMPACT: Funds received for the sale of the Old ABC Store property ($3,500) will
be distributed based on 40% to the Schools for renovations of older facilities ($1,400) and 60%
to a reserve fund established for future development of an Orange County Southwest Branch
Library ($2,100).
RECOMMENDATION(S): The Manager recommends the Board take the following action
regarding the Old ABC Store on Highway 49, Cedar Grove:
o accept the offer submitted by James T. and Tammy C. Wilson in the amount of
$3,500;
o approve the attached Resolution and authorize the Chair to sign the resolution as
appropriate; and
o authorize staff to create the appropriate paperwork for completion of the sale and
authorize the Chair to sign.

Resolution Authorizing Sale of Property 2
WHEREAS, Orange County owns the following property: Old ABC Store, Highway 49 North, Cedar
Grove-PIN # 9829408061 and;
WHEREAS, North Carolina General Statute § 160A-269 permits the County to sell property by upset
bid, after receipt of an offer for the property; and
WHEREAS, the County has received an offer to purchase the referenced properties as described
below:

WHEREAS, the bidders have paid the required five percent (5%) deposit on their offers; and
WHEREAS, proper notice and advertisement for upset bids was carried out as required by Statute
and no upset bids were received;
THEREFORE, THE ORANGE COUNTY BOARD OF COMMISSIONERS RESOLVES THAT:
1. The Board of County Commissioners authorizes sale of Old ABC Store, Cedar Grove to James T.
& Tammy C. Wilson in the amount of three-thousand five hundred dollars ($3,500.00).
2. The terms of the final sale are that
- the Board of County Commissioners approve the sale of the Old ABC Store, Cedar Grove
to James T. & Tammy C. Wilson, and
- the buyer must pay with cash at the time of closing.
3. The County reserves the right to withdraw the property from sale at any time before the final high
bid is accepted; and to reject all bids at any time.
