PURPOSE: To consider amending to Zordng Atlas by rezoning a 10-acre parcel
from AR Agricultund- Residential to AS Agricultural Service in Cedar
Grove Township.
BACKGROUND: The proposed 10 -acre tuning lot is located on the Barney W. and June
R. Pittman property (fax Map No. 2.37..24A). The forced which is
1060 feet to Ne east of NC 86N can be accessed by private easauent at
3711 NC 86N, located approximately 3,100 feet nonb of lake Orange
Road (SR 1323) atM approxhntely 3,200 sort of Bradshear Road (SR
154'U. The request is to rezone to entire 10 -acre property from AR
Agricultural Residential to AS Agricultural Service.
The 10 -acre parcel was created t 1989. A 13,000 situate foot building
was constmcted on to property N 1990 for Gla to- Wellcome large
normal research. The firm has since abandoned its operations at to site
Surrounding the proposed routine lot is the 94.5 -acre farm owned and
operated by rue Pitunans.
According to the 1988 site development plan, the use would now be non-
conforming in terms of impervious surface coverage. The maximum
impervious surface permitted for this type of non- residential use in the
Little River Protected Watershed is 12 percent. Including the 13,0005f
footpriut of the existing bu lding and surrounding graveled area,
impervious surface is 1.25 acres (54,450sf) or 12.5 percent of the 10-
acre (435,50(Isf) proposed zoom lot. Zoning and Watershed
Regulations became effective in Lithe River Township on January 1,
1994. The existing development of dm l0 -acre parcel probably became
nonconforming when regulations were adopted.
The maximum amount of land maid AS at any location normally shall
not exceed ten acres. All surrounding properties are within Orange
County's jurisdiction and are zoned AR Agricultural- Residential.
The intent of AS zoning is to provide sides in rual areas for mtal non-
farm, non- residential uses which support horticultural, silvicultural, and
agricultural purposes of AR districts. Application criteria in Article
4.2.24 state that this district will usually be employed where the
following conditions exist:
1. - The site is within an area designated as Agricultnal- Residential.
in the adopted land Use Element of the Comprehensive Plan.
(140 change in the Comprehensive Plan is required.)
2. The lot sire for individual uses would be appropriate to water
supply and sewage disposal.
3. Normally, dre maximum amount of land zoned Agricultural
Service would be no more than ten acres.
The Land Use Element of the Comprehensive Plan shows the Pittrmn
property as Agricvl[uN- Residential. This category pertains to rural
areas where prevailing activities (agriculture, forestry) are related to the
land in an appropriate location for the continuation of these uses.
Therefore, the proposed rezoning to AS would be consistent with the
Comprehensive Plan.
If the rezoning to AS is approved, the following development restrictions
apply:
1. The front building setback most he 50 feet
2. The side and rear building setbacks must be 20 feet;
3. The maximum impervious surface shall be no more than 12
percent, including all structure "fomprum," paved and graveled
driveways, aprons, and all compacted outside storage areas; and
4. A 75- to 100 -foot land Use Buffer adjacent to residential uses is
required, depending upon the use proposed.
Comments have been received from the Fire Marshal, 911, and the
Sheriff stating that the uses permitted m an AS zoning district at this
location can be served.
Plnrming Staff Findings
The application for the rezoning of the tract from AB to AS has been
reviewed by Planning Staff Findings requited by Article 20.3 follow.
1. Bezoromg the property to AS would be compatible with the
stipulations set fords for the Agricultural- Residential plan
category given in the Comprehensive Plan. The Plan would mt
need to be amended to accommodate AS zoning.
2. Seventeen uses one permitted by right in die AS Zoning District.
Four raquhe a Class A Special Use Permit with approval of the
Board of County Commissioners, and five require a Class B
Permit with approval of the Board of Adjustment. Any of these
urea, either by right or under special candidates, could be
allowed on the proposed zoning tract. Lists of AS uses are given
in the to the Boom of County
Commissimem and the Planting Board of June 18, 1998, which

A joint public hearing on the rezoning request was held by don Board of
County Commissioner; and Planning Board on May 26, 1998.
No cmmens were heard from the public.
The Planning Board Chair inquired as to the difference between Class r
and Class if Kennels. The uses are diffnienuated in the Zoning
Ordwvice by the number of animals kept on hand and by the purposes
of she kennels.
Ordinance by the number of arwuls kept on band and by the purposes of
the kennels. Ordinance provisions are as follows:
A Class I Keroad is an establishment which maintains more dun five but
fewer Ban twenty animals of any species, except livestock, for the
purpose of showing, competition, hunting, or sport Class I Kennels are
permiked in the AS zoning district by right.
A Class O Kemal is an establishmem involving sel is of any species,
except livestock, which is engaged in any of the fohowing:
a. Owning or keeping, for any, purpose, 20 or more animals;
b. Selling and/or training guard or security dogs; and
a Keeping more than five animals at any given time for the
foul of breeding.
Class II Kennels are pefmitted only after amining a Class B Special Use
Permit from doe Board of Adjuslbnem.
Planning Board ReconaneMation
The Planning Board considered the proposed terming of 10.0 acres from
AR to AS at its meeting of July 15, 1%8, and approved the rezoning per
the attacked findings. The vote was unanimous.
