PURPOSE: To consider approving a pyrotechnics permit for Orange County Speedway.
BACKGROUND: Orange County Speedway has requested that the County Commissioners
approve a pyrotechnics permit for the fireworks display which is scheduled for July 3, 1998
in conjunction with the regularly scheduled race.
GS 14-414, indicates that the Board shall consider a fireworks permit for "any and all kinds
of fireworks and explosives, which are used for exhibitions or amusement purposes."
GS 14-413 empowers the Commissioner to authorize and issue permits for the use of
pyrotechnics in connection with "...shows of all descriptions...but only after satisfactory
evidence is produced to the effect that said pyrotechnics will be used for the aforementioned
purposes and none other."
County policy further requires assurance from the sponsoring agency that adequate public
safety measures will be exercised; and that the County will be protected as an additional
insured on the insurance policy(ies) covering the event.
Documents attached satisfy the checklist criteria previously endorsed by the
Commissioners. It may be of interest to the Board that the Fire Code, as modified in 1996,
allows the local fire official to specify that a plan must be developed to ensure adequate
coverage for fire and emergency medical services if he/she believes that the specific public
gathering creates a significant impact on public or fire safety. Mike Tapp, the CountyFire

Marshal, has indicated that such a plan is required for the Speedway and as a result service
contracts were developed between the Speedway and Orange County EMS (for emergency
medical services) and Caldwell Fire Department (for fire protection). Both of these agencies
are on site during any race event.
RECOMMENDATION: The Manager recommends that the Board approve the pyrotechnics
permit for Orange Speedway for their fireworks display to occur July 3, 1998; and authorize
the staff to sign off on the permit form as indicated.
PYROTECHNICS PERMIT CHECKLIST
North Carolina General Statue 14-413 empowers County Commissioners in the State to issue
permits for the use of pyrotechnics in connection with shows of all descriptions after satisfactory
evidence is produced to the effect that the pyrotechnics will be used for the aforementioned
purposes and no others.
The Orange County Commissioners have adopted a policy which cites the completion of the
following criteria as prerequisite to the issuance of a pyrotechnics permit. Verification of the
receipt of information will be evidenced by the signature of the appropriate official on this form.
Only after all criteria listed below have been met will the permit be issued. It should be further
noted that all signatures must be written on the face of the permit in order for the permit to be
valid. Penalties for use of pyrotechnics without a permit are cited in the North Carolina Building
Code, Administration and Enforcement, Volume 1A, Chapter 8.1.

10:30 (approx.) and last 25 minutes (approx.). The Caldwell Fire

display.

PYROTECHNICS PERMIT
COUNTY OF ORANGE NORTH CAROLINA
Pursuant to G.S. 14-413, Commissioners in North Carolina Counties are empowered to authorize and
issue permits for the use of pyrotechnics in connection with "...shows of all descriptions...but only after
satisfactory evidence is produced to the effect that said pyrotechnics will be used for the aforementioned
purposes and none other".
On June 22, 1998, Orange County Speedway, Roughmont, NC, was approved for a pyrotechnic permit
to be used in association with races on July 3, 1998 at the Orange County Speedway.
The approval is granted based on the following assurances from the requestor:
Public Safety personnel will be on site during the event to ensure public safety and to provide
adequate traffic control;
Proof of Liability insurance which includes the County as a named insured, has been submitted to
the Orange County Director of Purchasing and Central Services. Limits of liability are no less than
$1,000,000 per occurrence.
Show setup will be approved by the Orange County Fire Marshal or his designee, prior to the
beginning of show. Permitted explosives include those listed on attachment #1, as submitted by
Fireworks Unlimited Inc., Yancyville, NC.
Orange County Speedway has a current fire inspection and is in compliance with the Standard
Fire Prevention Code, 1988, with North Carolina amendments.

HANDLING INSTRUCTIONS: EACH PARTY SIGNS TWO COPIES OF PERMIT
1. Director of Purchasing signs after certification that checklist criteria has been met.
2. Orange County Manager signs.
3. Fire Official signs, upon approval of the site set up prior to the event.
4. Emergency Management Director signs after assurance from Fire Official that requirements of the Standard Fire Prevention
Code as it respects the use of pyrotechnics has been met.
5. Emergency Management Director provides one copy of permit to show sponsor and returns one copy to the Director of
Purchasing for records maintenance.
