PURPOSE: To consider removing one member from the Orange Unified Transportation Board.
BACKGROUND: Paragraph 7 of Orange County's Resolution regarding Orange County Appointment
And Orientation Process for Boards and Commissions states that:
If an appointee, in any calendar year, has absences which constitute more than 25 percent of the
regularly-scheduled Board meetings or three consecutive meetings,whichever comes first,which
he or she is required to attend, he or she is obligated to resign...If the individual refuses to resign, he
or she may be removed by action of the Board of county Commissioners subject to state or local law.
The OUT Board support staff notified the Clerk's Office that one member, Mr. Eric B. Tillman,
member at-large, last attended a meeting of this Board in May, 2009. A letter (asking for his
resignation) was sent on July 28, 2010. There was no response from him. Mr. Tillman was
contacted by telephone by the Clerk's Office and "stated that he was busy at that time, but
wanted to discuss this board and his concerns. He asked if someone would call him later. He
was then contacted the second time by telephone and said he would not submit his resignation.
When advised that the next step for us was to ask the Board to remove him, he said that would
fine and that he would respond to this removal in writing after this occurred because he felt that
the Board of Commissioners needed to hear what he had to say about his concerns with the
OUT Board.
FINANCIAL IMPACT: None.
RECOMMENDATION(S): Consider removing Mr. Tillman from the Orange Unified
Transportation Board in order to appoint another applicant.

Dear Mr. Tillman:
Each member of an advisory board or commission is important to the effectiveness of the board
or commission. Decisions or other official advice on matters cannot be done without a quorum
of the members being present. That is why it is important for each member to attend and
participate in the meetings of the board.
Because of this,the Orange County Board of Commissioners requires that members of advisory
boards and commissions regularly attend at least 75%of the scheduled meetings.
Upon recommendation of the Orange Unified Transportation Board,based on your attendance at
the OUT Board meetings,the Clerk to the Board of Commissioners is requesting that you submit
your resignation from this board due to excessive absenteeism.
We are sorry you have not been able to participate this past year and should your schedule change
and you would like to be reconsidered for this or another one of our boards and commissions,
please let us know. Thank you for the time you have given to the Orange Unified Transportation
Board.

This letter serves as an appeal to your letter dated July 28,2010,requesting my letter of
resignation from the Orange Unified Transportation Board,to the Orange County Board
of Commissioners. Please find enclosed a letter to Karen Lincoln dated September 9,
2010,stating my reason for appeal,

Dear Ms.Lincoln:
This letter is to confirm that I received your voicemail on my telephone,Wednesday,
September 8,2010,at or about 4:OOPM. Please fund enclosed,a letter from Ms.Donna
Baker,Clerk to the Board of Orange County Commissioners,dated July.28,2010,stating
among other things that,"Upon recommendation of the Orange Unified Transportation
Board,based on your attendance at the OUT Board meetings,the Clerk of the Board of
Commissioners is requesting that you submit your resignation from this board due to
excessive absenteeism."
According to your voicemail you wanted to know if I still wanted to attend meetings of
the OUT Board. It appears that based on precedence set by you with former OUT Board
members with like or similar absenteeism records as my"absenteeism-record,"your
request is"moot"at best. As an employee of the Orange County Government you either
knew or should have known that once you set a precedence for notice,you must apply
that precedence of notice equitably and without disparity. For whatever reasons,you
failed to apply your precedence of notice to my situation as you applied it to former OUT
Board members with like or similar absenteeism records as mine.
It is my intention to appeal the request for my resignation from the Clerk to the Board of
County Commissioners to the Board of County Commissioners. I suggest to you that a
letter of retraction of the request for my resignation from the Clerk to the Board be sent to
me before any discussions take place concerning my future with the OUT Board,in order
to alleviate any future embarrassment.

Board of Orange County Commissioners.
I ask that you review these letters in order to gain an understanding of the situation that is
being appealed to the Board of County Commissioners. It is unfortunate that the Orange
Unified Transportation Board has,in my opinion,seen fit to use a procedural disparity
and inequity to have me removed from this board because of ideological and
philosophical differences with the"status quo"on this board. In my opinion, Orange
County Volunteer Boards should embrace differences in order to gain a better perspective
concerning the needs and opinions of all tax paying citizens of Orange County,before
making decisions that impact upon them.
