7* The Orange- County Board of Commissioners met in regular session
8. on Tuesday, April 5, 1983, at 10:00 A.M. in the Commissioners' Room,
9, Orange County Courthouse, Hillsborough, North Carolina.
10. Commissioners present: Richard E. Whitted, Chair, and Commis-
11. sioners Ben Lloyd, Shirley E. Marshall , and Don Willhoit.
12. Commissioners absent: Norman Walker.
13• A. BOARD COMMENTS
14. Commissioner.Marshall added consideration of the meeting of
15, April 25th to the agenda and requested a report from either the
16. Manager or the Planning Department about the status of the airport
17. public hearing.
18. B. AUDIENCE COMMENTS
19. Dr. Vickers Burdette and Mr. Lance Richards wished to address
20. the Board about the Wild Animal Control issue. There were no other
21. comments.
22. C. MINUTES
�3, Commissioner Marshall moved, seconded by Commissioner Willhoit,
24• to approve the Minutes of February 21, 1983, as submitted. Vote:
25. Ayes, 4; noes, 0.
26. Commissioner Willhoit moved, seconded by Commissioner Marshall ,
27, to approve the Minutes of March 15, 1983, as corrected. Vote: Ayes,
28. 4; noes, 0.
29. D. REPORT-- CLEAN UP LITTER CAMPAIGN
30. Mr. Wayne Weston, Recreation Director, reported on plans to
31. observe Clean Up Litter Week in Orange County. He presented
32. a Joint Proclamation from the Towns of Carrboro and Chapel Hill
33.- de.signating. the week of April 17th - 23rd C1_ean Up Litter in Orange
34. County. Commissioner Marshall moved, seconded by Commissioner Lloyd,
35. to adopt the Proclamation establishing April 17-23, 1983, Clean Up
36• Litter Week in Orange County (see page of this book for that Pro
37. clamation) . Vote: Ayes, 4; noes, 0.

21. 3. WILDWOOD SECTION ONE: Mr. Collins provided the details on
22.this proposal to the Board (pages ) . The Board discussed the
�3,recommended conditions suggested by the Planning Board. Mr. John
24-McAdams, engineer for Wildwood, responded to questions posed by the
25,Board regarding the developer's intent. Mr. McAdams said the develop-
26.er would abide by the NC- Department -of Environmental Management
27,requirements for this pump station.
28. Commissioner Lloyd moved, seconded by Commissioner Marshall ,
29,to approve the Preliminary Plan for the Wildwood Subdivision Section
30,One subject to the conditions recommended by. the Planning Board.

32, 4. WILKERSON ACRES Section IV-B: Mr. Collins provided the
33,details on this proposal to the Board (page ) . Mr. Alois Callemyn,
34,surveyor, told the Board that if the road is paved, as recommended by
35,the Planning .Board, the Department of Transportation would not "take it
36.0ver" after paving as the road would not meet minimum requirements of
37,its Secondary Road System program. Mr. Callemyn continued that Mr.

4• Wilkerson would be able to maintain an unpaved road (i .e. gravel )
5• but it would be prohibitively expensive for him to maintain a paved
6. road given the nature of the traffic on it (i .e. heavy equipment) .
7. Mr. Collins, said the Planning Board's concern was more of
8. a long-term nature; that Mr. Wilkerson would not "be around for--.
9. ever" or might, not retain title to the properties and the main-
10. tenance question would return.
11. Commissioner Wi?lhoit moved, seconded by Commissioner Marshall ,
12, to approve the Preliminary .Plan -for Section 1V-B Wilkerson Acres with
13. a Class A Private Road. Vote: Ayes, 4; noes, 0.
14. 5. GREENWOOD: Mr. Collins provided the details on the Green
15. wood subdivision to the Board (page ) . Mr. John McAdams, repre-
16. senting the developer, disagreed with the condition that a "stubout"
17. be provided. He said the developer is not responsible for the land-
18. locked property, containing 127 acres, behind this site; and that,
19. furthe.r, it is highly unlikely that connection will ever be made bet-
20. ween the two tracts of land. He said this subdivision is for those
21. who wish to "get away" and therefore a thru street is not desirable.
22. Mr. Gledhill , County Attorney, provided information regarding
23. the General Statutes and rights-of-way. He said such a right-of-way
24.would exist whether the "stubout" was shown or not.should the County
25.decide to extend the existing road .and the property owners would, in
26.effect, agree in advance to such an arrangement.
27. Commissioner Marshall moved, seconded by Commissioner Lloyd ,
28.to approve the Preliminary Plan for Greenwood subdivision with the
29.drainage easements being placed along streams and drainage ways as
30.determined by the Erosion Control Officer and as recommended by the
31-Planning Board but without the "stubout. ". .Vote: Ayes, 4; noes, 0.
32. 6. ADOLESCENT DAY TREATMENT CENTER--CHANGE ORDERS

35.Board. Commissioner Whitted moved, seconded by Commissioner Willhoit,
36.to approve the change orders (see pages of this book) . Vote

40 7. WILD ANIMALS--SECOND READING OF ORDINANCE
5, The Board members suggested amendments to the ordi,
6, rewritten pursuant to their motion on March 28, 1983.
7, Drs. Vickers Burdette and Paul Modrich protested the lump,.._
g, of servals in the same category as large cats (i .e. tigers, etc. ) .
9, 17hey explained that their serval was not a dangerous cat and servals
l0. in general were not known for digging. Drs. Burdette and Modrich said
ll,that they would not be able to keep their cat if the 1OO1 setback
12,was required. Board members said. that was not the intent of the ordinance.
13, Various members of the audience addressed the Board regarding
3.4,their individual concerns over the ordinancelcaging requirements/
15,fees. These included but are not limited to: Mr. Lance Richardson,
16.Dr. Mike Bleyman, Mr. Tim Greene, representative of the APS and other
�7,unidentified persons.
18. Board members told the audience that they, the Board of Com-
19,missioners, were petitioned by Orange County citizens who were concerned
20.about their safety and the safety of their families. This Ordinance
21,is a response to those concerns; it is a compromise that enables those
22,who owned animals and had registered those animals as of March 28, 1983,
�3,to keep those animals. It also tries, through the caging requirements,
24,to address the safety issue raised by the original petitioners. The
�5,ordinance tries also to address the issue of the humane treatment
26.and safety of the animals being kept.
27, In response to a question - raised by Ms. Lorie Stephenson,
2$,Mr. Gledhill said a permit can be issued only for those animals
29,physically in Orange County; no permit can be issued for an animal
30,not in Orange County.
31, Mr. Greene opposed the inspection fees as proposed; he also
32,opposed the breeding ban, saying that he had hoped to "recoup" his
33.expenses through breeding the animals for alternative markets (other
34,than zoos) . The APS representative produced a letter from the American
35 Association of Zoological Parks and Aquariums which said the numbers
36 of lions and tigers were sufficiently large in zoos so that private
37 breeding to maintain the species was "folly. " The APS representative

said the "alternative" market Mr. Greene was referring to was those
5. who wished to have such animals as pets which the APS "condemns. "
6. Commissioner Marshall moved, seconded by Commissioner Willhoit,
7. to approve the Wild Animals Ordtnance on its second reading as
a. amended this morning (this includes the fee schedule on its first
9,, reading as amended this morning) . Vote: Ayes, 3 (Commissioners
10. Marshall , Whitted and Willhoit) ; noes , 1 (Commissioner Lloyd) .
11. This ordinance ?s effective as of this date; the fee schedule
12. will be returned for its second .reading and will be effective on that
13. date if adopted. .
14. Following a short break the Board resumed deliberations with
15. all members present as indicated at the beginning of these minutes.
16. Commissioner Whitted announced that the executive session
17. scheduled for 1:30 P.M. had been cancelled and was rescheduled for
1$, 12:00 noon on Friday, April 8, 1983.
19. 10. BUDGET AMENDMENTS
200 Commissioner Willhoit moved, seconded by Commissioner Marshall ,
21. to approve the budget amendments as recommended by the Manager (see
22. pages of this book) . Vote: Ayes, 4; noes, 0.
23. 11. HOUSING REHAB CONTRACTS
24. Commissioner Whitted moved, seconded by Commissioner Willhoit,
25,to approve the awarding of Housdig . rehab contracts to:
26. Taylor Home Improvement for Units # 49 . ($5,625) , 76 ($12,994)
27.and 82 ($7,299);
28. Eugene H. Morrow for Units # 85 ($6,900) and 97 ($18,000) ;
29. Gates Construction for Unit # 56 ($5,000) . .
30. Vote: Ayes, 4; noes, 0.
31. 12. HB 426
32. Commissioner Whitted noted that the Board had already voted to
33, support SB 51, which removes the tax on food. Commissioner Marshall moved ,
3L„tseconded by Commissioner Willhoit,that this Board will support HB 426
31 if it is amended to remove the food tax too. Vote: Ayes , 3 (Commis-
36 stoners Marshall , Whitted and Willhoit) ; noes, 1 (Commissioner Lloyd) .
37. APRIL MEETING SCHEDULE
38e Commissioner Marshall said that Planned Parenthood had scheduled
39 a meeting for that same evening which she wished to attend.

4. to cancel the April 25th meeting of the Board of Commissioners. Vote:
