BACKGROUND: On September 30, 1998, the Board of County Commissioners adopted an amendment to the Joint Planning Agreement that establishes a mechanism for declaring development moratoria in the various portions of the Joint Planning Area, i.e., Carrboro and Chapel Hill Transition Areas and the Rural Buffer. In accordance with the provisions of the amended agreement, the Town of Carrboro is requesting a three (3) month moratorium for the Carrboro Northern Transition Study Area. The purpose of the moratorium is to allow time to complete ordinance language for implementation of the Facilitated Small Area Plan. When the Planning Board considered the draft plan on July 15, 1998, it withheld a recommendation on it pending review of the implementing ordinance language. The moratorium is designed to allow time to complete the ordinance language. The Carrboro Board of Aldermen will hold a public hearing on the moratorium on October 6, 1998. Following a decision at the conclusion of the hearing, an emissary will be dispatched to the County Commissioners' meeting to relay the results. RECOMMENDATION: The Administration recommends approval of the moratorium if it is adopted by the Town of Carrboro. 3 i Chapel Iii ll. Any proposed moratorium shall not be effective until adopted by Orange County following a public hearing conducted by Orange County. Any such adopted moratorium shall initially be no more than six months in duration and may be extended one time for no more than six months for the reasons and following thQ procedures prescribed here. McGuire, Land Use Planner DATE: September 30, 1998 SUBJECT: Carrboro Land Use Ordinance Text Amendment 1 PAGE DELIVERED VIA FAX TO 644-3002 This memorandum is a revised version of one submitted to you on September 9, 1998. The memo has been revised to reflect the Board of County Commissioners final action on JPA 1-98, "Temporary Development Moratoria," which is expected to occur at a special meeting this evening. As noted in the September 9 memo, an amendment to the Town's Land Use Ordinance was proposed during the Board of Aldermen's regular weekly meeting on September 8. The amendment is described below: Extension of development moratorium for Northern Study Area. This amendment would extend the moratorium currently in place on the processing of special and conditional use permit applications for developments on properties located within the Northern Study Area. Members of the Board requested that two options for extending the moratorium be prepared. One option would extend the moratorium for two months and the other for three months. The moratorium was originally adopted for the period November 11, 1997 to May 11, 1998 on November 12, 1998 by vote of the Board of Aldermen. The vote on the issue was four affirmatives and two negatives. Aldermen Shelley and Caldwell cast the negative votes. The ordinance was extended for the period May 12, 1998 to September 30, 1998 on May 12, 1998 by a vote of six affirmatives and one negative. Aldermen Caldwell cast the dissenting vote. As the full text of the proposed amendment was forwarded to you on September 9, 27 days prior to the public hearing date of October 6, 1998, it was requested that the amendment receive an expedited review as allowed in Section 2.6, Subsection C. Please review the proposed ordinance in accordance with Section 2.3, Subsection C, which is to be amended by final vote of the Orange County Board of County Commissioners this evening. As discussed, a procedure to convey formal notice of the outcome of the public hearing on October 6 in time for the Board of County Commissioners to consider the moratorium at their meeting that evening will be developed in the next few days.
