PURPOSE: TO consider r ing the eontract between Orange County antl
the University O£ North Carolina at Chapel Hill £OL security and the
provi eion of law enforcement at certain major Univerai ty events.
BACKGROUND: In September 1993, the Hoard approved a agreement xith
the University whereby Ue Sheriff's Department provides n law
enforcement officers for security and lax enforcement coverage at
special events ouch as football and basketball games and cancerta at
the Smith Center. The University reimburses the County fully for
salary and benefit payments antl for the coat of any County eguipment
weed in providing Ua service. The agreement is proposed to continue
far the 1998-99 academic yeaz with scope and terms identical to flee
agreement that was originally approved by the Hoard of Commisaionera.

Tlils Contract dated August I, 1998, between The Uttiveaity of North Carolina at Chapel Hill
(the "UrdversiTy") and the Cowty of Orange Qhe "Cowry") forjoint and ooopemvive
artangemrnts for security and the provision of law enforcement personnel at cermiv major
UNversiry events.
W ITNESSETH
WHEREAS, the County and the University bane historically cooperated and worked
jointly on immmecable maarrs of concem or irteresr, and
WHEREAS, the County and the Urdvecsiry have entered into a Mutual Assistance
Agreement dated Apri12, 199'1; and
WHEREAS, certain University sporting events, such as Ne University's home f [ball
and basketball games, and other events at the Student Activities Centeq such az
ncens, bring f and alunmi to Chapel Hill and Orange County to rnjoy Ue
campus and visit Chapel Hill and Orurge Cowty; and
WHEREAS, Ne provision of adequate security, maffic diremioq and law enforcement
personnel at such home football and basketball games or other special evenss is a
matter of mutual concem and inrerest to the University and Ne County; and
WHEREAS, demiledjoint and coopemfive artengemems with inspect to such home
football and basketball games and specie! even¢ will mutually benefit the
University and the Cowty; eud
WHEREAS, We County and Utdversity desire m provide such woperative security
arrangemrnts iv addition ro any requests for assistance wder the Mutual
Assistance Agreemenq
NOW THEREFORE, iv consideration of the premises and the mutual covenants and
cOndillOns se[ forth below, Ne Cowty and the University agree as follows'.
1. The Cowty agrees ro provide uv w fifteen QS) swom law enfomemrnt officers
far each 1998 University home football game.
2. 1'he Cowty agmes to provide up m flfrern 05) swom law enforcement officers
for each 1998-1999 University home men's varsity basketball game.
3. The Cowty agrees m provide, if requested, ap to fifteen (15) swom law
enfomemeu of5oers for each 199fr1999 University special evem at the Student
Activities Cevtu, such as eoveeM1S-
4. The Cowty agces w keep records of the services provided to the University
wder this contmct and ro provide such records ro the Gniversity upon request.
5. The following servioes shall be provided by the Cowry's law etJorcemevt
officers: traffic direction, security, emergency medical assistance, crowd control,
patrol and surveillance and oerertaw enforcement duties requested by ere
UnVersity and slated therein ("the law enforcement sarvioes"). The law
errfomement services hereunder shall also include protective patrol of the event
site and designated adjacem properties prior to, during wd for a masowble lime
after the end of the event.
6. The University will provide vansponation on campus and cotmnwications
equipment to the Cowty's law entbmement of5oea while they are assigned to
contracted dufies far the University. The Cowty shall provide all othrr equipment
essary m perfovn the law enforcement servioes. The Urhversiry shall pey the
costs of Imnsponation and commwications equipment which it provides for the
Cowry's law rnfoccemmt officers-The County shall pay the equipment costs of
all other necessary egwpmem and Ne University shalt reimburse the Cowry for
the costs m the amowt imluded for that purpose in dre smtement to the
University from the Cowty described in pazagmph seven of this Contract.
7. The University shall compensate [he Cowry for the law enPomament servi<w
provided pursuant to this contract by paying to the County w amowt equal m one
and one half times fie salary of each offiwr provided to the University, including
supervisory persowel, plus associated employer payments to FICA wd
retirement socowts (or said employees. Payment shag be made within thirty (307
days of receipt of a svtemem from Ne Cowry following each evem for which
s are provided. The satement shall be sent to: Chief of Police, Unversity
Policee Scewity Services Building, Campus Box 1600, University of North
Carolina at Chapel HiII, Chapel Hill, NC 29599-1600. Payment shall be trade m
Ne order of Ne Cowty and delivered to the County's Fitance Officer, 208 South
Cameron Street, Hillsborough, NC 292'18.
8. The Cowty and the University shall each desigtate one person as its official
wnmet person for purposes o(implemrnting and administering this contract. The
UNVeaity end the County shell wnsult in a fimely fashion regarding the "law
enforcement services" far each respective home football basketball game oe
special evem The County agrees m considu wd use its best efforts to be
responsive to all reasonable University needs wd requests relating ro ehe law
enforcement services hemwdec
9. While perfortoing law enforcement serviws for the University, the County's
law enforcement officers slap be subject m the lawful operational eormnands of
the officer in charge of the division m which etey are temporarily assigned and
shall operate wder his or her direct mpervision.
10. Vothing contained herein is imended to alter or abridge the employment
relationship between the Cowty and its employees. Any disciplinary aztions
sivg out of the temporary work assigmvevt of the Cowty's officers will remaiv
the mspovsibility of the County. At any rime, the Uviversfry's officers iv charge of
the divisiov to which wy Cawty oRtcer is assigned may relieve such Couvty
officer of Ns or her duties being provided wderthis <onhact and such University
officer shall immediately forward a written statement seeing forth the reason for
moh azfiov to the Cowty's officer in nhazge of the divisiov to which that Couvty
officer is permwendy assigned.

12. All Cowry law enforcement of<cers providing the law enforcement services to
the University shall be subjectto the Cowty's medical and hospitaliution
insurance, or Workers' Compensation coverage.
t3. The pacdes may agree to law enforcemwt services EJt additional aWatio or
special events in accordance with Ne terms of this conract.
14. the contract will be reviewed amrually no later than July 1, and nay be
wed, modified, or amended at manime, oc at any other time, upon the mmual
written agreement of the parries.
I5. This contract may be terminated at any time by either patty by giving 90 days
notice to the other party iv writing.
16. If either party defaWts in iss obligations and does not cure such defauh within
ten QOJ days of receipt of voGce of such default the non-de6vleng party may
immediaely termimte Ne contract.
^. No transfer or assumption of additional liability for the acts of any law
enforcement officer is intended by the parties to tris contat.
