BACKGROUND: The next regular quarterly public hearing is scheduled for February 23, 1998. A summary of each item proposed for public hearing is provided below. The proposed legal advertisement, the text of proposed ordinance amendments, and other background information are attached. LIVING WAGE ORDINANCE The Board of County Commissioners has received, and on December 1, 1997, considered A Report Examining a Living Wage Ordinance for Orange County, North Carolina. The Board directed the preparation of a Living Wage Ordinance for its consideration following a public hearing during which it will receive public comment on the coverage and other content of the proposed ordinance. Generally the proposed ordinance will require those contracting with Orange County to pay their employees a living wage when the purpose of the contract is to provide services to Orange County or its citizens that Orange County could provide with its own employees. The proposed ordinance will also cover construction contracts, to the extent permitted by the public bidding laws. It will also propose that businesses receiving the benefits of loans from the Orange County loan pool, economic development grants, and other financial aid pay their employees a living wage. 1 The ordinance will initially establish the Orange County living wage at $8.00 per hour and may provide for periodic (annual) changes to incorporate cost of living increases. ORANGE COUNTY ZONING ATLAS AMENDMENT 1. PD -2 -98 State Employees Credit Union Request for approval of a Planned Development - Economic Development (PD- ED) zoning designation and a Class A Special Use Permit to construct a 4800 square -foot credit union facility with drive - through window on 2.07 acres. The property is located at the southwest comer of Old NC 86 and Oakdale Drive (4.44.B.22,23) in the Economic Development District. Development projects in the Economic Development District (EDD) which do not meet all standards specified in the EDD Design Manual may be approved by the Board of Commissioners as a Planned Development with a Class A Special Use Permit. The applicant is requesting Special Use Permit approval because the proposed development project does not meet all of the standards specified in the EDD Design Manual, including the requirement for a 100 - -foot buffer around the perimeter of the Economic Development District, and the requirement that parking areas be located to the rear of the building. ORANGE COUNTY ZONING ORDINANCE TEXT AMENDMENT 1. Floor Area for Existing Non - residential Uses in Residential Districts Proposed amendment to Article 5.1.2 Schedule for Non - residential Development to allow an increase in the maximum floor area for additions to existing non - residential uses permitted in the AR, RB, R -1, R -2, R -3, and R-4 zoning districts from 8.8 percent, 10 percent, and 12.3 percent to 14.1 percent. CLASS A SPECIAL USE PERMIT 1. PD -1 -98 Carolina Friends School (Modification) Carolina Friends School is an existing private school located in the Rural Buffer Zoning District on the north side of Mt. Sinai Road west of Friends School Road, with access provided by Friends School Road. The property contains about 38.62 acres and is known as Tax map lots 20A, 20B and 26A of Tax Map 7, and lots 2 and 43A of Tax Map 6, in Chapel Hill Township. The school currently operates under a Class A Special Use Permit due to the type and size of the sewage disposal system and the use of multiple principal structures. The Special Use Permit was originally issued in 1990 and was modified in 1992, 1993, 1996, and 1997. The proposed modification is for a master plan to expand the school including a new entrance on Friends School Road, athletic fields, and 50,450 square feet of floor area in a meeting house, multi- purpose center and additions to existing buildings. RECOMMENDATION: The Administration recommends approval of the attached advertisement for the February 23, 1998, quarterly public hearing. 4 NOTICE OF PUBLIC HEARING ORANGE COUNTY BOARD OF COMMISSIONERS A public hearing will be held in the Superior Courtroom of the New Orange County Courthouse, 106 E. ImpacMssues: Institutional uses such as schools, government buildings, and places of worship are permitted in all residential zoning districts with site plan approval by the Planning Department. Traditionally, such uses are located in or near residential areas. The architectural form that houses an institutional use historically has been massive, not only because of its function, but as a symbolic focal point for the local community. In many cultures worldwide, institutional structures typically serve as local landmarks due to their prominent size, accessible location, and use. Schools and churches often have one or more accessory structures such as a gymnasium and other recreational buildings, fellowship hall, or administrative/ educational building. The result is sometimes a campus or complex of buildings united by a similar purpose. The volume of buildings is usually balanced by open space on the lot in the form of playgrounds, courtyards, athletic fields, or cemeteries. In Article 5 of the Zoning Ordinance, dimensional requirements are established for each zoning district. Two sets of standards apply for each district to residential and non - residential uses. The numbers and ratios set forth in Article 5 establish site development criteria such as minimum lot size, building setbacks, lot width, maximum floor area, and building height. Because of larger land requirements, institutional uses frequently have difficulty locating where they are needed, or expanding to meet growing community demands. In 1989 the Zoning Ordinance was amended to increase the floor area allowed for non - residential uses in residential districts (RB, AR, R -1, and W7 R -2) from 5.8 percent to 8.8 percent, the standard in the R -3 district. Since that time, the Board of Adjustment has reviewed at least three requests for variances from the standards in Article 5.1.2 as applied to churches and schools. Several existing institutional uses are at or approaching the current 8.8 percent limit on floor area, which might preclude any significant future additions to those buildings. The proposed amendment would increase the maximum floor area allowed for non - residential uses legally existing as of 5/6/98 in the RB, AR, R -1, R -2, R- 3, and R-4 residential districts from 8.8 percent (10 percent in Planned Developments, 12.3 percent in R -4) to 14.1 percent. The text of the amendment is attached. The new standard is equal to the current limit on floor area in PD -R -4 district and is consistent with actual floor area of existing facilities.
