The proposed ameodmem to the Land Use Elemeat of the Compresersive Plan is to change die
designation of a 616 -acre parcel owned by Duke University Gom Public Interest Area (Upper Eno
Watershed Critical Area) to Apiouttuml Residential (Upper Eno Watershed Critical Area). The
property is located in Cheeks Toxvship on dx tmrh side of US Highway 70 east of Eflmrd and

the Orange County Z 'vg Ordmence to permit the covshuclion of a telecommutdwtion
tower. The proposed faedity xrould include a 2700.foot telecommmtieation tower, an
equipment cabinet, end an area for fume additioml klecommuvcation carters.
The subject property is soned Agricultural Residential (AR). It is located approximately 450
fat east of Lloydmwn Road (SR 1960) with access from a private easement having an
entrance approximaely 2000 feet sods of NC Highway 54 Wes. The application includes

equipnem cabinet and an area for fume additional telecommunication canrks.

(U -PW). It is loaned 1155 fed noM of NC Highway 54 Wen with access from a
private road knows as O'Day Drive having an enhma approximately 600 felt west of

3. SUP -3 -98 Orange Regional Landfill (Modi0cadan of SUp -}97)
The property is located in Chapel Hill Township on the north side of Bubards Road (SR
1924) on the west side of the rusting Orange Regional Landfill. The parcel contains 12 76
acres and is referenced as Lot 29D on Tax Map 18. The proposed modification m the
anent Special Use Permit is to add an area to be used for recycling glass and metal cans.
The expansion includes a 95M square foot concrete slab, two (2) open sheds, and 44,400
square feet of additional vehicular sundwe. The cunent wrung of the property is Rural
Buffer(RB).

PURPOSE:
To receive public comment on a regoest to amend the Land Use Element ofthc
Comprehensive Plan.
BACKGROUND: An application to amend the Land Use Element of the Compmhensive Plan has
been received from Mark O'Neal, agent for Duke University for a 62.65 -acm
parcel of land were of Hillsborough along US 70 in Cheeks Township, adjacent to
land owned by Orangc-Alamance Water Systems containing Corporation Lake.
The applicant proposes that the property be mdmigvated in the Land Use
Element from its current category of Public Induced Ara nipper Eno Watershed
Critical Area) to Agricultural Residential (UpPee Eno Watershed Critical Arta).
The property is zoned Public Interest Dattict (PID), and is adjacent ro other lands
zoom[ PID owned by Duke and Oange- Alammce Water Systems. Orange -
Alimance Water System hm provided a letter commending on the proposed

modifying the land use plan and zoning to Agricultural Residential consistent with the surromaing
zoning sad usage. This proposed annulment does ram change the intent aM purpose of the plan.
It is Duke University's invent to sell this land. Other than the fact that it is owned by Duke
University, there does not seem m he any other nvsoe that it was idmdfred in the small area plan
as Public Interest District. From Duke's perspective, this vast u not used for forest research, it
does not have any, strategic sigNficaoce to the forestry pro8mm at Duke and it does mt edJOln any
other Isads of Duke University. Marketing of the tract hat proven extremely difficult given iv
present zoning of Public iomrest District which prohibits any' residential uu. This zoning
classification was apparently pawed without Duke's knowledge or consent In our research, we

On June 26, 1998, a petition for amendment to the Land Use Element of the Comprehensive Plan
was submitted by Mark O'Neal, saying an agent for Duke University. In accordmrce with Articles 2
ae 20 of the Zoning Ordinates, the proposed amendment is evaluated on the following pages.
A. GENERAL DESCRIEIION AND HISTORICAL

The inPlicant is requesting that Ne property be m -designated Agricultural Residential (Upper
Ew Watershed Crifical Area) from its covert category of Public Interest Area (Upper Eno
Watershed Critical Area).
Agricultural Residential is descnbed in the Land Use Element as "land in the rural areas where
the prevailing land use activities are related to the land (agriculture, foresrry) and which is an
appropriate locationfor the condonation of these mei'(Sation 3.3). The current designation is
Public Interest Area, which is "land which contains public or quasi.publtc uses such as publicly-
owned land research forests or brown archaeological or historic sites." The property 's location
widdn the Upper Eno Watershed Critical Area would apply to either district. This watershM
overlay district applies to lands widen one-half mile of an existing or proposed water supply
impoundment. Corporation lake, which provides water to customers of the Orange- Alamance
Water Synem, is approximately 500 feet from One property line of Ws parcel. Long -term plans of

Background on the even surrounding the land use designation of this property and
subsequent sending might be instructive. The original 1981 Laud Use Plan classified
this property, along with other lands, as Public Interest Area. Prior to a 1311711984
plat that separated the Duke holdings north of US 70 (BookTage 43183), from those
south of US 70, this property and the adjacent Duke lands to the south were all a
single parcel of land. The subaequent mating of the property took place on October 1,
19M slang with the initial summit of Cheeks Township. Property owners in the
township were no iftal of the swung change. The zoming of Cheeks was based ham the
1981 post categories, and the results of a 1983 small area plan, the West Oconee Area
Study, Both documents classified the land in question as PIA. The PIA land use
category was defined as "hand which contains public or qusi- public ones such as
publicly owned land, research farests or known archaeological or historical situ." The
study further anted that Me recommended classification was based upon elements
including the cadeidenlom that "Duke Forst b considered a semi - public, public
interest area."

PURPOSE: To receive citizen comment on a Class A Special Use Permit application for the
construction of telecommunication tower.
BACKGROUND: The property is located in I ingl em Township approximately 450 feet east of
Lloydtown Road (SR 1960) with the access proposed from a 50'private easement.
The entrance from Lloydtown road is approximately 2000 feet south ofN C. 54
West A 4.4 acre pact is proposed with a 10,000 square foot leased area and an
additional Brea designated as a fall zone easement. The property is zoned
Agdcolmral- Residential (AR) and is not located in a designated watershed
The applicants are rryuesting a Class A Special Use Permit under Article 8.8.I7a
of the Orange County Zoning Ordinance to construct a 270 foot
telecommunication lower, an equipment cabinet, and an area for Income additional
telecommunication carriers. The tower will be a free standing lattice structure and
light steel gay in color.

A type C 40 -four landscaped buffer will be provided around the facility with
Leyland Cypress and Loblolly Pines to he planted. The site is presently in an open
field with a tree line located along the noMem property line. Mils rise line will be
left undisturbed.
There are no existing towers within one mile of Us site on which the applicants
could o-lo late however, the application indicates this tower can structurally
accommodate 5 users. Gabon has indicated they are willing to negotiate with
other users to attach additional communication facilities provided they do not
interfere wit the primary, purpose of the tower.
The facility will he umnawed; therefore, water and sewer facilities will not be
required. Once constructed the tower will only be visited for scheduled
maintenance and emergencies.
RECOMMENDATION: Article 8.4.3 of me Zoning Ordinance includes that the Zoning Officer's
recommendation be presented to the Planting Board within 45 days of receipt of
an application. The 45-day period may he extended up to 60 days with the written
consent of the applicant The public hearing is the time scheduled for presentation
of the Zoning Officer's ecommendation.
The Zoning Officer has not received information which would establish grounds
for mxdd'ng a regarmse finding on the general standards. These standards include
maintaining orpromoting the public hedth, safety, and general wet( e,

PURPOSE: To receive citizen comment on a Class A Special Use Permit application for the
eonsWCtlOn Of a telttmnNOWCaIIOn tower.
BACKGROUND: The property is located in Binghmn Township approximately 1155 feet north of
NC Highway 54 with the access proposed from O'Day Drive, an existing private
road. The enhance from NC 54 is approximately 600 feet west of Bethel- Hickory
Grove Church Roar! (SRI 104). A 2.77 acre tract is proposed with a 10,000 Nacre
foot leased area and an additional area designated as a fell zone easement. The
property is wand Rural Buffer I") and University Lake Protected Watershed
(UNIV -PM.
The applicants are requesting a Class A Special Use Permit under Article 8.8.1]e
of to Orange County Zoning Ordinance lo construct a 250 foot
telecommunication tower, an equipment cabinet, a rd an area for future additional
telecommmdcation carriers. The lower will be a free standing lattice structure and
light steel gray in color.

A type C 40-firm landscaped buffer is pmvided around the facility with existing
force meeting the buffer requirement. The site is presently wooded and existing
vegetation will only be disturbed to accommodate the tower and entrance road.
There are no existing towers smart one mile of Ws site on which the applicants
could co-locaze however, an application has been received from Spectmsite
Communications, Inc. for a 199 ft telecommunications tower approximately
1 33 miles cut of Ws site. This proposal is scheduled to be heard before the
Orange County Board of Adjustment in their September meeting.
The application indicates this tower can structurally accommodate 5 users. Gearon
has indicated they are willing b negotiate with other users to attach additional
communication facilities provided they do not interfere with the primary, purpose
of the tower.
The facility will be unmanned; therefore, water and sewer facilities will not be
required. Once Comtructed the tower will only he visited for scheduled
maintemeace and emergencies.
RECO1,4MBNOATION: Article 8.43 of the Zoning Ordimvice requires that the Zoning Officer's
recommrndetion be presented to the Planning Board within 45 days of receipt of

PURPOSE: To receive citizen comment on a modification to a Class A Special Use Permit for
an addition to the (range Regional Landfill,
BACKGROUND: The Orange Regional Landfill is located on dm outfit and sous sides of EubaNss
Roed (SR 1727) noNn ofChapel Hill. The subject property (Tax Map Number
7.18..27D) coma's 12.76 acres and is located immediately west of the existing
landfill on the noM side of Eubanks Road. It is zoned Rural Buffer and
designated Rural Buffer on da Joint Planning Area Land Use Plan. The existing
landfill is in the Chapel Hill Transition Area on the Joint Pearang Ara Land Use
Plan.
The applicants are regnestivg a modification to a Class A Special Use Permit
issued on the above referenced property on May 5, 1997. The Special Use Permit
included the construction of a 4000 square four vehicle maintenance building, the
processing of yard waste and station debris on an ongoing basis, and the processing
of recyclable materials which included white appliances, tires and scrap meal.

The proposed modification will add an area to be used for recycling glass and
meal cans. The expansion includes: a. A 7,500 square foot concrete slab, b. Two
open sheds, 600 square her and 900 square feet each, and c. 44,000 square feet of
additional vehicular surface.
Currently access to the site is provided through the existing landfill. There is no
direct access to EubaNa Road.
A 100 -foot buffer is provided around the perimeter of me site, except along the
iso em border, neat to the existing landfill. A condition of approval was added to
the original Special Use Permit to insure that all vegetation within the 100 f t
buffet will remain undisturbed.
The Noun of operation of the site are from 7:00 a.m. to 4:00 p.m. Monday through
Friday, and 8:30 a.m. on 12:00 noon on Saturday. Gayle Wilson, Director of Solid
Waste Management for Chapel Hill, has indicated the proposed additional area is
needed for recyclables m the landfill and would not involve any landfilling
activity. The existing landfill will be used through the year 2004 or 2005 and will
be moruroteri for 30 years afterwards. The recycling facility may beutilbed during
this 30 year period.
RECOMMENDATION: Article 8.4.3 of the Zoning Ordinance requires this the Zoning Officer's
raommetdation be presented to the Planning Board within 45 days of receipt of
an application. The 45-day period may be extended up in 60 days with the vamen
commit of &a applicant The public hearing is the time scheduled for presentation
of the Zoning Officer 'a recommeodat an.
The Zoning Officer has not received information which would establish grounds
for among negative frrding on the general standards. These smrdards include
maintaining or promoting the public health, safety. and genera/ welfare.

The Zoning Officer has reviewed the application, the site plan and all supporting
documentation and has j and that the application does comply with the specific
standards and required regulations concerning the modification.

for a Special Use Permitfoodfcarion subject to thefollowing original approved
conditions,
1. All vegetation vvalon the 100 foot buffer shall remain undisturbed. A waiver
of the 100 foot butler shall be provided along she property line next to the
eximing landfill.
2. Yard Waste, mulch and recyclables shall be kept in the designated area as
indicated on the site plan. Land within this designated area not in use shall be
seeded, repaired and maintained.
3. The maximwn amount of recyclables stored on the site at any one time shall
include the following: 12 tons ofwhite appliances, 500 fires and 6 roll -offs
for storage of scrap metal.
6. If any condition of this Special Use Permit shall he held invalid or void, then
this Special Use Permit shall be void in its entirety and of no effort.
No decision on the application is made by either the Planning Board or the Board
of Commissioners at the public heating. Instead, the Planning Board has 60 days
within which to prepare and submit a recommendation to the Board of
Conmtiuionew. Failure of the Planning Based to submit a recommendation
within the settlement time dull be considered a favorable recommendation, without
conditions.
