PURPOSE: To approve a right of way agreement as requested by Duke Power for power lines
to be installed for the .Seymour Senior Center on the Human Services Campus on Homestead
Road, Chapel Hill.
BACKGROUND: Duke Power will be installing certain underground power transmission lines
from Homestead Road to the Seymour Senior Center facility and parking areas and have
requested that the County grant a 10' easement on each side of the installed lines. The exact
location of the underground lines and the associated 10' easement is undetermined at this time.
Duke Power will be determining the actual location on site at the time of installation to account
for features such as existing light poles, trees, and other amenities that facilitate or impede the
installation. A map showing any affected features is not available at this time. A map showing
actual location of lines will be attached to the Right of Way. Agreement at the completion of the
work.
FINANCIAL IMPACT: There is no financial impact associated with granting this request:
RECOMMENDATION(S): The Manager recommends that the Board approve the right of way
agreement with Duke Power for underground power lines at the Seymour Senior Center; and
authorize the Chair to sign on behalf of the Board.

hereinafter called "Grantor" hv~hether one or more). in consideration of the sum of One Dollar (51.00) and other good and valuable
considerations. does hereby `rant unto DYKE ENERGY CORPORATION, and its successors and assigns. subsidiaries and
divisions, hereinafter called "Grantee," the perpetual right.. privilege and easement to go in and upon that certain land of Grantor
(hereinafter "premises'") situated in said County and State, propem~ described as:

This right-of-way is ~,~ivcn to permit the consh~uction of facilities. presently proposed. f=acilities at other locations and future
extensions of presently consh•ucted facilities are not permitted by this agreement. The fi~resoin~~ not~+ithstandin~~. Grantee may
relocate its facilities and right-of-way strip over the premises to contonn to anv future high~ti~av or street relocation. ~+idening or
improvement.
