ORANGE COUNTY BOARA OF COMN:ISSIONES
August 16, 1983
The Orange County Board of Commissioners met in regular session on Tuesday,
August 16, 1983 at 7:30 P.M. in the Courtroom of the Old Post Office Building,
Chapel Hi11, North Carolina.
Commissioners Present: Richard E. Y7hitted, Chair, and Commissioners Ben
Lloyd, Shirley E. Marshall, Norman Walker, and Don Willhoit.

Commissioner 4Thitted moved Items 9 and 11 after Ttem C-2, and added a
report on the Water and Sewer Agreement.
Commissioner Marshall removed from the agenda the appointments to the Child
Care Task Force (part of Item D-3).

Commissioner 4dhitted noted that the Board of Commissioners had established
$50,000 in the capital reserve fund, pending a more concise understanding for
location of the building requested by Orange Industries.
Martin Freed stated he was waiting for a 'response to a community
development fund application submitted through the Town of Carrboro, and that
Orange Tndustries has been working with the OPC Mental Health Board, which is
examining the plans and budgets for approval of the transition from the public
to the private domain. Representatives of Orange Tndustries requested from
Vocational Rehabilitation and received a 6 month extension on the S50,D00 grant
to raise matching funds.
Commissioner Lloyd noted that he has found three locations in the Central
part of the county for consideration.

Virginia Tveisz highlighted the stabilization o£ membership: ten (10) new
members were acquired in the 1982-83 year and five of .the seven townships in
Orange County are presently represented. The Employment Committee held a
workshop in the winter, with 43 women in attendance; four women attending
.. .. were accepted into training programs, and two found jobs by referrals from
Commission members; a microfiche for jab listings is now available in the
- Hillabarough library.
The Continuing Education Committee held an information luncheon for
community leaders in the spring with approximately 65 attendees and sent
letters to approximately 200 high school dropouts informing them of the
referral information available. The Affirmative Action Committee presented a
Report to the Carrboro Board of Aldermen asking for an Affirmative Action Plan
for the Town as well as presenting the analysis of the Orange County
Affirmative Action Plan with the report to the .Board.

Beverly Whitehead were present. Orange County has attempted to assure that all
personnel actions are taken without regard to race, sex, age and other factors;
policies are based on the principle of merit.
In aonjunetion with the Commission far Women, Mr. Thompson recommended the
• endorsement of seven areas of improvement. These include: (1) the development
of department goals; (2) provision of training to department heads and
supervisors; (3) evaluation of achievement as a part of overall job
performance; (4) improvement in the selection process; (5) establishment of an
active file of available minority and female applications for selection
referral; (6) implementation of routine recording procedures and inclusion of
an annual report to the Board for public record and (7) publishment of the
report to be made available to the public. At this time there is no recom
mendation to add additional personnel ar to establish a separate Affirmative
Action Officer position in the Personnel Department.
Judy McNeil, Chair of the Affirmative Action Committee of the Commission
for Women stated that the Commission supports the recommendations of the
' Manager; that she would like to see a focus taken by the Commissioners as well
as the Personnel Department that the goals reflect not only the hiring
practices, but other areas of personnel, such as recruitment, compensation,
benefits, in-service training, promotions, and terminations. There is a need
for timetables because they are an important part of an Affirmative Action
Plan.
Ms. Beverly Whitehead, Director of Personnel, noted that the proposal
before the Board was for an endorsement allowing the establishment of
departmental goals.
Commissioner Whitted noted the need for additional information and the need
to have this item scheduled again for the next meeting. He thanked the
Personnel Department and the Commission for Women far the report.

Commissioner Willhoit moved, seconded by Commissioner Marshall to adopt the
resolution submitted by the Commission for Women. VOTE: Ayes, 5; Noes, 0.
Commissioner YThitted noted this item was not yet ready for discussion, the
Water Resources Tasl; Committee of the Council of Government was meeting the
following evening, and with the Board's approval will draft a statement to be
submitted to Secretary Grimsley after that meeting.
Commissioner whitted made an effort to accommodate the people in the
audience wishing to speak to particular items, by rearranging the items on the
agenda.

Attorney Geoffrey Gledhill made note of the revisions to be applied to the
Animal Control Ordinance: (1) the County Ordinance will only affect
unincorporated areas in the County; and (2) the State law affects all areas of
Orange County. The Ordinance contains issues concerning nuisance problems,
impoundments, prowlers at night in the County and provides for the appointment
of an animal cruelty investigator, penalties, and delegates animal control
responsibility generally and primarily to the Health Department.
After some discussion pertaining to definitions of public nuisances,
vicious animals, and use of the word "repeatedly," Commissioner Willhoit
proposed that suggestions for changes be made at this time and that the
Ordinance be retyped and made available to the public for comment on the first

and third Tuesdays in September, and scheduled for adoption at the third
Tuesday meeting in September.
Dr. Robert Greenberg noted that the Animal Protection Satiety strongly
supports the Ordinance; that the first step necessary for a successful animal
control program is a comprehensive strict Animal Control Ordinance with a
citation provision as a civil penalty for violation. He made a strong appeal
to include civil penalties in the Ordinance.
Dr. Vanstee, (Veterinarian) and Peter Burger (resident) both spoke in favor
of the Ordinance.

Ms. Jane Cousins, member of the Board of the Community Services Restitution
Program made a 51,000 matching request for the program started initially as a
six month pilot project of the Chapel Hi11 Police Social Unit to respond to
requests from District Attorneys and Judges lacking for alternatives to fines
and sentences.
The program has received a S38,D00 grant from the State Department of Crime
Control Public Safety which requires raising 10~ local matching funds.
Safe Roads Act (effective October 1, 1983), will require people convicted
of driving while intoxicated to do community service work, and the Community
Penalties Act provides alternatives for non-violent defendants who would
otherwise be sent to prison.
Commissioner Vlillhoit moved, seconded by Commissioner Diarshall to take
51000 from the contingency fund for the Community Services Restitution Program.
VOTE: Ayes, 5; Noes, 0.

Commissioner Willhait moved, seconded by Commissioner 4Talker to adopt the
amendments to the Raise Control Ordinance. VOTE: Ayes, 5; Noes, 0.
Sheriff Lindy Pendergrass noted that he would like to see a pravision.in
the Ordinance for habitual violators.
Commissioner ~lillhoit requested that the Attorney draft more appropriate
language for Article v2(C) pertaining to previous violations, and bring it back
to the Board for consideration.

Yen Thompson, County Manager, clarified the use of Clean ]~Tater Bond money
for the sewer project: the state is providing a grant for 542,700, and is
willing to increase the amount of this grant based on the size of the project;
there must be a federal grant before the state will allocate any monies.
He then introduced r]r. Thurman Murphy of the Farmers Home Administration
who explained that the County submitted a preapplication to the Administration
for financial assistance for Efland Estates to install a package treatment
plant. Farmers' Home informed the County that they were eligible for
approximately S38,p00. The County will allocate approximately 535,OD0 and
- Farmers' Home will make a loan or a grant of approximately 585,000. The
regulations currently state that the loan has to be an amount creating a debt
service of at least 1~ o~ the median income of Efland Estates which is 510,30p,
or 5103 per year. The loan will have to yield a debt service of 52678, and the
County will need to borrow approximately 534,80D.
Commissioner Whitted noted alternatives to this provision of the loan: the
County to issue a general obligation bond which Farmers Home Administration
would buy and the residents served would pay the debt through a user fee; or,
the service district could issue the bond and the Farmers Home Administration
would purchase the bond. The taxes from that service district would serve as

collateral for the bond. tdr. Murphy noted that the mechanism used far
non-profit corporations was considered, but unsuccessful.
Wallace Harding,. Finance Director noted that he had put together an
analysis of the different types of districts: (1) County service district, (2)
a water and sewer district, and (3) a sanitary district.
Commissioner Whitted noted that the required ten-year limitation would
create an added burden to the residents of Efland Estates.
The County Manager stated that if a sewer district was created with the
ability to issue revenue bands using taxes as collateral, that the tax base of
Efland Estates would not be sufficient.
Commissioner Whitted noted the need for more information before
establishing a preliminary plan.
Commissioner Whitted acknowledged a two minute break.

Commissioner Marshall moved, seconded by Commissioner Whitted to accept the
grant. VOTE: Ayes, 4; Noes, 0. (Commissioner Lloyd was not present for the
vote.)

The appointments were deleted.
Commissioner ~villhoit moved, seconded by Commissioner Whitted to accept the
charge with an amendment that the Task Force recommend sources of funding with
justifications for their recommendations. VOTE: Ayes, 5; Noes, 0.
- After discussion concerning nominations for membership to the Task Force,
by consensus, it was agreed that the membership be between 24 and 36; and that
the Hoard would appoint the Chair. Staff assistance from the County will be
provided.

Commissioner Walker moved, seconded by Commissioner Lloyd to approve
negotiation of the contract for data processing services with the Town of
Hillsborough. VIE: Ayes, 5; Noes, 0.

Family Planning Fee Scale for implementation on September 1, 1983. VOTE:

Mr. John McAdams made the presentation. It was the consensus of the Board
to refer the matter of the authorization to enter into an agreement with
Southern Hell to protect underground telephone cable to the County Attorney.

Commissioner Whitted suggested that all members of the Board submit a list
o£ potential candidates to interview sa that contact can be made.

Marvin Collins, Planning Director, presented a chart depicting the progress
of the Cheeks Township land use and the zoning study. (see page of this
book)
As a result of some concerns raised by the Economic Development Commission,
the Planning Staff's focus has been shifted from the industrial and commercial
aspects of the Township to the watershed protection issue. A time schedule°
has been established including the zoning of Cheeks Township.
The reservoir feasibility study is essential because decisions concerning

By the end of the year or the first of the next year, the Planning Staff
will hold a public hearing with a definitive land use plan or zoning plan for
Cheeks, which will reflect much basic information and include findings of the
feasibility study. Questions concerning watershed issues and industrial
development should then be resolvable.
The creation of the Economic Development Commission should help in the
determination of haw Cheeks Township will fit into an industrial development
package. The Planning Board is concerned with the affect I-40 will have on
economic development and other areas in the County which should be earmarked
for industrial development - toa much emphasis might be placed on Cheeks
Township as the sole area far industrial development.
Commissioner ~~?illhoit stated that it is critical to place the extension of
the sewer lines as top priority because the use of that line is critical to the
Efland Estates and the school.
There was Board agreement that the Planning Staff should .gut the Cheeks
Township issue among its top priorities.
with no further business for the Board to consider, the meeting was
adjourned.

RESOLUTION AUTHORIZING THE FILING OF AN APPLICATION FOR MASS TRANSIT
ASSISTANCE GRANTS UNDER SECTION 9A OF THE SURFACE TRANSPORTAION
ASSISTANCE ACT OF 1978.
WHEREAS, the North Carolina Department of~Transportation has
been designated as the Public Body in North Carolina charged with
the allocation and administraion of funds provided under Section 9A
of the Surface Transportation Assistance Act of 1978; and
;dHEREAS, Orange County wishes to apply r"or federal and state
Hass transit assistance for administration and operating projects
under Section 9A of the Act, and would be the Recipient assisted by
these projects; and
WHEREAS, the contracts for financial assistance will impose
certain obligations upon the Recipient, including the provision by
it of.the local share of pro3ect costs; and
WHEREAS, it is required by the United States Department of
Transportation in accord with the provisions of Title VI of the
Civil Rights Act of 1964, that in connection with the filing of
applications far assistance under the Urban Mass Transportation
Act of 1964, as amended,~the Recipient give an asurance that it
wi17 comply with Title VI of the Civil Rights Act of 1964 and the
United States Department of Transportation Requirements thereunder;
and
WHEREAS, it is required by the United States Department of
"transportation tin accordance with the provisions of Section 13(c}
of the Urban Mass Transportation Act of 1964, as amended, that in
connection with the filing of applications for assistance under the
Urban Mass Transportation Act of 1964, as amended, the Recipient
give an assurance that the rights and working conditions of trans-
portation related employees are not adversely .affected by the
assisted projects..
NOW. THEREFORE, BE IT RESOLVED 8Y THE COUNTY COMMISSIONERS OF
ORANGE COUNTY, NORTH CAROLINA:
7. That the. County Manager of Orange County is authorized to
execute and file applications on behalf of Orange County
with the North Carolina Department of Transportation, to
aid in the financing of the transit projects described in
the Section 9A Application;
2. That the County Manager is authorized to execute and file
with such applications an assurance or other document
' required by the United States Department of Transportation
effectuating the purposes of Title VI of the Civil Rights
Act of 1964;
3. That the County Manager is authorized to execute and file
a "Special Section 13(c) Warranty Agreement for Application
to the Small Urban and Rural Program" as required in order
to rsceive federal mass transit assistance;

4. That the County Manager is authorized to set forth and
execute affirmative minority business policies in connection
with the procurement needs of the projects; and
5. that the Caunty Manager is authorized to furnish-such
additional information as the North Carolina Department of
