HomeMy WebLinkAboutRES-2006-049 Amend Interlocal Cooperation Agreement to Allow Immediate Suspension & Resolution to Suspend Interlocal Cooperation Agreement by Mutual Consent of the Parties~~s -~d~~ ~ o ~ ~ ORANGE COUNTY BOARD OF COMMISSIONERS RESOLUTION TO AMEND INTERLOCAL COOPERATION AGREEMENT TO ALLOW IMMEDIATE SUSPENSION AtVD RESOLUTION TO SUSPEND INTERLOCAL COOPERATION AGREEMENT BY MUTUAL CONSENT OF THE PARTIES WHEREAS, Orange, Person, and Chatham counties entered into an Interlocal Cooperation Agreement for the Provision of Mental Health, Developmental Disabilities and Substance Abuse Services effective July 1, 2004; and WHEREAS, Orange, Person and Chatham counties have continued to provide mental health, developmental disabilities and substance abuse services through Orange, Person and Chatham Mental Health, Developmental Disabilities and Substance Abuse Authority (OPC Area Program) while administrative activities were begun to implement the Interlocal Cooperation Agreement; and WHEREAS, since July 1, 2004, mental health system reform has been subject to a dizzying array of technical memoranda, conflicting communiques, restrictive rulings, executive edits, and shifting policy directives regarding system reform, including decisions to divest local management entities of two of the primary functions vested in them under the system reform statute; and WHEREAS, as a result, the process of converting from an area authority model to a multicounty program model as contemplated by the Interlocal Cooperation Agreement would dilute already overtaxed resources. NOW THEREFORE BE IT RESOLVED that the Board of Commissioners of Orange County hereby ratifies the adoption of an amendment to the Interlocal Cooperation Agreement to allow its immediate suspension and, upon the adoption by Person County and Chatham County of corresponding resolutions, the Board of Commissioners of Orange County resolves to suspend the Interlocal Cooperation Agreement by agreement of all parties.
