PURPOSE: To consider accepting a $4,000 Certified Local Government (CLG) grant from the State
Historic Preservation Office.
BACKGROUND: At its January 20, 1998 meeting, the Board of Commissioners authorized the County Manager to
apply for up to $18,000 from the CLG Grant Program administered by the State Historic
Preservation Office (SHPO). The grant and matching funds would be used to complete a
National Register nomination for the St. Mary's Road/Trading Path Historic Corridor.
The Preservation Planner was notified on April 6, 1998 that the application has been approved
(attachment #1). However, the amount of grant funds awarded was less than requested - $4,000.
SHPO has also recommended a change to the original project description. Since the St. Mary's
Road/Trading Path Historic Corridor is not currently listed on the state's National Register Study
List, SHPO has recommended that Orange County use this grant to conduct a preservation
planning study of the corridor. This study will be a preliminary step toward an eventual
nomination to the National Register . The study will involve an intensive evaluation of the area
and assessment of possible preservation options, such as scenic byway designation, open space
easements, National Register listing, and local historic district or landmark designation (see
attachment #2).
To receive the grant, the County must sign the attached Grant Agreement and provide
certification of matching funds (attachments #3, #4). These documents must be mailed to the
SHPO on May 7, 1998 (attachment #7).
The revised project budget totals $12, 000, including $4,000 in grant funds, $6,000 in County
matching funds and $2,000 in -kind services. A Scope of Work will be developed by the Planning
Department in consultation with SHPO.
RECOMMENDATION: The Administration recommends that the County Manager be authorized to sign the Grant
Agreement and provide certification of matching shares.

I am pleased to inform you that your application for a 1998
Certified Local Government (CLG) grant is one of twelve selected
for funding from among twenty -four proposals. Grant funds are
made available to CLGs through the State Historic Preservation
Office, Division of Archives and History, from the Historic
Preservation Fund (HPF) administered by the National Park
Service, U.S. Department of the Interior.
This year approximately $70,000 will be awarded to county and
municipal governments participating in the CLG program. Funding
is targeted for archaeology, architectural survey, commission
training, design guidelines, restoration, and nominations to the
National Register of Historic Places.
The enclosed Grant Project Outline, based on your grant
application, will provide a brief summary of anticipated
activities and costs related to-your project. To indicate your
acceptance of the grant, with its related conditions, please sign
both copies of the enclosed Grant Agreement and the Certification
of Matching Share Form and return them by April 30, 1998, to

to set aside some time to read through the booklet. It will help
answer your questions concerning the responsibilities of the
Project Coordinator. The booklet also provides information on
contracts and a sample reimbursement letter. If you have further
questions about the administration of grant funds, please call
Ms. Edmisten at the number listed above.

Debarment Form. Kindly return the completed poster receipt form
and debarment form by April 30 also.
After all initial documents have been received, the HPO staff
specialist assigned to your project will contact you about
project initiation, including the open selection of a qualified
consultant, and preparation of a Project Description and _
Contract. Parties to the contract will include you, as Grantee;
the Division of Archives and History; and the consultant.
Attachments to the description /contract will specify the services
and goods provided by each party and standards to be followed. No
reimbursement from grant funds will be available until the final
contract has been executed.

PROJECT DESCRIPTION:
Orange County will conduct a preservation planning study of the St. Mary's Road Corridor. The study
will involve an intensive evaluation of the area and assessment of possible preservation options. such as
scenic byway designation, open space easements, National Register listing, and local historic district or
landmark designation. Examination of the area will include consideration of historic architectural and
known archaeological resources. In lieu of intensive archaeological survey, background research will be
conducted to determine the possibility that historic archaeological resources exist. The county will hire a
consultant who meets the qualifications outlined in 36 CFR 61 to conduct the study. The study will be
completed on or before September 30, 1999.

GRANT AGREEMENT
This Grant Agreement is entered into this 6th day of April, 1998, by the State Historic
Preservation Office (HPO), hereafter known as the HPO, and Orange County, Grantee, for
and in consideration of a federal grant in the amount of $4,000 (four thousand dollars), for the
purpose of a preservation planning study of the St. Mary's Road Corridor. The project will
end no later than September 30, 1999.
GRANTEE STANDARDS: The Grantee agrees to have a satisfactory record of performance;
comply with the required completion schedule for the project; conform with debarment
requirements; and be otherwise qualified and eligible to receive a grant award under applicable
laws and regulations.
GENERAL CONDITIONS: The Grantee agrees to match the grant with funds or services
from nonfederal sources within the grant period, to use grant and matching funds or services
for the purpose specified above, and to furnish such reports and documentation, financial or
otherwise, as may be specified by the HPO. Project activities shall be performed according to
the Secretary of the Interior's Standards for Archaeology and Historic Preservation, under the
guidelines and professional supervision of the HPO. -
PROJECT DESCRIPTION AND CONTRACT: The Grantee agrees to enter into a detailed
Project Description and Contract with the Division of Archives and History and a qualified
Consultant openly selected to carry out objectives for non - construction projects, including
architectural surveys, survey manuscripts, archaeological investigations, preservation planning,
design guidelines, and the preparation of nominations to the National Register of Historic
Places. Attachments to the description /contract will specify the services and goods provided by
each party, a project budget, and standards to be followed. No reimbursements from grant
funds will be available until this final contract has been executed.
APPENDIX FOR GRANT AGREEMENTS: The Grantee agrees to the stipulations
contained in the attached "Appendix for Grant Agreements ". The Grantee further agrees to
incorporate reference to the Appendix in all contracts and attach a copy of the Appendix to all
contracts involving project activities.
PAYMENT OF GRANT FUNDS: The HPO agrees to payment of grant funds on a
reimbursement basis. Reimbursements will consist of a maximum of 60 percent of allowable
project costs, documented by invoices and canceled checks, and timesheets or other evidence
of in -kind contributions as applicable. Upon request the HPO may advance the Grantee up to
25 percent of the grant funds. After satisfactory documentation of this advance, along with the
required matching share, additional advances may be requested for up to 75 percent of the
grant award. The final 25 percent of grant funds will be payable only after satisfactory project
completion.

APPENDIX
for
GRANT AGREEMENTS
The following stipulations apply to all projects funded in part by federal Historic Preservation
Fund (HPF) moneys awarded to the North Carolina Department of Cultural Resources,
Division of Archives and History, State Historic Preservation Office (HPO), by the U.S.
Department of the Interior, National Park Service.
Questions about the application of these conditions to specific projects are available from the
HPO project specialists or from the grants administrator, State Historic Preservation Office,

1. PROCUREMENT: Grantees must forward to the HPO evidence of compliance with
federal competitive procurement requirements for professional services and
subcontracts prior to reimbursement, if applicable.
2. RETENTION OF RECORDS: Acceptable federal and nonfederal share - supporting
documentation must be submitted prior to reimbursement, if applicable. Documentation
includes: copies of contract, time sheets, front and back of canceled checks, invoices,
etc.
3. CHANGES IN SCOPE: The approved scope of work, products, budget, and
performance/ reporting milestones included in the contract cannot be changed without
prior written approval from the HPO.
4. LOBBYING PROHIBITED: Grantees must conform with the following text of 18
U.S.C. 1913, which prohibits the use of the grant funds for lobbying: No pan of the
money appropriated by any enactment of Congress shall, in the absence of ecpress
authorization by Congress, be used directly or indirectly to pay for any personal
service, advertisement, telegram, telephone, letter, printed or written matter, or other
device, intended or designated to influence in any manner a Member of Congress, to
favor or oppose by vote or otherwise, any legislation or appropriation by Congress,
whether before or after the introduction of any bill or resolution proposing such
legislation or appropriation; but this shall not prevent officers or employees of the
United States or its Department or agencies from communication to Members of
Congress on the request of any Member or to Congress, through the proper official
channels, requests for legislation or appropriations which they deem necessary for the
efficient conduct of the public business.
5. NONFEDERAL AUDIT: Grantees that receive $300,000 or more in federal financial
assistance are responsible for obtaining audits in accordance with the Single Audit Act
of 1984 and the Single Audit Act Amendments of 1996, and OMB Circular A -133. The
audit shall be made by an independent auditor in accordance with generally accepted
government auditing standards covering financial and compliance audits.
6. PUBLICATIONS. Acknowledgment of federal grant assistance should be made in
connection with the publication of any material based on, or developed under, any
activity supported by HPF grant funds, as follows: The acriviry that is the subject of
this (type of publication) has been financed (in pan /entirely) with federal funds from
the National Park Service, Department of the Interior. However, the contents and
opinions do not necessarily reflect the views or policies of the Department of the
Interior, nor does the mention of trade names or commercial products constitute
endorsement or recommendation by the Department of the Interior.
NOTE: The design and content of any publication produced from a survey of
architectural or archaeological resources must be reviewed and approved by the HPO
prior to its printing.
7. SUSPENSION OR TERMINATION OF GRANT: Voluntary and involuntary
suspension or termination of the grant, in whole or in part, by either the state or
grantee may occur at any time prior to the date of project completion.
8. STANDARDS FOR FINAL PRODUCTS: Final products that do not conform to the
terms and conditions of the grant Agreement or which do not meet the applicable
Secretary of the Interior's Standards will not be reimbursed.
9. EQUAL OPPORTUNITY. Grantee must comply with Title VI of the Civil Rights-Act
of 1964 and Section 504 of the Rehabilitation Act of 1973.
10. OTHER REQUIREMENTS: In addition to the terms detailed in this grant Agreement,
all federal requirements governing grants are applicable. (OMB Circulars A -87 or A-
121, A -102 or A -110, and A -128.)

On a separate sheet, please describe in one well developed paragraph what will be accomplished with
the grant and matching funds, and how the project meets the goals of Legacy, North Carolina's
comprehensive historic preservation plan for the 1990s (see enclosed information).
Applications for architectural surveys should include the estimated number of acres and properties to
be surveyed. Archaeological survey project abstracts must be accompanied by a map (USGS Quad)
showing the area(s) to be covered and a narrative statement/estimate of the acreage to be covered.
Historic Preservation Office staff are available for assistance in developing the project description,

III. ABSTRACT OF PROPOSED PROJECT
When white settlers began arriving in the North Carolina Piedmont during the early -to-
mid eighteenth century, many of them traveled south along a trade route used for centuries by
native inhabitants. The Indian Trading Path extended from present -day Petersburg, Virginia, to
the North Carolina -South Carolina border near Union County and beyond. During colonial
times, it was a major route of travel into Hillsborough and Orange County. Farmsteads and
plantations were built along the road. Farmers used the ancient path, once trod by bison, to drive
hogs on the hoof to Petersburg. The Trading Path spawned numerous villages and became the
main corridor for a system of colonial travel and trade. Today, only remnants of the Trading
Path remain. Disrupted by settlement and land use patterns, there are only faint reminders of a
route that was significant to the growth and development of North Carolina.
During the development of Orange County's Preservation Plan, interviews were
conducted with members of the Historic Preservation Commission and the local preservation
community to elicit their views on preservation priorities for the county. In addition, a series of
public meetings was held to seek information and opinions from citizens about places in the
County they considered historically significant and worthy of preservation. The St. Mary's Road
corridor was consistently cited as an important - resource because of its historic association with
the Trading Path and its scenic qualities as a gateway to Orange County. Citizens also
acknowledged that suburban sprawl threatens the cultural and historical significance of the area.
The Historic Preservation Commission advocates measures to protect the integrity of St. Mary's
Road as a preservation resource.
St. Mary's Road (NCSR 1002) in Orange County parallels and incorporates much of the
Trading Path route. As part of the primary trail for colonial settlers migrating into North

Carolina from coastal Virginia, numerous historic sites are located along St. Mary's Road.
According to Orange County's historical architecture survey, fifteen historic inventory sites are
located along the road, including three National Register sites and three National Register -
eligible sites. The Historic Preservation Commission believes the St. Mary's Road/Trading Path
Corridor contains suitable contributing characteristics to qualify as a rural historic district. The
corridor exhibits elements of a historic cultural landscape that has evolved through use by the
people whose activities and occupancy have modified the physical environment. The corridor
possesses a significant concentration, linkage, and continuity of land uses, buildings and
structures, roads, and natural features that would qualify it as a National Register Rural Historic
District.
Grant funds would be used to develop a National Register nomination for the St. Mary's
Road/Trading Path Historic Corridor. Funds would be used to hire a consultant to conduct survey
work aimed at developing a thorough historic context of the rural landscape of the corridor. The
scope of work would include: determination of historic area boundaries and evaluation of the
landscape elements; expanded surveys on historic structures and archeological sites; evaluation of
significance and historic integrity of the landscape and built environment; application of the
National Register criteria, and preparation of the National Register Multiple Listing forms. The
work would also include the required photography for the nomination forms and preparation of a
color slide presentation.
National Register listing would provide a basis for more extensive citizen -based planning
initiatives, wherein the residents of the St. Mary's Road/Trading Path Historic Corridor would work
toward a consensus on a vision of their community's future. One approach could involve a
community "visioning" process that uses visual preference surveys, hands -on modeling and other
techniques to develop a plan for the area. North Carolina Scenic Byway designation, a corridor
management plan, rural district designation and design guidelines would be among the tools for
implementing a future community -based plan.

A
A National Register nomination for the St. Mary's Road/Trading Path Historic Corridor
would address several objectives of the county's Historic Preservation Element; namely,
promoting nominations to the National Register, incorporating archeological sites into the
county's priority list of significant historic resources, and broadening the base of support for
historic preservation in the community.
This proposal for a 1998 CLG grant would provide a model for meeting the goals and
objectives of the Legacy plan. Orange County is already implementing its own historic
preservation plan through a number of initiatives. These include a local landmarks designation
program and a National Register nomination for the Cedar Grove Crossroads Rural Historic
District. The County is also considering creation of a preservation division within its Planning
Department to effectively integrate historic preservation concerns into the planning process.
Therefore, the proposed project, under the auspices of the County's ongoing preservation
program, meets all the objectives of Legacy Goal #2 (Planning). In addition, the project
immediately addresses Objective #4D. Upon listing of the St. Mary's Road/Trading Path
Historic Corridor in the National Register, Objectives #5D through #5G will be addressed
through the County's continued commitment to historic preservation.

Dear St. Mary's Road Property Owner:
The Orange County Historic Preservation Commission (HPC) is proposing a study on the history of the St.
Mary's Road corridor.
St. Mary's Road (NCSR 1002) in Orange County includes much of what was known as the Indian
Trading Path. This route extended from present -day Petersburg, Virginia, to the North Carolina -South
Carolina border and beyond. During colonial times, it was a major route of travel into Orange County.
A number of historic sites are located along St. Mary's Road.
The Historic Preservation Commission believes the St. Mary's Road/Trading Path Corridor contains
suitable characteristics to qualify as a historic district. With the approval of the Orange County Board of
Commissioners, the HPC has applied for grant funds to conduct a study that would lead to the eventual
nomination of the St. Mary's Road/'Trading Path Corridor to the National Register of Historic Places.
For owners of historic properties within a National Register district, listing on the Register is a
prestigious honor, for a property that is listed on the National Register of Historic Places has been
deemed important to the Nation's heritage. The listing of a property in the National Register places no
obligation or restriction on the private landowner using private resources to maintain or alter the
prove . Owners of National Register sites may benefit from the availability of Federal and State tax
credits for rehabilitation of income - producing properties, such as rental and commercial buildings.
National Register sites are also given a higher level of review by the state and federal government when
federally funded projects, such as road construction, may adversely affect the area.
A "National Register Fact Sheet" is enclosed that describes the National Register of Historic Places and
what it means to the property owner. If you have any questions about the proposed study, please contact

Historic Preservation Commission. The HPC meets every fourth Wednesday at 7:00 PM at the Planning
