BACKGROUND: The Board of Commissioners approved the appointment of Laura Blackmon as Orange County Manager, effective November 30, 2006, and established her starting salary at its meeting on October 17, 2006. The other elements of compensation and aspects of Ms. Blackmon's appointment are resolved in the attached "Terms" Board action. FINANCIAL IMPACT: Funding for the pay and benefits for the County Manager for the 2006-07 fiscal year is included in the BOCC-approved 2006-07 budget. RECOMMENDATION(S): ,Approve the terms of the appointment of Laura Blackmon as Orange County Manager. 2 _ Terms of the Appointment of Laura Blackmon As Orange County Manager In consideration of the public service provided to Orange County by Ms. BlaclQnon, pursuant to N.C. Gen. Stat. § 153A-92, Ms. Blackmon will receive the following compensation and other consideration: 1. An annual salary of $135,000.00, effective November 30,2006. 2. Ms. Blackmon will be evaluated at least annually with the potential for receiving merit increases plus any bonus as the Boazd of Commissioners, in its discretion, deems appropriate from time to time. For the 2006-2007 fiscal yeaz, the Boazd of Commissioners and Ms. Blackmon will together evaluate Ms. Blackmon's performance in Apri12007 and in June 2007. 3. The same cost of living adjustment as received by full time, permanent County employees from time to time. 4. A County owned vehicle (compressed natural gas) assigned to Ms. Blaclm~ion. 5. A County owned cell phone provided to Ms. Blackmon for County use and for personal use, the latter only as provided for in a County policy concerning the personal use by County employees of County owned cell phones. 6. Vacation and leave time: (1) Effective November 30, 2006, paid vacation leave will be accrued at the rate of 10 hours per month. Provided, however, Ms. Blaclonon may draw on and use immediately 80 hours (10 days) of her first yeaz's paid vacation leave. Earned and unused vacation leave maybe accumulated without a maximum until January 31 of each year. On that date, any accumulated vacation leave in excess of 240 hours will convert to sick leave. The maximum amount of accumulated vacation leave that can be carried forward to February 1 is 240 hours. (2) Effective November 30, 2006, paid sick leave will be accrued at the rate of 8 3 hours per month. (3) Effective November 30, 2006, 2 days per yeaz paid personal leave will be available. (4) Upon Ms. Blackmon's termination of employment with Orange County, by retirement or otherwise, she shall receive a cash payment equal in amount to any accumulated vacation leave. 7. Vested right in the North Carolina Local Government Retirement System as prescribed by law; after five (5) years of service Ms. Blackmon will be eligible for monthly retirement benefits based on salary, age and years. of service. 8. Participation in either or both of the County's 457 and 401(k) plans; a 5% of compensation employer contribution to the County's 401(k) plan. 9. Family health insurance (including Ms. Blackmon) consistent with coverage of full time, permanent County employees. This coverage will be provided effective December 1, 2006. 10. Payment of membership fees and reimbursement for travel expenses associated with membership in the following associations: ICMA, NACo, The Innovation Group and NCCCMA. 11. Reimbursement for reasonable County-related business expenses. 12. Reimbursement in an amount not to exceed $10,000 for actual, out of pocket expenses associated with Ms. Blackmon's relocation, including packing, moving, storage, insurance, unpacking of household, temporary housing if necessary including the cost of airline tickets, hotels, and a rental caz in seeking a new home. 13. The County has a policy, Policy Number 0470, providing generally for the defense of and indemnification of County employees. A copy of Policy Number 0470 is attached hereto and incorporated herein by reference. The County has comprehensive general 4 liability and public official errors and omissions insurance coverage. Each of these policies includes coverage for the Orange County Manager. 14. Ms. Blackmon will provide Orange County with 90 days' notice of her intent to resign should she decide to do so. In the event the Board terminates the at will appointment of Ms. Blackmon, for reasons other than personal misconduct as defined in the Orange County Personnel Ordinance, Ms. Blackmon will receive a lump sum payment equal to one fourth her then current annual salary.
