BACKGROUND: In 6eptmibar 1993, the Hoard approval a agreement xith
the university whereby Ue Sheriff's Department Dzovidae sworn law
enforcement offlcere for curity and law anforemant coverage at
special events each as football and tsbtball games and concert at
the Smith Cenbr. The Uniwcaity caimbureee tM County fully foc
salary and benefit payments aM for the coat of any County equipment
used in providing the service. The agreement is psoposed to continue

(tha "Univesity") and she County of Orange (dse "Cowry") forjoim and cooperative
angements for security and the provssmn of law enforcement perso~mel at certain major
University evems.
W ITNESSETH
WHEREAS, the County and the University ltave historically cooperazed and worked
jointly on imnmerable manor of canteen or mterert; and
WHEREAS, Ilse Couvry and [he Usdversiry have entered into a Mutual Assissance
Agreement dated April 2, 199}, and
WHEREAS, cermin Univmity sporting events, such es the University's home football
and basketball games, asd oNer events at We Snsdens Activities Center, such as
ovicerts, bring fans and alumni to Chapel Hill and Orange County to enjoy the
campus and visit Chapel Hill and Orange Cowry; and
WHEREAS, Ne provision of adega&e xcsuity, trafF<dvection, and law errfomemem
personnel at such home football and basketball games or other special events is a
nmtter of mutual concern and interest so the University and slx Cowry; and
WHEREAS, detailedjoiv[ and coopemtrve atmvgemrnts wiN respect m such home
football and basketball games and special events will mutually benefit the
University and dx Cowry; and

Aasistwce Agreemrnr,
NOW THEREFORE, w costsidemsian ofthe pxmius and Ne mutual wvewnts and
conditions set foM below, the County arW Ne University ogre as follows:
1. The Cowry agree so provide up ro fifteen (157 swam law enforcemem officers
for each 1998 University home football game.
2. The County agrees to provide up ro fheen (l5) swom law errfomemem oRcers
for eazh 1998-1999 University home men's vazsity basketball game.
1. The Cowry agrees to provide, if requested, up to ffteen (IS) swom law
eNOrcemem officers for each 1998-1999 Uvivcsity special even at the Student
Activities Centeq such as concerts.
a. The Cowry agrees to keep records of Ne services vrovided to dae Uniuxrsi[u'
under this contra[ and ro provide such records to [he G~dversiry upon request.
5. The fallowing services shall be provided by the Cowty's law enforcemem
officers: vaffic dimniom security, emergency medical assisrance, crowd cnnvcl,
patrol and surveillmce and othn law enforcemem duties requested by the
University and relamd N<mto ("dse law ek'orcemrn[ services"). The law
erd'orcemem services herewder shall also include protective patrol of dae event
site and dnigwmd adjacent properties prior to, during and for a reasonable time
after the end of Ne event
6. The Uriversity will provide trarispodation on campus and commwications
equipmem to Ne Ccunry's law enorcement officers while they arc azsigned m
convaaed defies for Ue Uriversiry. The Cowry shell provide all oNer equipment
necessary to perfonv the law enforcemem urvices. The UNversiry shall pay the
cosu oftravspoiudon and commurications equipmem which it provides for Ne
Cowry's law eN'orccment officm. The Ccunry shell pay the cluipmem costs of
all older nnnsary cluipment and the U~iveniry shall rewburse the County for
the case N the emawt included for that purpose m the sratemmt to the
Uivesity from die County described m paragraph oven ofdds Conva<t.
]. The University shall compensate We Cowty for the law e~d'orcemevt service
provided pursuant td this convect by paying m the County w amount equal m one
and one halftime the salary of each otficn provided m the University, including
supervisory persomel, P(e associated employer Payments m FICA and
retirement acwwts for said employees. Payment shall be made witbin ddrty (30)
days of reeipt of a smtemmt Gom the Cowry following each event for which
ervice ere provided. The nmemevt shell be xnt to: Chief of Police, University
Police, Security Services Building, Campus Box 1600, University of North
Carvliva at Chapel Hill, Chapel Hill, NC 2]599-1600. Payment shall be made m
Ne order of the Coutny end delivered to the Couutys Fimvice Officer, 20g South
Cameron Street, Hillsborough, NC 2]2]g.

responsive m all reaxvable University needs and requests relating m the law

9. While perfbrming law enforcement urvices for Ne University, the Cowty's
law enfomemrn[ officers shall be subject to We lawful opemtiorui commends of
the oRcer in charge of the division to which dray are temporarily assigned and
shall opemm under his Or her dIR[t supervision.
10. Nothing comained heroin is intended to alter or abridge Ne employmem
relationship between the Cowry and its employees. Any disciplinary actions
arising out of Ne mmporary work assignment of the Cowry's ot7icers will remain
the responsibility of the Comty. At my time, the UWversiry's officers in chage of
the division to which any Cowry officer is azsigned may relieve such Cowry
officer ofhis or her dudes being provided under this contract and such UWVersiry
officer shall immNiately forward a wnaen smmment senmg forth Ne reason For
uch action m Ne County's officer N charge of Ne division to which that County
officer is pem~anevtly assigned.
11. The officers providing the law enforcement services shall report to Kesan
Smdium, Student Activities Center, or Neu odser work stetio~, at least two hours
before the official starting time for Ne game or other special event for bdefng by
Ne UWversity. The oRcers shall not be released fiom Nev respective
assigrwents until dismissed by the Univeniry's Chief of Police or his/her
desigvm.
12. All Couvry law enforcementortcers providing the law enorcement servicesm
N<UWVersity shall be subject to the County's medical and hospimlieadon
u¢mancq or Workers Comprnsation coverage.
13. The parties may ogee m law enforcement services for addinotW aWedc or
special evevb N accordance wiN the temu of Nis contract.
10. The mntmct will be reviewed amtuWly no lazer than 1Wy 1, and may be
rcnewe4 modified, or amended at that time, ar at my oNer time, upon the mutual
written ageemmt of the paries.
I5. This connect may be tertWvazed at any time by either party by giving 90 days
notice to the oNer party in writing.
I6. If eiNm party defaWU in iu obligations and does not cure such default within
ten (10J days of receipt ofnodce of such defaWq Ne non-defaulting parry may
immediazely terminate the contract.
U. No traasfer or assumption ofadN[ionW liabiliry for Ne acts ofany law
