Purpose: To consider a contract between Orange County Raceway and Orange County,
Department of Emergency Management, to provide medical coverage for events and
races held at the Raceway.
Background: The Emergency Management Department provided medicai coverage for
races and events last year, under a similar agreement. The race track last year was known
as Orange County Speedway, and has changed ownership and is now known as Orange
County Raceway. Emergency Management staff have met with the owners, and have
discussed the need for medical coverage and how it is to be provided. Staff and raceway
officials have worked out the operational and fiscal issues of the contract, and have
reached a satisfactory agreement. Reimbursement to the County for its services to the
Raceway will increase from the $47.50 per hour paid last year to $50 per hour for the
1998 race season.
Recommendation: The Manager recommends that the Board approve the contract and
authorize the Chair to sign.

This Contract dated February 12, 1998., between William Michael Lamm, Vice-
President, General Manager DBA Orange County Raceway, Inca (the "Raceway") and the
County of Orange (the "County") for joint and cooperative arrangements for the
provision of emergency medical services at certain Raceway events.
WITNESSETH
WHEREAS, the County and the Raceway propose to work jointly on matters of
concern or interest; and
WHEREAS, certain events at the Raceway bring spectators to Orange County
to enjoy the events; and
WHEREAS, the provision of adequate emergency medical care at such events is
a matter of mutual concern and interest to the Raceway and the County; and
WHEREAS, detailed joint and cooperative arrangements with respect to such
events will mutually benefit the Raceway and the County; and
WHEREAS, the County and the Raceway desire to provide such cooperative
emergency medical care;
N(~?~ THEREFORE, in consideration of the premises and the mutual covenants
and conditions set forth below, the County and the Raceway agree as follows:
1. The County agrees to provide emergency care providers certified at the
Emergency Medical Technician and/or Pazamedic level for the eighteen (18) 1998
Raceway events as outlined in the Orange County Speedway 1998 Schedule. (Exhibit A)

2. The County agrees to provide one (1) ambulance staffed with one (1) Paramedic
and two (2) Emergency Medical Technicians (minimally) for one (1) 1998 event (5-29).
and two ambulances each staffed with one (1) Paramedic and two (2) Emergency Medical
Technicians for seventeen (17)1998 events (3-28, 4-11, 4-18, 5-2, 5-9, 5-30, 6-20, 6-27,
7-3, 7-18, 8-1, 8-15, 8-22, 9-5, 9-12, 9-18, and 10-10. Additional coverage will be
negotiated between the County and the Raceway at the time of need.
3. The County agrees to keep records of patients seen at the Raceway while
covering Raceway events under this contract and, with the consent of the patient, to
provide such records to the Raceway, upon its request. Data available to the County
from the records of patients seen at the Raceway which is clearly not patient identifying
may be provided to the Raceway, upon request of the Raceway and when appropriate.
4. The Raceway shall compensate the County for emergency medical services
provided pursuant to this contract by paying to the County a sum based on a rate of
$50.00 per hour per ambulance for each event covered. These hours will include
preparation and travel time of one (1) hour for each event plus the coverage time per
event. The county shall submit an invoice for these events on a weekly basis and
payment by the Raceway shall be made to the order of the County and mailed to Orange
County Emergency Management , P. O. Box 8181, Hillsborough, N, C. 27278.
5. The personnel providing the emergency services shall report to the Raceway at
the time agreed upon by the Speedway and the County.

6. The contract may be reviewed annually no later than March 1, and may be
renewed, modified, or amended at that time, or at any other time, upon the mutual
written agreement of the parties.
7. This contract may be terminated at any time by either party by giving 90 days
notice to the other party in writing.
8. If either party defaults in its obligations and does not cure such default within
ten (10) days of receipt of notice of such default, the non-defaulting party may
immediately terminate the contract.
