BACKGROUND: The property is located off the east side of Dumont Drive (SR 1595) in Eno Township. It is zoned AR and L- ENO -PW and designated Agricultural Residential and Lower Eno Protected Watershed in the Land Use Element of the Comprehensive Plan. The approved Concept Plan involved 52 lots with a total area of 81.2 acres proposed to be subdivided. Phase 3 includes 31.33 acres with 5.49 acres in open space. Eleven (11) lots are proposed which average 2.62 acres. Phase 4 includes 18.56 acres with 5.01 acres in open space. Nine (9) lots are proposed which average 1.38 acres. All lots will have individual wells and septic tanks and all roads are proposed to be public. Alex Drive will be the main road extending northeast from Phase 1 and 2. Parker's Path will extend off Alex Drive in Phase 3 and Crabtree Creek Road extends off Alex Drive in Phase 4. Alex Drive intersected with Dumont Drive which is off the south side of Saint Mary's Road. A The Planning Board approved the Concept Plan for Charles' Woods Subdivision on May 15, 1995 before flexible development requirements. Phase 1 contained 15 lots and was approved March 14, 1996. Phase 2 contained 12 lots and was approved April 17, 1997. These are the last two phases of the approved Concept Plan. The subdivision layout is the same as approved on the Concept Plan. Lot lines have been adjusted to obtain Health Department approval. On June 3, 1998 the Planning Board unanimously recommended approval of the Preliminary Plan for Charles' Woods Phases 3 and 4 subject to the conditions contained in the attached Resolution of Approval. RECOMMENDATION: The Administration recommends approval of the Preliminary Plan for Charles' Woods Phases 3 and 4 per the Planning Board recommendation. V RESOLUTION OF THE ORANGE COUNTY BOARD OF COUNTY COMMISSIONERS Name of Subdivision Charles' Woods Phases 3 and 4 Owner /Applicant George W. Thompson/Jeffrey Peloquin The Board of County Commissioners hereby approves Charles' Woods subdivision Phase 3 preliminary plat, dated May 21, 1997 and Phase 4 dated June 1, 1997 and containing 20 lots in Orange County, subject to the fulfillment of requirements specified herein. Alex Drive, Parker's Path, Thomasview Lane and Crabtree Creek Road shall be irrevocably dedicated to the general public and be constructed to standards of the North Carolina Department of Transportation. The approval of this resolution authorizes and directs the Orange County Manager to accept for Orange County and on behalf of the public generally, the offer of dedication of Alex Drive, Parker's Path, Thomasview Lane and Crabtree Creek Road. This acceptance by Orange County of the dedication to the general public of Alex Drive, Parker's Path, Thomasview Lane and Crabtree Creek Road shall be without maintenance responsibility. These roads shall be maintained by the owner /applicant until such time as they are accepted for maintenance by the North Carolina Department of Transportation or some other governmental body. Before the Final Plat of Charles' Woods Phases 3 and 4 can be recorded: A. Sewage Disposal 1. Each residential lot shall contain an adequate area for septic disposal, and repair area, approved by the Orange County Division of Environmental Health. 2. The septic system location may restrict the size and location of improvements. This disclosure shall be included in a document describing development restrictions to be recorded concurrently with the Final Plat. The document shall also disclose that information regarding the tentative location of septic systems is available from the Orange County Health Department, Division of Environmental Health. B. Roads and Access Alex Drive and Crabtree Creek Road shall be constructed to standards of the North Carolina Department of Transportation, within a 60 -foot right -of -way, and the construction shall be inspected and approved by NCDOT. Parker's Path and Thomasview Lane shall be constructed to standards of the North Carolina I Department of Transportation, within a 50 foot right -of -way and the construction shall be inspected and approved by NCDOT. o A letter of credit, escrow agreement, or bond shall be submitted to secure construction of Alex Drive, Parker's Path, Thomasview Lane and Crabtree Creek Road to the standards of the North Carolina Department of Transportation. An estimate of the construction cost must be prepared by a certified/licensed engineer or grading contractor and submitted to the Planning and Inspections Department. The financial guarantee must reflect 110% of that estimate and be issued by an accredited financial institution licensed to do business in North Carolina. The document describing development restrictions to be recorded with the Final Plat shall state that the financial guarantee will not be released until the road construction has been inspected and approved by NCDOT. 2. Submit an erosion control plan for construction of the roads. 3. A sight triangle to NCDOT standards shall be shown at all street intersections. 4. An approved street name sign shall be erected at the intersection of streets as required in Section IV- B- 3 -c -12 of the Orange County Subdivision Regulations. Evidence shall be submitted by the applicant that the sign is in place or a copy of the receipt for purchase of the sign shall be submitted to the Planning Department. 5. All lots shall receive access from the subdivision roads. 6. A turnaround to NCDOT standards shall be provided at the end of Crabtree Creek Road. C. Land Use Buffers and Landscaping 1. Landscaping shall be installed or preserved as indicated on the approved landscape plan, and must be inspected and approved by the Planning and Inspections Department. The applicant shall secure installation of required landscaping through a letter of credit, escrow agreement, or bond. An estimate of the cost for required plantings and their installation must be provided. The estimate for landscaping must include a 10% contingency factor. The financial guarantee shall reflect 110% of the estimate and be issued by an accredited financial institution licensed to do business in North Carolina. 2. Provisions for protection of existing trees as shown on the approved landscape plan shall be included in a document describing development restrictions and requirements to be prepared by Planning Staff and recorded concurrently with the Final Plat. T D. Drainage 1. Impervious surface data, pursuant to Article 6.23 of the Zoning Ordinance shall be included in a document describing development restrictions and requirements to be prepared by Planning Staff and recorded concurrently with the Final Plat. 2. A stream buffer shall be provided along the creek in lot 32 and lot C as indicated on the Preliminary Plan. 3. Locate drainage easements as required following review and approval of the Erosion Control Plan. E. Parkland Cash in the amount of $9,100.00 [($455.00 per lot x 20)] shall be paid to Orange County as payment in lieu of parkland dedication. F. Miscellaneous 1. The Final Plat shall contain a title block and vicinity map in accordance with Section V -D -2 and V -D -3 of the Orange County Subdivision Regulations. 2. The following easements shall be shown on the plat: a. drainage easements as required by D.3 above. G. Certifications A Certificate of Survey and Accuracy signed by a registered Land Surveyor shall be notarized on the face of the Final Plat. 2. A Certificate of Declaration and Maintenance in the form provided in Section V -D -6 -b of the Orange County Subdivision Regulations signed by the landowner and developer shall be on the face of the plat and included in a document describing development restrictions to be recorded concurrently with the Final Plat. 3. The Department of Environmental Health shall certify that all lot residential lots contain sufficient area for septic tank disposal and repair. 4. The North Carolina Department of Transportation shall certify that Alex Drive, Crabtree Creek Road, Parker's Path and Thomasview Lane have been constructed to State standards or that construction plans have been approved. 5. A Certificate of Approval signed by the Orange County Planning and Inspections Department. The lots are accessed by new public roads which will intersect with Dumont Drive south of Saint Marys Road. The current zoning is AR Agricultural Residential. The average lot size is approximately 2.62 acres in Phase 3 and 1.38 acres in Phase 4. Lots will be served by individual wells and septic systems. Project build -out is estimated at four years. Housing units will be constructed, beginning in 1998, with completion of the project scheduled for 2001. Units will consist of detached single - family homes, and the applicant estimates the average sales price to be $180,000, including the lot. METHODOLOGY Fiscal impact analysis is a projection of the direct, current, public costs and revenues associated with residential and non residential growth in the jurisdiction in which the growth is taking place. Fiscal impact analysis considers only direct impact in that it projects only the primary costs that will be incurred and the immediate revenues that will be generated. It calculates the financial effect of a planned development or new subdivision by considering the current costs and revenues such a development would generate if it were completed and occupied today. Fiscal impact analysis does not consider the private costs of public action. It is concerned only with public (governmental) costs and revenues. The method used in preparing the fiscal impact analysis is the Service Standard Approach. While only gross expenditures by service category are derived from the Per Capita Method, the Service Standard method determines the total number of additional employees by service function that will be required as a result of growth. This method employs average county government costs per person, average school costs per pupil, an employee to population ratio, and average operating expenses per employee for each service category and school district. The number of new employees are projected and multiplied times the average operating expenses (includes personnel, operating and capital costs) per employee. These average costs are then weighed against per capita and per pupil revenues to project the total net fiscal impact of the development. The private roads are justified through open space protection, lower density than the maximum allowed, and the subdivision's location in a protected watershed. The Planning Staff recommends approval of the Preliminary Plan for MTK Development with public and private roads according to the conservation option of flexible development and the conditions contained in the Resolution of Approval (an attachment to these minutes on pages ). Barrows asked about access for the new lots 24 and 25. Cameron responded that lot 24 will access Ritz Way and lot 25 will access Yates Road. Cameron continued that only lots 20 and 25 will access Yates Road. Barrows continued, asking about item #5 in the Resolution of Approval which states that further subdivision may require upgrade of roads. She noted that part of the justification for private roads was larger lots and the applicant had indicated that there would be no further subdivision. Cameron stated that with this on record, it would make anyone looking at the recorded plat would know that further subdivision would require road upgrades. Price stated that she felt including the statement help to ensure or a double check to assure it remains as a private road. She felt without this statement in the resolution, the opportunity may be there for further subdivision. Brooks asked if the statement of no further subdivision would be included in the covenants and Cameron agreed that it would. Allison asked if there are any issues related to siting a building because of the ATT 100 -foot right -of -way which may be reduced by ATT later this year to 33 feet. Cameron responded that ATT had indicated that later this summer the right -of -way will be reduced to 33 -feet. She continued that building and septic setbacks can be met with the 100 -foot right -of -way; building on this lot is not contingent upon the reduction of the right -of -way. Brooks asked the open space. Cameron responded that it is being called conservation area and there will be stream buffers and setbacks. Selkirk asked if there was a flowing stream or a wet weather stream. The response was that it is flowing. MOTION: Searles moved approval as recommended by the Planning Staff. Seconded by Selkirk. Kirk noted that the Concept Plan had contained 52 lots but Health Department approval required combination of some lots so there was a loss of 5 lots. The entire subdivision plan now contains 47 lots. The Planning Staff recommends approval of the Preliminary Plan for Charles Woods Phases 3 and 4 per the Resolution of Approval (an attachment to these minutes on pages ). Discussion followed regarding open space requirements. It was pointed out that there is 10.5 acres of open space in these two phases.
