Purpose: To consider renewing the contract with Orange County Kartway.

Background: Orange County Kartway, Inc.(formerly known as the Orange County Raceway) holds
events open to the general public and the County provided Emergency Medical coverage at those
scheduled events under a contract for the 1997 season. The Kartway is a small race track that holds races
with go -carts, motor cycles, and legend cars (miniature race cars). The County provides coverage at the
basic life support level, using personnel furnished by South Orange EMS & Rescue Squad, Inc.
Coverage for the 1998 season is proposed under the same terms as the previous contract, with the
exception that reimbursement to the County will be at $35.00 per hour, per unit for each event. This
represents an increase of $5 per hour in the amount paid by the Kartway to the County for coverage in
1997. Coverage time includes preparation and travel to and from the event. Staff have met with Kartway
officials to review the terms of the renewal agreement. This agreement has worked well in the past and has
promoted public safety for citizens attending events at the Kartway.
Recommendation:
The Manager recommends that the Board approve the contract renewal and authorize the Chair to sign.
STATE OF NORTH CAROLINA
ORANGE COUNTY
This Contract dated June 4, 1998, between Orange County Raceway, dba Orange
County Kartway, Inc. (the "Kartway ") and the County of Orange (the "County ") for joint
and cooperative arrangements for the provision of emergency medical services at certain
Kartway events.
WITNESSETH
WHEREAS, the County and the Kartway wish to cooperate and work jointly
on matters of concern or interest; and
WHEREAS, certain events at the Kartway bring spectators to Orange County
to enjoy the events; and
WHEREAS, the provision of adequate emergency medical care at such events is
a matter of mutual concern and interest to the Kartway and the County; and
WHEREAS, detailed joint and cooperative arrangements with respect to such
events will mutually benefit the Kartway and the County; and
WHEREAS, the County and The Kartway desire to provide such cooperative
emergency medical care;
NOW THEREFORE, in consideration of the premises and the mutual covenants
and conditions set forth below, the County and the Kartway agree as follows:
1. The County agrees to provide emergency care providers certified at the
Emergency Medical Technician level for the scheduled 1998 Kartway events as
outlined in the Orange County Kartway 1998 Schedule. (Exhibit A). Additional

coverage will be negotiated between the County and the Kartway at the time of need.
2. The County agrees to keep records of patients seen at the Kartway while covering
Kartway events under this contract and, with the consent of the patient, to provide such
records to the Kartway, upon its request. Data available to the County from the records
of patients seen at the Kartway which is clearly not patient identifying may be provided
to the Kartway, upon request of the Kartway and when appropriate.
3. The Kartway shall compensate the County for emergency medical services
provided pursuant to this contract by paying to the County a sum based on a rate of
$35.00 per hour for each event covered. These hours will include preparation and travel
time of one (1) hour for each event plus the coverage time per event. The County shall
submit an invoice for these events on a monthly basis and payment by the Kartway shall
be made monthly payable to the order of the County and mailed to Orange County
Emergency Management, P. O. Box 8181, Hillsborough, N. C. 27278.
4. The personnel providing the emergency services shall report to the Kartway at
the time agreed upon by the Kartway and the County.
5. The contract may be reviewed annually no later than March 1, and may be
renewed, modified, or amended at that time, or at any other time, upon the mutual
written agreement of the parties.
6. This contract may be terminated at any time by either party by giving 90 days
notice to the other party in writing.
7. If either party defaults in its obligations and does not cure such default within
ten (10) days of receipt of notice of such default, the non - defaulting party may
immediately terminate the contract.
