BACKGROUND: Orange County Speedway has requested that the Board of Commissioners approve a pyrotechnics permit for the fireworks display which is scheduled for July 3, 2010 in conjunction with the regularly scheduled race. North Carolina General Statute (NCGS) 14 -414 states that the Board shall consider a fireworks permit for "any and all kinds of fireworks and explosives, which are used for exhibitions or amusement purposes." NCGS 14 -413 empowers the Board to authorize and issue permits for the use of pyrotechnics in connection with "...shows of all descriptions ... but only after satisfactory evidence is produced to the effect that said pyrotechnics will be used for the aforementioned purposes and none other." County policy further requires assurance from the sponsoring agency that adequate public safety measures will be exercised; and that the County will be protected as an additional insured on the insurance policy(ies) covering the event. The documents attached indicate satisfactory evidence that these requirements have been met. The issuance of the permit is conditioned upon safe burning conditions being present on the day of the fireworks presentation. FINANCIAL IMPACT: There is no financial impact as a result of this action. RECOMMENDATION(S): The Manager recommends that the Board approve a pyrotechnics permit for the Orange County Speedway for July 3, 2010, pending verification of valid and current insurance coverage, and authorize staff to execute permits as needed. F PYROTECHNICS PERMIT CHECKLIST North Carolina General Statue 14-413 empowers County Commissioners in the State to issue permits for the use of pyrotechnics in connection with shows of all descriptions after satisfactory evidence is produced to the effect that the pyrotechnics will be used for the aforementioned purposes and no others. The Orange County Commissioners have adopted a policy which cites the completion of the following criteria as prerequisite to the issuance of a pyrotechnics permit. Verification of the receipt of information will be evidenced by the signature of the appropriate official on this form. Only after all criteria listed below have been met will the permit be issued. It should be further noted that all signatures must be written on the face of the permit in order for the permit to be valid. Penalties for use of pyrotechnics without a permit are cited in the North Carolina Building Code, Administration and Enforcement, Volume 1A, Chapter 8.1. CRITERIA APPROVED BY DATE 1. LETTER OF REQUEST RECEIVED FROM SPONSORING AGENCY 2. LETTER RECEIVED FROM FIRE DEPARTMENT INDICATING SUFFICIENT MEASURES WILL BE TAKEN TO ENSURE THE SAFETY OF THOSE IN ATTENDANCE. 3. LETTER RECEIVED FROM LAW ENFORCEMENT INDICATING SUFFICIENT MEASURES WILL BE TAKEN TO ENSURE THE SAFETY OF THOSE IN ATTENDANCE. 4. QUALIFICATIONSILICENSE SUBMITTED FOR PYROTECHNIC OPERATOR 5. SITE LAYOUT SUBMITTED BY THE PYROTECHNIC OPERATOR. 6. INVENTORY OF PYROTECHNICS TO BE USED SUBMITTED 7. CERTIFICATE OF INSURANCE FOR GENERAL LIABILITY COVERAGE RECEIVED; MUST INCLUDE COUNTY AS A NAMED INSURED ON THE FACE OF THE CERTIFICATE; MINIMUM LIMIT $1,000,000 PER PERSONIPER OCCURRENCE. 8. LOCATION OF PYROTECHNIC DISPLAY HAS CURRENT FIRE INSPECTION AND IS IN COMPLIANCE WITH THE NORTH CAROLINA FIRE PREVENTION CODE, 2000 INTERNATIONAL FIRE CODE WITH NORTH CAROLINA AMENDMENTS. 9. SHOW SET UP HAS BEEN APPROVED BY THE FIRE OFFICIAL IN APPROPRIATE JURISDICTION PRIOR TO THE BEGINNING OF SHOW. CERTIFICATION RESPONSIBILITIES: ITEMS 1 -7: ORANGE COUNTY DIRECTOR OF PURCHASING AND CENTRAL SERVICES or ORANGE COUNTY DIECTOR OF EMERGENCY MANAGEMENT OR DESIGNATE. ITEM 8: JURISDICTION'S FIRE OFFICIAL ITEM 9: ORANGE COUNTY DIRECTOR OF EMERGENCY MANAGEMENT OR DESIGNATE— NOTE: THIS SIGNATURE CERTIFIES THAT THE FIRE OFFICIAL IN THE APPROPRIATE JURISDICTION HAS MADE THE SET UP INSPECTION. IT IS NOT INTENDED TO INDICATE THAT THE COUNTY S EMERGENCY MANAGEMENT DIRECTOR MUST INSPECT AND APPROVE SET UP PERSONALLY. FOLLOWING CERTIFICATION OF ITEM 9, PLEASE RETURN THIS FORM TO THE PURCHASING AND CENTRAL SERVICES DIRECTOR. 1.1 FWPherCia 3 PYROTECHNICS PERMIT ORIGINAL SIGNATURES ORANGE COUNTY, NORTH CAROLINA Pursuant to G.S. 14 -413, Commissioners in North Carolina Counties are empowered to authorize and issue permits for the use of pyrotechnics in connection with "...shows of all descriptions... but only after satisfactory evidence is produced to the effect that said pyrotechnics will be used for the aforementioned purposes and none other ". On June 15, 2010, Orange County Speedway, Rougemont, NC was approved for a pyrotechnic permit to be used in association with races on July 3, 2010 at the Orange County Speedway. The approval is granted based on the following assurances from the requestor: Public Safety personnel will be on site during the event to ensure public safety and to provide adequate traffic control; Proof of Liability Insurance which includes the County as a named insured, has been submitted to the Orange County Department of Asset Management and Purchasing Services Director. Limits of general liability are no less than $1,000,000 per occurrence; Show setup will be approved by the Orange County Fire Marshal or designee, prior to the beginning of show. Permitted explosives include those identified in the information submitted by the requestor and approved by the Fire Marshal as part of the pyrotechnics approval process. Note: FIRE OFFICIAL SHALL NOT EXECUTE THIS PERMIT IN THE EVENT ENVIRONMENTAL CONDITIONS AT TIME OF PERFORMANCE PRESENT A HAZARD FO EITHE BURNIGN OR AIR QUALITY (CODE RED). Compliance with requirements of the 2010 North Carolina Pyrotechnics Act; Orange County Speedway has a current fire inspection and is in compliance with the North Carolina Fire Prevention Code, 2009 International Fire Code with North Carolina Amendments. Department of Asset Management and Purchasing Services Director signs after certification that checklist has been met. 2. Orange County Manager signs. 3. Fire Official signs, upon approval of the site set up prior to the event. 4. Emergency Services Director signs after assurance from Fire Official that requirements of the Standard Fire Prevention Code as it respects the use of pyrotechnics has been met. 5. Emergency Services Director provides one original of permit to show sponsor and returns one original to the Department of Asset Management and Purchasing Services Director for records maintenance.
