MINUTES BOARD OF COMMISSIONERS _., REGULAR MEETING JUNE 6, 1988 The Orange County Board of Commissioners met in regular session on Monday, June b, ].988 at 7:30 p.m, in the Courtroom of the 01d Courthouse, Hillsborough, North Carolina. MINUTES Motion was made by Commissioner Hartwell, seconded by Commissioner Halkiotis to approve the October 20, 19$7 minutes as circulated. VOTE: UNANIMOUS. Motion was made by Commissioner Hartwell., seconded by Chair Marshall to approve the May 17, 19$8 minutes as corrected. VOTE: UNANIMOUS. D. RESOLUTIONS OR PROCLAMATIONS None ~~~ E. REPORTS 1. MANAGER'S PROPOSED BUDGET PRESENTATION County Manager John Link stated that the 39 million dollar budget outlines a progressive plan and service system for Orange Gounty for the next fiscal. year. The major components of the budget include emphasis an education and human services. There is a significant increase in outside agency appropriations. Improvement of the county's financial position was a main objective in the budget to prepare the county for the future bond referendum. Link continued with a slide presentation outlining the major impacts of the budget and the expected revenues. In order to fund the recommended budget a tax rate of 64.5 cents would be required (increase of 3.9 cents) and an increase of 2.2 cents for the Chapel Hill-Carrboro School District Tax. He described the budget objectives which were used as guidelines for making the decisions in the recommended budget. The current expense x'equest from the. Chapel Hill-Garrboro School system was $932 per student from county funds plus $904 p.er student from the district tax. Orange County requested $1017 per student for current expense. In the recommended budget $950 per student is recommended for both school systems. Link highlighted the significant increases in the budget and explained those increases. He reviewed the new County positions included in the recommended budget and listed the school capital projects. In conclusion, Link stated that the proposed budget is a reflection of the county's efforts to respond to the changes of the community and diversified service needs for the citizens of Orange County. The Board members asked specific questions to which John Link answered. 2. LOW/MOD HOUSING TASK FORCE RECOMMENDATIONS (A copy of the staff implementation report is in the permanent agenda file in the Clerk's office) Director of Housing and Community Development Tara Fikes summarized the report and stated that several of the recommendations are in progress and scheduling has been done to implement those recommendations. Recommendations 2, 3 and 10 have been completed. All planning items -- recommendations 4, 5, 6a and 8a have been scheduled for review in October of 1988 with public hearing in November of 1988. She pointed out that recommendation 6b pertaining to the study of public transportation in Orange County was being done by the Orange County Transportation Board and the task force supports those efforts. Recommendation 3b and 7d peztain to the establishment of a local housing and trust fund. House Bill 328 was passed by the General Assembly last year and gave cities and housing .authorities the authority to provide local funds for low and moderate income housing. However, this authority was not extended to counties. Chair Marshall asked that a bill be prepared for review by the Commissioners by November which would include counties in this legislation. F. ITEMS FOR DECISION = CONSENT AGENDA (ANY ITEM MAY BE REMOVED FOR SEPARATE CONSIDERATION) Motion was made by Commissioner Hartwell, seconded by Commissioner Halkiotis to approve the items as stated below: 1. LEGAL SERVICES CONTRACT - GHILD SUPPORT To approve the contract with Goleman, Bernholz, Dickerson, Bernholz, Gledhill and Hargrave, Attorneys at Law to provide legal representation for the Child Support Office dated July 1, 1988. 2. LISTING OF EMERGENCY PHONE NUMBERS IN TELEPHONE DIRECTORIES FOR HAZARDOUS MATERIALS ~~1 To make a request of each telephone company operating in Orange County for publishing the telephone numbers for hazardous materials along with other emergency numbers in the telephone directories. 3. NCDOT CONTRACT APPROVAL FOR A PU$LIC TRANSPORTATION FEASIBILITY STUDY To approve an agreement with the N.C. Department of Transpor-tation, Public Transportation Division, for funds to hire a transportation consultant for completing a Public Transportation Feasibility Study and to establish an Ad Hoc Committee to work with the Consultant. NCDOT would fund the study up to $10,000 maximum with Orange County providing a 10~ match. 4. RESOLUTION OF PARTICIPATION IN THE STATE'S LAND RECORDS-MODERNIZATION GRANT PROGRAM To adopt the resolution stated below indicating the desire of Orange County to continue to participate in the State's Land Records Modernization grant program for 1988 and forward a copy to the State. BE IT RESOLVED by the Orange County Board of Commissioners, that it recognizes and appreciates the Land Records Management Program of NRCD and its assistance to counties through matching grants, and desires to participate in the modernization program of land records for the 1988-89 fiscal year. It further agrees to abide by the agreements and contracts with the programs that are mutually adopted. 5. EXPANSION OF INSURANCE RATED AISTRICT To approve the expansion of the East Orange Insurance rated district from four (4) road miles to five (5) road miles. 6. NURSE CONSULTATION SERVICES ;. To approve the agreement between Orange County and the Home Health Agency of `,:,;~ Chapel Hill, Inc, to provide nurse consultation services for the Adult Services Program, Orange County Department of Social Services and authorize the Chair to sign the agreement. 7. TAX SETTLEMENT PRELIMINARY REPORT (A copy of this report is in the minute book on pages';;. ;`~r!) To accept the report from the Tax Collector regarding the annual Tax Lien Sale which gives the total amount of unpaid real property taxes for 1987 and the list of those having unpaid personal property taxes for 1987 and enter the lien and insolvent lists into the minutes. 8. FIREWORKS PERMIT FROM THE TOWN OF CARRBORO To approve, contingent upon submission of proof of insurance, a fireworks permit for the Town of Carrboro on July 4, 1988. 9. LEASE RENEWAL-EFLAND RESCUE UNIT BUILDING To approve the lease renewal between the Efland Rescue Unit, Efland Volunteer Fire Company, Inc., and Orange County for the Efland Rescue Unit building in Efland, North Carolina to continue for a period of one year commencing July 1, 1988 and terminating at 12:00 midnight June 30, 1989 and to authorize the Chair to sign the lease agreement on behalf of the Board. 10. RENEWAL OF LEASES EXPIRING IN JUNE, 1988 i~~ To approve lease renewals for Wake Opportunities, JOCCA, and Community School for People Under Six through June 30, 1989, and authorize the Chair to sign on behalf of the Board. 11. 1987-88 AUDIT CONTRACT ': To approve the contract for fiscal year 19$7-$8 to develop the audit for the fiscal year ending June 30, 1988 with Touche Ross & Co, for the amount of $25,750 and to authorize the Chair to sign. VOTE: UNANIMOUS. ITEMS FOR DECISION-REGULAR AGENDA 1. ORANGE REGIONAL LANDFILL TIPPING FEES Bruce Heflin, Director of Public Works for Chapel Hill, gave background information and summarized the reasons for the recommendation to increase tipping fees at the Orange County Landfill. Because of the additional requirements from the State, the operation costs for the landfill have increased. With the additional revenues they will purchase new equipment which will be needed to meet the state requirements as well as dig new wells for monitoring. The first installment of the landfill liner will be paid in 1988. Three payments of $100,000 each will be paid over the next three years. The recycling program will be expanded. Commissioner Halkiotis asked if there was a law against trash being hauled in open trucks and Bruce Heflin responded that all trucks are supposed to be covered so that debris does not blow out. Commissioner Hartwell suggested making the tipping fee lower for cars and pick-up trucks stating that these are the people who make the decision to go to the landfill or dump the trash elsewhere. Heflin indicated that some pickup trucks come to the landfill scraping the pavement because of being overloaded. They would like to discourage this by keeping the pick-up truck rate close to the per ton rate. Heflin indicated he would study the request from Commissioner Hartwell and try to get a breakdown on how much material is coming in from pick-up trucks and cars and report that information back to the Board. Further discussion ensued on the future of the landfill operation and alternatives to the landfill. Commissioner Willhoit made comments about debris blowing out of trucks and asked that he be provided with a copy of the state regulation. The Board requested that Heflin take the comments made; by the Board members back to the Landfill committee and report back at a later time and he agreed. Motion was made by Commissioner Halkiotis, seconded by Commissioner Hartwell to approve a new schedule of tipping fees for the Orange Regional Landfill beginning July 1, 1988 as listed below: garbage and refuse construction and bulk asbestos coal ash pick-up trucks and trailers single carloads VOTE: UNANIMOUS. $10.00 per ton $12.00 per ton $10.00 per ton $15.00 per ton $ 5.00 per load $ 3.00 per load 2. EAGLES CHASE SUBDIVISION -PRELIMINARY PLAT The property is located in Hillsborough Township off Ode Turner Road (SR 1130). Seven (7) lots are proposed out of 21.71 acres. The average lot size will be 3.10 acres. Each lot will have frontage on Jacobs Trail. The property is zoned ~-~~ Residential-1 and the Land Use Plan designation is Rural Residential. _. _ The Administration recommends approval with the extension and dedication to Orange County of the 50-foot right-of-way from the cul-de-sac on Jacobs Trail to the eastern property line. The acceptance of the dedication by the Board is also recommended. Actual construction of Jacobs Trail would terminate in the temporary cul-de-sac as presently shown. Motion was made by Commissioner Hartwell, seconded by Commis-sioner Halkiotis to approve the Administration's recommendation. VOTE: UNANIMOUS. 3. OAK CREST SUBDIVISION-PRELIMINARY PLAN The property is located in Chapel Hill Township near Star Point at the end of Booth Road (SR 1531) on the Orange/Chatham County line. The tract is zoned Rural Buffer and Protected Watershed II. The Joint Planning Area Land Use Plan designation is Rural Residential. Thirty-eight (38) residential Iots are proposed on the 113.99 acre tract. All lots are over two acres in size. The Administration recommends approval per the Planning Board Recommendation with three changes which are included in the conditions listed below in the motion. Planner Emily Crudup and the developer of the subdivision answered various questions from the Board. Motion was made by Commissioner Hartwell, seconded by Commis-sioner Halkiotis to approve the preliminary plan for Oak Crest Subdi-vision with the following 11 conditions and accept the dedication of the right-of-way. 1. Provide restrictive covenants for review by the County Attorney which include a prohibition on further subdivision of the thirty-eight (38) lots shown on the preliminary plan as well as provisions for maintenance of drainage easements and stormwater detention facilities. (Final plat requirement) 2. Approval of the access easement agreement with accompanying plat by the ~.' County Attorney. (Final plat requirement) 3. Provide a warranty deed to Orange County for the 5.86 acres of recreation/open space in the format recommended by the County Attorney. (Final plat requirement) 4. Approval of the stormwater management plan including provisions to control the peak rate of runoff for the 10-year storm to the predevelopment rate. 5. Provide a registered engineer's calculations and certification that proposed improvements to the road crossing at Price's Creek will not decrease the flood carrying capacity of the stream. 6. Provide a note on the final plat which restricts access of lots l9, 20, 21, and 22 to the cul-de-sac at the end of Booth Road; lots 14, l5, 16, 17 and l8 to Cedar Run Lane; lots 7, 8, 9, and 10 to Ridge View Lane; and lots 34, 35, 36, and 37 to Shiners Place. 7. Obtain approval of the erosion control plan and apply for the required grading permit prior to any site disturbance. (Final Plat requirement) 8. Provide a 30-foot public pedestrian and non-motorized vehicle access easement to connect the dedicated recreation/open space to the Heritage Hills Recreation Area. 9. On the final plat, label the 5.86 acres on Price's Creek as "Dedicated to Orange County for Recreation/Open Space Purposes." (Final plat requirement) l0. Combine lots 26, 27, and 28 with other lots or label thew as being of restricted development potential and not for building purposes. If labeled on the plat, a written notice of the restriction must also be recorded. If lots 26, 27, and 28 are found to have suitable septic sites, they may be ~~ retained as separate lots on the final plat. 11. Dedicate to public use (Orange County) the Booth Road right-of-way for the stub-out as indicated on the preliminary plan. It is required that the right-of-way be labeled "dedicated to public use." VOTE: UNANIMOUS. 4. BOULDER BLUFF SUBD. -PRELIMINARY PLAN The property is loca ted on the east side of Dodsons Crossroads two-thirds mile south of Dairyland Rnad. It is zoned Residential-1 and the Land Use Plan designation is Rural Residential. Twelve (12) lots and two tracts over ten acres are proposed in two phases out of 62.7 acres. The open space easement which will be owned and maintained by a Homeowners Association includes approximately 1.97 acres. The dev- eloper has agreed to provide an easement for a trail along the length of the creek. The Administration and the Planning Board recommends approval of the preliminary plan for Boulder Bluff Subdivi-sion with a Glass B private road having pullovers as needed for cars to pass each other safely and seven conditions as listed below in the motion. Motion was made by Commissioner Hartwell, seconded by Chair Marshall to approve the preliminary plan for Boulder Bluff Subdivision as recommended by the Administration and the Planning Board with the following seven conditions: 1. Submit restrictive covenants and Road Maintenance Agreement fox review and approval by the County Attorney. 2. Indicate a fifty-foot right-of-way on the private road. 3. Show acreage of lots 3 through 12 and Tracts A and B including and excluding the road right-of-way. 4. Choose a new road name which is not repeated elsewhere-in the County. 5. Include in the Restrictive Covenants provisions for tree protection. 6. On the final plat, indicate an easement to allow the residents access along the creek. 7. Provide a note restricting access of lots 3 and 4 to the private road. 8. Included in the restrictive covenants prohibition of further subdivision. VOTE: UNANIMOUS. 5. PD-1-87 FLOWERS MO$ILE HOME PARK -REQUEST FOR EXTENSION Motion was made by Commissioner Halkiatis, seconded by Commissioner Hartwell to approve a six-month extension of a Planned Development/Special Use Permit for Flowers Mobile Home Park. VOTE: UNANIMOUS. 6. TOWN OF HILLSBOROUGH REQUEST - RELINQUISHMENT OF SUBDIVISION REGULATIONS Planning Director Marvin Collins gave background information on the request from Hillsborough for Orange County to relinquish administration of its Subdivision Regulations within the Town's planning and zoning jurisdiction. Motion was made by Commissioner Hartwell, seconded by Commissioner Halkiotis to approve the proposed amendments made by Hillsborough to clarify the design standards for I-40/I-8S, and other minor changes to the Subdivision Regulations to address the recommendations from Orange County. VOTE: UNANIMOUS. The Board's decision will be forwarded to the Town of Hillsborough. Following adoption and incorporation of the design standards into the Hillsborough zoning and subdivision regulations, the Board of Commissioners may consider the specific request to ~~~ relinquish administration and enforcement of the Orange County Subdivision Regulations in the Town's planning and zoning jurisdiction. 7. REQUEST TO INITIATE LEGAL ACTION - DWIGHT WAGONER Motion was made by Commissioner Willhoit, seconded by Chair Marshall to initiate legal proceedings against Dwight Wagoner who is in violation of the Orange County Zoning Ordinance. VOTE: UNANIMOUS. 8. PROCEDURAL CHANGE - ISSUANCE OF BUILDING PERMITS (Copy of the procedure is in the permanent agenda file) Motion was made by Commissioner Halkiotis, proposed procedural change for the issuing VOTE: UNANIMOUS. seconded by Chair Marshall to.support the of building permits. 9. ASSIGNMENT OF HOUSE/BUILDING NUMBERS -RURAL ROUTES AND CHAPEL HILL AREAS Motion was made by Commissioner Halkiotis, seconded by Commissioner Willhoit to approve the advertisement and the public hearing date of June 21 for the assignment of house numbers on Rural Route 11 and a portion of Route l5, Chapel Hill. VOTE: UNANIMOUS. 10. OWASA/CHATHAM AGREEMENT Motion was made by Commissioner Hartwell, seconded by Commissioner Willhoit to adopt the resolution as stated below: WHEREAS, the OWASA Board of Directors has asked the governing bodies of Orange County, Carrboro and Chapel Hill to comment on a proposed agreement between OWASA and Chatham ~! County regarding sale of water and cooperative planning of water facilities; and WHEREAS, the Orange County Commissioners support the sharing of water supplies in the :'mutual interest of the citizens of Chapel Hill and other jurisdictions; and WHEREAS, the proposed agreement would enable sharing of OWASA's water supplies on an interim basis as Chatham County develops facilities to use Jordan Lake water, most likely on a joint basis with other entities; and WHEREAS, the management of growth in southern Orange and northern Chatham Counties should be conducted on a cooperative, coordinated basis in the best interests of the citizens of the areas; NOW, THEREFORE, BE IT RESOLVED by the Orange Gounty Board of Commissioners: That the Orange County Commissioners endorse the purposes of the proposed draft agreement, dated April, 1988, between Chatham County and OWASA, regarding sale of water and cooperative water supply planning. VOTE: UNANIMOUS. ll. JOINT APPLICATION FOR AN ALLOCATION OF $. EVERETTE JORDAN LAKE WATER SUPPLY Motion was made by Gommissioner Hartwell, seconded by Commissioner Willhoit to endorse the County's joint application for water withdrawal from B. Everette Jordan Lake in cooperation with OWASA, Tawn of Hillsborough, Orange-Alamance Water System, Inc. and Chatham County as stated. in the resolution stated below: RESOLUTION AUTHORIZING THE FILING OF ORANGE COUNTY'S APPLICATION FOR AN ALLOCATION OF B. EVERETT JORDAN LAKE WATER SUPPLY STORAGE AND EXPRESSING SUPPORT FOR SUBMITTING SAID APPLICATION IN GOOPERATION WITH OTHER AGENCIES WHEREAS, Orange County has reviewed possible water demands for the next several decades and assessed the water supply available from existing and planned water supply ~~~ sources within the Gaunty, and has determined that additional water supply sources will need to be developed to meet the potential demand for water within the County; and WHEREAS, $. Everett Jordan Lake is a multiple-purpose water resource which is "-'~`'~ reported to have approximately 100 million gallons of water per day potentially ', available for use as a public water supply; and `. WHEREAS, B, Everett Jordan Lake will continue to undergo close observation, testing and evaluation as to quality and suitability for use as a public water supply source, and the technology for the treatment of water from this potential source may be further developed to improve protection of the public health of water users who may depend upon the lake as a source of potable water supply; and WHEREAS, the North Carolina Environmental Management Gommission has the authority and responsibility to allocate the water supply potentially available in B. Everett Jordan Lake to water supply purveyors and has adopted rules and regulations applicable to the submittal of formal requests for an allocation of water from said lake, and the Division of Water Resources has stated that the date by which allocation requests are to be submitted is July 1, 1988; and WHEREAS, B. Everett Jordan Lake may in the future be a suitable and economically feasible water supply source for use by Orange County and an allocation of water supply from said lake should be requested; and WHEREAS, the development and utilization of $. Everett Jordan Lake in cooperation with other parties in the region may offer substantial benefits, including: economies of scale in facility development and ongoing operations; reduction in the adverse environmental impacts associated with facility development; improved water treatment, staffing and water quality testing; and greater ability to implement further modifications to the water treatment process; and WHEREAS, Orange County desires to carefully and fully evaluate in cooperation with all other interested parties the benefits of joint development and/or utilization of B. Everett Jordan Lake as a future public water supply source. -'~ NOW, THEREFORE, BE IT RESOLVED: 1. The Board of Commissioners of Orange County hereby authorizes and directs the __:. County Manager to file with the North Carolina Environmental Management Gommission an application for an allocation of B. Everett Jordan Lake water supply storage. Based on present water demand projections, a Level I water supply storage allocation is not required; however, a Level II water supply storage allocation of 1.3 million gallons per day shall be requested by Orange county. 2. The Board of Commissioners authorizes and directs the Gounty Manager to develop and submit Orange County's allocation application jointly in cooperation with the applications of other parties in the region, if possible. Said parties may include, but are not limited to, the Town of Hillsborough, Orange-Alamance Water System, Orange Water and Sewer Authority, Chatham County and the Town of Pittsboro. Orange County's request shall state that substantial public benefits are anticipated from participation in a cooperative approach to developing and/or utilizing water supply- related facilities at B. Everett Jordan Lake. 3. If a joint allocation application is submitted, said application shall clearly state that the respective allocations requested in the joint submittal are to be made to the individual parties participating in the application. Each party should formally express its interest in evaluating cooperative development and/or utilization of B. Everett Jordan Lake as a future water supply source; however, participation in the joint application submittal shall not in any way preclude any party from utilizing and developing its respective allocation wither independent from or in cooperation with any or all of the parties to the request. 4. The monitoring data collected to date indicates that B. Everett Jordan Lake may be used as a public water supply; however, increasing development and other land-disturbing activities within the lake's drainage basin will affect the quality i ~~ of the water supply available in the lake. Orange County supports the continuation and strengthening of programs established to comprehensively monitor, maintain and improve the quality of water in B. Everett Jordan Lake. VOTE: UNANIMOUS. H. BOARD OF HEALTH - Reappointment of William E. Beel, Riley Wilson and Emil. Chanlett. EXECUTTVE SESSION - Motion was made by Commissioner Hartwell, seconded by Commissioner Halkiotis to go into Executive Session for legal purposes. VOTE: UNANIMOUS. E88--7331 PURPOSE: To receive reports from the Tax Collector regarding the annual Tax Lien Sale which gives the total amount of unpaid real property taxes for 1987 and the list of those having unpaid personal property taxes for 1987, - - BACKGROUND Mandated by General Statutes 105-373 which states: Settlements.--(a) Annual Settlement of Tax Collectar- (1) Preliminary Report. On the second Monday following the Tax Lien Sale, the Tax Collector shall make a sworn report to-the governing body of the taxing unit showing: (a) Action taken with respect to the Lien Sale; and (b) A list of the persons not owning real property whose personal property taxes remain unpaid. (to this list the Tax Collector shall append his statement under oath that _ he has made diligent efforts to collect the taxes due from the persons listed out of their personal property and by other means available to him for collection, and he shall report such other information concerning these ' taxpayers as may he of interest to or required by the governing body, including a report of his efforts to make collections outside the taxing-unit under the provisions of G. S. 105-364. (2) Insolvents. Upon receiving this report required by subdi- vision (a) (l), above.the governing body of the taxing unit shall enter ,upon its minutes the names of persons awing .~ taxes (but who listed no real property) whom it finds to be solvent, and it shall by resolution des-ignate the list entered in its minutes as the insolvent list to be credited to the Tax Collector in his settlement.
