PURPOSE: To approve on second reading the request by Johnston Ambulance Service related to
their request to increase rates for non - emergency ambulance transports within Orange County.
BACKGROUND: In May of 1994, the County granted a franchise to Johnston Ambulance
Service to provide convalescent non - emergency transports within Orange County. Johnston has
been performing satisfactorily since they began business. Section 13.1 of the County's franchise
ordinance provides that "each franchisee shall submit a schedule of rates to the County for approval
and shall not charge more nor less than the approved rates without specific approval by the County"
Johnston's ambulance rates were originally approved by Commissioners at an eighty five dollar
($85.00) base, plus three dollars, fifty cents ($3.50) per loaded mile (with patient actually in
ambulance). Johnston had not previously asked to increase their rates since their franchise was
initially granted.
At their April 21, 1998 meeting, the Board approved on first reading Johnston's request for a new
rate schedule as indicated below:
This request had been presented to the EMS Advisory Council for their review, who found this
request to be reasonable and recommended it be submitted to the Board of County Commissioners.
Under NCGS 153A -46, any action related to granting or amending a franchise requires a passing
vote by the governing board at two regular meetings. Since the Board approved the franchise
amendment at the first reading on April 21, an affirmative vote at this second reading will result in
the approval of the requested rate increase to Johnston Ambulance Service.
RECOMMENDATION(S): The Manager recommends that the Board approve the new rate
schedule as requested by Johnston Ambulance Service.

AN ORDINANCE OF THE ORANGE COUNTY BOARD OF COMMISSIONERS
AUTHORIZING A CHANGE IN THE FEES TO BE CHARGED BY JOHNSTON
AMBULANCE SERVICE
WHEREAS, the Orange County Board of Commissioners on May 2, 1994 approved a franchise
requested by Johnston Ambulance Service for the provision of non - emergency ambulance
transportation between points in Orange County, and
WHEREAS, Johnston Ambulance Service has delivered satisfactory service since the award of
their franchise, and
WHEREAS, Orange County's franchise ordinance provides that each franchisee shall submit a
schedule of rates to the County for approval and shall not charge more nor less than the approved
rates without specific approval by the County, and
WHEREAS, Johnston Ambulance Service has requested that its rates be increased to $125 per
trip plus $3.50 per loaded transport mile with a $15 charge for oxygen used during the trip, and
WHEREAS, Orange County staff and the Orange County Emergency Medical Services Advisory
Council have reviewed the request and found it to be reasonable and appropriate;
NOW, THEREFORE, BE IT ORDAINED, by the Board of Commissioners of Orange County,
North Carolina, that:
Section 1. The rate increase requested by Johnston Ambulance Service, to $125 per trip plus
$3.50 per loaded transport mile with a $15 charge for oxygen used during the trip, is hereby
approved.
Section 2. This ordinance shall become effective immediately upon its adoption.
