PURPOSE: To approve on second reading the rescue franchise requested by the Orange County
Underwater Search and Recovery Team, Inc.
BACKGROUND: At their meeting on April 21, 1998, the Board of Commissioners considered
and approved, on first reading, an application for franchise for rescue services from the Orange
County Underwater Search and Recovery Team, Inc. Orange County has historically depended
upon dive teams from other counties, when the need has arisen. In the most recent Cedar Grove
area drowning, individual volunteer divers donated their time to assist in body recovery. The
primary organized dive team was from the Durham County Sheriff's Office.
The individual volunteers and other certified divers have formed a dive team. This team has been
incorporated as anon-profit organization and developed a set of by-laws, policies, and operating
procedures. This team is composed of highly qualified, trained, and personally equipped divers.
This team has submitted an application to be franchised to provide dive related services to Orange
County. Their application complies with all the stipulations of the Orange County franchise
ordinance. The team has asked for no County funds to subsidize their operations. Franchising this
team will enable Orange County to have a lead agency in any dive operations that may occur within
the County, and also to return the favors to other agencies that have assisted Orange County in the
past. This application was submitted to the EMS Advisory Council for review, and received
favorable recommendations to be carried forward to the Commissioners.
Under NCGS 153A-46, any action related to granting or amending a franchise requires a passing
vote by the governing board at two regular meetings. Since the Board approved the franchise
application at the first reading on Apri121, an affirmative vote at this second reading will result in
the award of the requested franchise to the Orange County Underwater Search and Recovery Team,
Inc.
RECOMMENDATION(S): The Manager recommends that the Commissioners approve the
requested franchise .

AN ORDINANCE OF THE ORANGE COUNTY BOARD OF COMMISSIONERS
AWARDING A RESCUE SERVICE FRANCHISE TO ORANGE COUNTY
UNDERWATER SEARCH AND RECOVERY TEAM ,INC.
WHEREAS, Orange County Underwater Search and Recovery Team, Inc. is anon-profit
organization incorporated under North Carolina law with the specific intended mission to provide
a comprehensive search and recovery service to the citizens of Orange County, and
WHEREAS, Orange County Underwater Search and Recovery Team, Inc. has complied with the
provisions of Orange County's "Ordinance Regulating Emergency Medical, First Responder, and
Rescue Service Granting of Franchises and Contracts to the Operators in the County of Orange"
in submitting its application to provide Water/Underwater Search and Rescue/ Scuba services,
and
WHEREAS, Orange County staff and the Orange County Emergency Medical Services Advisory
Council have reviewed the application and found that the services are needed and that the
applicant is well-qualified to provide the service;
NOW, THEREFORE, BE IT ORDAINED, by the Board of Commissioners of Orange County,
North Carolina, that:
Section 1. The rescue service franchise requested by Orange County Underwater Search and
Recovery Team, Inc. is hereby approved.
Section 2. This ordinance shall become effective immediately upon its adoption.
