Harvey, Planner Craig Benedict, Director Phone Number 245-2597 245-2575 Letter PURPOSE: To hold a public hearing on a petition submitted by Mr. Vernon Davis to rezone a portion of his two (2) acre parcel of property located at 3300 NC 54 West (TMBL 6.30B..8 /PIN 9749-50-0366). BACKGROUND: According to the application the subject properly is 2.04 acres in area, with approximately 1.36 acres of the properly zoned Rural Residential One (R-1) and the remaining portion zoned Neighborhood Commercial Two (NC-2) (Please refer to Attachment One -Exhibit Two for legal descriptions of the existing properly and the area currently zoned R-1 proposed for rezoning to NC-2). There is an existing structure on the commercially zoned portion of property that is used to support an existing general retail operation. The septic system, and required repair area, supporting the existing commercial operation is located on the portion of property that is currently zoned R-1. Mr. Davis is concerned about his continued ability to have a septic system supporting his commercial operation located on the residentially zoned portion of property and is seeking to rectify the problem. PETITION REQUEST: Mr. Davis is requesting the rezoning of a portion of his two (2) acre parcel located at 3300 NC 54 West From: Rural Residential One (R-1) (1.36 acres in area) To:Neighborhood Commercial Two (NC-2) (Rezoning the 1.36 acres zoned R-1 to NC-2) EXISTING LAND USES: The property subject to the rezoning petition is currently utilized to support a general retail operation. 2 SURROUNDING LAND USES: NORTH: Across NC Highway 54 there are several properties zoned Local Commercial One (LC-1) and NC-2. SOUTH: Property to the south is zoned R-1 and is primarily used to support single-family residential land uses. EAST: Property to the east is zoned R-1 and is primarily used to support single-family residential land uses. WEST; Property to the west is zoned R-1 and NC-2. REASON FOR ZONING ATLAS AMENDMENT: As previously indicated, the septic system supporting the existing commercial land use is located on the residentially zoned portion of the subject property. Within his application, Mr. Davis indicates he is concerned about his continued ability to have the septic system supporting the existing commercial operation on the residentially zoned portion of the subject property. The applicant would like to rezone the residential portion of the subject property so the entire property is commercially zoned. ZONING OFFICER ANALYSIS: As required under Section 20.3.3 of the Orange County Zoning Ordinance, the Zoning Officer is required to: `cause an analysis to be made of the application and, based upon that analysis, prepare a recommendation for consideration by the Planning Board and the Board of County Commissioners'. In analyzing this request, the Zoning Officer offers the following information: 1. The application has been deemed complete in accordance with the requirements of Article Twenty (20) of the Zoning Ordinance. 2. The properties in question are located within the White Cross Rural Community Activity Node as denoted on the Orange County Comprehensive Plan Land Use Element Map. 3. According to the Comprehensive Plan Rural Community Activity Nodes are areas of the County intended to serve the needs of the surrounding rural community, where numerous land uses have been deemed appropriate for development including: churches, fire stations, small post offices, schools, other similar institutional uses and one or more commercial uses. 4. According to the application, the property owner is seeking to rezone the residentially zoned portion of property to NC-2. The Comprehensive Plan indicates that either LC-1 or NC-2 zoned property is permitted within a Rural Community Activity Node subject to the requirements of the Zoning Ordinance. 5. According to Section 4.2.9 of the Orange County Zoning Ordinance, the maximum amount of land zoned NC-2 permissible within a Rural Community Activity Node is ten (10) acres. It should be noted that according to Section 4.2.8 of the Ordinance, the maximum amount of land zoned LC-1 permissible within the Rural Community Activity node is also ten (10) acres. 6. In completing an assessment of the existing non-residentially zoned property within the White Cross Rural Community Activity Node, the Zoning Officer has determined: 3 a. There is approximately four point two (4.2) acres of existing property zoned Local Commercial One (LC-1) within the Node, and b. There is approximately five point five (5.5) acres of existing property zoned Neighborhood Commercial Two (NC-2) within the Node. 7. The Zoning Officer agrees that the request is an acreage expansion of an existing non- residential land use and is reasonable given the issues relating to the location of the septic system and further finds that the request is consistent with the requirements of the Ordinance. STAGE RECOMMENDATION: Staff recommends the Board approve this request based on the following: A. Recent amendments to Article Four (4), specifically Sections 4.2.8 and 4.2.9, of the Ordinance have increased the total cumulative amount of allowable non-residential zoned property within a Rural Community Activity Node to ten (10) acres of LC-1 and ten (10) acres of NC-2. B. As previously indicated there is already four point two (4.2) acres of existing property zoned Local Commercial One (LC-1) and five point five (5.5) acres of existing property zoned Neighborhood Commercial Two (NC-2) within the White Cross Rural Community Activity Node, and C. In approving this petition, there will be six point eighty-six (6.86) acres of NC-2 zoned property within the Node leaving a balance of three point fourteen (3.14) acres of allowable NC-2 zoned property. FINANCIAL IMPACT: This request has been reviewed by various County departments who have determined the approval of the request will not create the need for additional funding for the provision of County services. NOTIFICATION PROCEDURAL REQUIREMENTS: In accordance with Article Twenty (20) of the Zoning Ordinance, the Zoning Officer hereby certifies: 1. Staff caused a notice of the public hearing, indicating that this rezoning petition would be reviewed by the Board of County Commissioners, to be published in accordance with the requirements of the Ordinance, 2. Staff notified all adjacent property owners, within five hundred (500) feet of the subject property, of the submittal of the rezoning petition and informed them of the date and time of the public hearing via certified mail, 3. Staff posted a sign on the subject property providing notice of the public hearing. Attachment Three (3) of this abstract contains: 1. A copy of the Certification of Mailing. 2. A copy of the letter mailed to adjacent property owners informing them of the public hearing, and 3. This area of the County is notorious for poor soils with respect to the absorption of wastewater Into septic fields. Septic systems were located where the most appropriate soils were located on a given parcel of property regardless of the zoning designation. This opinion has changed over thne and staff no lorigex allows for the non-residential use of residentially zoned property, including the location and operation of septic systems and repair areas. With.thesa feats in mind, the applicant desires re-zoning the remaining 1.34 acre portion of the subject property from R-1 to NC-2 so that the existing septic system and repair area are located entirely on a NG2 zoned parcel of property consistent with staff's current interpretation of the Zoning Ordinance. BACKGROUND: At the August 24, 2009 Quarterly Public Hearing, staff was authorized to begin development of a UDO. In the last eight (t3) months, the following tasks have been completed: Internal peer review is on-going on existing sections of the Zoning Ordinance being revised as part of the UDO (i.e. parking, signage, stream buffers, outdoor lighting, Conditional Use), • The Planning Board began reviewing draft sections of the UDO.in February of 2010, • Specific sections of the UDO were forwarded to various advisory boards for review and comment in March of 2010 including, Commission for the Environment, Economic Development Commission, Parks and Recreation, and OUTBoard, • Staff has met with the consultant to review formatting and organizational issues. The consultant has made several recommendations proposing to modify the organizational framework of the UDO, • Additional outreach meetings have been conducted with local groups; most notably the North West Triangle Chapter of the North Carolina Society of Surveyors and Orange County/Hillsborough Chamber of Commerce, to discuss the project. An outreach meeting has tentatively been scheduled for June 2010 with the Home Builders Association. Additional outreach is also scheduled in mid-June. SCHEDULE: Based on the consultant's recommendations, the UDO format is being altered to address organizational and formatting concerns. These changes will modify the draft table of contents originally reviewed and approved by the BOCC in December of 2009. 44 Staff and the consultant have further concluded that additional review time will be necessary to ensure all reviewing entities are able to offer comments on the initial draft of the UDO. With this in mind, the following modifications to the UDO project schedule are proposed: 1. Community Outreach Meetings, originally scheduled for March and April, shall occur in June of 2010 on the revised sections of the UDO already reviewed by staff, the Planning Board, and other County advisory boards, 2. In July of 2010 staff will distribute the initial draft of the UDO to the BOCC and local advisory boards including: a. Planning Board, b. Commission for the Environment, c. Economic Development Commission, and d. OUTBoard. 3. Courtesy review of this initial draft shall occur from July through August of 2010, 4. The final two (2) community outreach meetings on the complete first draft of the UDO will be held in August of 2010, 5. The August 23, 2010 Quarterly Public Hearing shall be utilized as a work session between the BOCC and Planning Board to review, discuss, and provide feedback on the draft UDO distributed in July. Prior to the final draft noted in 6 below and the formal Public Hearing in November, the Planning Board will have concluded their primary input. 6. The consultant will be expected to submit the final UDO public hearing draft, as well as the policy implementation bridge outlining possible future modifications, in October of 2010, 7. The BOCC and Planning Board shall hold a public-hearing to review the UDO on November 22, 2010 with a decision on the final document occurring sometime in February 2011. This timeline wilt allovV the BOCC to set priorities (from Planning Board Comprehensive Plan Strategy Implementation input) for the upcoming year. Please refer to Attachment One (1) for a revised timetable for the project. Staff believes that the modified schedule will address concerns over allowing sufficient time for BOCC and advisory board members to review the draft UDO and allow time-for the incorporation of the consultant's suggested formatting and organizational changes. FINANCIAL IMPACT: The BOCC has provided $32,600 in this year's 2009-2010 budget, Departmental Contract Services Account, to complete this BOCC priority. The costs of consulting services, as outlined in the executed contract, are not to exceed $30,000. The additional $2,600 was budgeted for advertising, copying and printing expenses. RECOMMENDATION: The Manager recommends the Board: 1. Accept the update from staff regarding the UDO, 2. Approve the proposed modifications to the timeline for the project as recommended.
