Harvey, Planner III, 245 -2597 PURPOSE: To receive an overview of the first draft Unified Development Ordinance (UDO), review next steps, and discuss. BACKGROUND: At the May 24, 2010 Quarterly Public Hearing, the BOCC received a staff update on the status of the UDO project and approved a revised timetable (Attachment 2) for its completion. Since then, the following tasks have been completed: • Planning Board review of preliminary draft sections (stream buffers, lighting, signs, parking, landscaping, conditional use, subdivisions, and general provisions), • Advisory board courtesy review of preliminary draft sections (stream buffers, lighting, signs, parking, and landscaping), • Public Information Session held on June 16 (Attachment 3), • Public Information Session scheduled September 8t", and • First draft UDO. SCOPE: At the August 24, 2009 BOCC meeting, staff was authorized to begin the process of developing the UDO. Specifically, staff was tasked with the following: • Incorporate all land use development regulations (i.e. Zoning Ordinance, Subdivision Ordinance, Soil Erosion and Sedimentation Control, and Floodplain Ordinance) into one document, 2 • Correct any identified inconsistencies that exist within the individual regulatory standards, • Begin updating the following sections of the Zoning Ordinance: Article 9 - Signage, Article 10 - Parking, Article 12 - Landscaping, and Article 6 — Dimensional Requirements including, but not limited to: Section 6.31 Lighting and Section 6.27.11 Stream Buffers, • Revise existing subdivision regulations to incorporate recent changes to State law and eliminate identified inconsistencies, • Develop a Conditional Use /Conditional zoning process for review and comment, • Update existing graphics and tables detailing development standards, and • Provide recommendations for subsequent phases of UDO amendments and 2030 Comprehensive Plan implementation. SUBSEQUENT PHASES: Naturally, during development and review of the initial UDO there will be tendencies to provide comments and ideas in areas where changes are not being made during this project phase. In these cases, comments and ideas will be documented for consideration in the next phase of UDO amendments. It is a primary task of the County's Consultant, Clarion Associates, to document comments and provide formal recommendations to the County on subsequent phases of UDO amendments. FIRST DRAFT UDO: The first draft UDO is approximately 750 pages and combines all existing land development regulations under one cover. Although a sizeable document, staff has "tracked" changes to enable the reader to identify new text from existing as quickly and easily as possible. Furthermore, a comparative table (Attachment 4) has been prepared as a tool for anyone interested in knowing where existing regulations are located within the new UDO format. The first draft does not contain graphics the Consultant will insert for the public hearing draft and most of the tables contained in the first draft will be reformatted by the Consultant. Notations of where graphics will be inserted and tables are to be reformatted are highlighted in the document. The draft UDO is available to the public on the Planning Department's website and upon request, can be provided on CD. WRITTEN COMMENTS: Planning Staff encourages BOCC, advisory board, and public review and comment on the first draft. It would be helpful if individuals would please submit comments digitally. A form has been prepared for this purpose and is available on the Planning Department's website (www.co.orange.nc.us /planning /UDO.asn). This form will also be included on any CD copies of the UDO that are provided. In order to be considered for inclusion into the draft document that will be presented at the November 22, 2010 public hearing, comments must be received no later than 9:00 a.m. on Monday, September 20, 2010. Planning staff will review comments and incorporate them as appropriate before sending the document to our Consultant to format the tables and insert graphics. The costs of consulting services, as outlined in the executed contract, are not to exceed $30,000. The additional $2,600 was budgeted for advertising, copying and printing expenses. RECOMMENDATION: The Manager recommends the Board: 1. Receive the first draft UDO, 2. Provide input and direction, as may be appropriate. June 14 Discussion Topic ■ Concerns about changes to signage ordinance; would like regulations to support business development and business marketing efforts June 16 Discussion Topics Discussion Tonics ■ UDO process may include change of zoning district names to better reflect intent of districts ■ Idea to put final code on CD so that it can be searchable by key words ■ Staff will put together administrative manual to accompany LIDO • Focusing on protection of rural character is a preferred way to discuss the differences between rural and urban development ■ Zoning districts could be consolidated based on uses allowed in current districts; some districts are redundant in the uses they permit ■ Procedures in UDO to be organized by "difficulty" of process and by ultimate approval body ■ Explained the reason for having so many procedures and that not all procedures were required for every development • County interested in facilitating non- residential/commercial development through the UDO, may be an opportunity for an expedited process to create incentive for commercial development • Parking, landscaping, tree protection, outdoor lighting provisions in current ordinance are very inconsistent, through LIDO process will be making more consistent • Landscaping and tree protection ordinances are currently inadequate and do not provide enough guidance for enforcement • Proposing addition of Conditional Zoning and Conditional Districts: o Conditional Districts would replace the current Planned Unit Development district designation o Conditional Zoning is a new tool what would allow for development of small area focused districts (floating zones) • County would like to include "light' uses within stream buffer areas with mitigation measures (e.g., trails, walkways, and other low impact uses) E ■ Concerns about protection of environmental features that are not adequately documented on maps and through focused studies; Environmental Impact Statements (EIS) and environmental surveys should address any features not identified by County or State agencies Potential Issues to be Included in Implementation Bridge Report ■ Regulating adult entertainment
