JANUARY 24, 1983
The Orange County Board of Commissioners met in regular session on Monday,
January 24, 1983, at 7:30 P.M. in the Superior Courtroom, Orange County, Courthouse,
Hillsborough, North Carolina.
Commissioners present: Richard E. Whitted, Chair, and Commissioners Ben Lloyd,
Shirley E. Marshall, Norman Walker, and Don Willhoit.
Commissioner Whitted announced that the Joint Public Hearing scheduled with
the Planning Board would be held at this time; he reviewed procedures for the joint
public hearing.
Planning Board Members present: Logan Irvin, Chair, and Tom Bacon, Alice Gordon,
. Nancy Lazslo, Hazel Lunsford, Sharlene Pilkey, David Shanklin and Carl Walters.
Planning Board Members absent: Sally Boericke, Pat Crawford, John Kizer and
John Wilson.,
D. JOINT PUBLIC HEARING WITH THE PLANNING BOARD
1. Land Use Plan Amendment--James Rae Freeland,
Ms. Susan Smith, Planning Staff, made the presentation to the Boards; she
. said the request is to amend the Land Use Plan from Twenty Year Transition and
. Rural Residential to Ten Year Transition for the 149.3 acre tract located in Hills-
. borough Township at the southwest intersection of I-85 and NC 86. (For specifics
. see abstract page on page y1� of these Minutes.) She concluded, saying that the
. Planning Staff recommended the Land Use Plan be amended as requested.
Planning Board Member Pilkey: Asked if the Town of Hillsborough Planning Board
. had any comments on the proposed amendments.
Commissioner Whitted responded that the Commissioners had received such a letter
. this evening and that the record would reflectgthat the letter was on file. (See
page of these Minutes for that letter.) Ms. Smith said the letter really
. addressed issues raised by the proposed subdivision rather than the proposed Land Use Plan Amendment.
Planning Board Chair Irvin: Asked that those in favor of the proposal speak.
. Mr. James Rae Freeland: Referred to the Planning Staff's recommendation (cited
abs6-a.:t naae) and asked ::,.a Staff meant by "public sewer" or if a
. treatment plant would •rir.iudea in its definition of "public sewer."

Ms. Smith: Replied that this recommendation was really directed at the intended
use of the tract and therefore would be more specifically addressed at the rezoning
request to be heard shortly; however, she said the Staff did mean tapping onto Hills-
borough's sewer system.
Mr. Freeland: Said that he intended to tap onto Hillsborough's system when
the number of customers warranted the expense. Until that time, however, he had
planned on using a package treatment system approved by the NC Department of Natural
Resources. He said he will "meet all State criteria."
Mr. Irvin: • Asked what would be done with the effluent if a package treatment
plant was used.
Mr. Freeland: Responded that there was a creek on the property and using flow
data his consultants would work with the State to design the treatment plant and
best care for the effluent. He said Mr. Bud McCall of McCall Brothers of Charlotte
were the consultants and would be able to answer any questions.
Mr. McCall: Said that any statements at this point would be preliminary.
He continued, that the State "has very strict criteria" in the design and treatment
of any package treatment plant. He said the existing stream would be regulated by
• the State and EPA under their "design criteria" which must be met. He asserted that
• the effluent, under these standards, would be better quality than the quality of
• water in the stream. He said he has not received the specific State requirements
• and would be unable to be more specific than all requirements set by the State
• would be met.
• Commissioner Willhoit: Asked Mr. McCall to define "qual'ity" in his use of the
• term "the quality will be better than what was there before."
• Mr. McCall : That it is capable of sustaining wildlife, fish and acquatic growth;
• that the water in the stream will be equal to or better than the water presently in
• the stream. He said once the plant is installed a certified operator must be hired
• to operate the plant; he added that water samples may be required to be sent in
-weekly or monthly to be sure standards are met. Mr. McCall continued, replying to a
• technical question from Commissioner Willhoit, that the process, "I would think, in
•a case like this...would require what we call extended aeriation, tertiary plant
•following ,it, which is filtration to remove all solids and chlorination and perhaps
*even removal of the chlorine there...."
• Mr. Freeland: Replying to Ms. Pilkey, said this stream fed into Cates Creek.

Commissioner Lloyd asked if this or a similar system was presently working
anywhere in the State. Mr. McCall said there were several.
There were no further comments either for or against the proposed Land Use
Plan Amendment.
D-2 Rezoning Request--James Rae Freeland
Mr. Marvin Collins, Planning Director, made the presentation for the rezoning
request to the Boards. He said the request is for the ten southernmost acres of
' this 149.3 acre tract to be rezoned from Rural Residential (R-1) to Residential-4
(R-4). To obtain this rezoning the Land Use Plan would have to be changed to
Ten Year Transition (simply extending the present Ten Year Transition from 1-85
south to emcompass this area). Mr. Collins listed the criteria to change the,.n,
' designation (see abstract page attached to and part of these minutes on page
of this Book). Mr. Collins said the ten acre rezoning request by itself would
have little impact; however, with the entire development there could be significant
' impact. Mr. Collins listed some concerns of the Planning Staff: 1) ability of the
' existing school system to handle the influx of students; 2) site accessibility
' (turn lanes); and, 3) provision of water and sewer services for the site.
' Ms. Pilkey asked that the letter from the Town of Hillsborough be read into the
record (previously cited); Mr. Irvin complied.
Mr. Freeland asked to respond to the contents of the letter. Mr. Freeland said
he felt that the package treatment plant would be a reasonable alternative to tapping
' onto Hillsborough's sewer lines until the development was large enough to justify
the expense of tap-ons. For the turn lanes, Mr. Freeland said the NC Department of
' Transportation would be making recommendations to facilitate access to the site and
was unable to "make any commitment" without knowing Mr. Mills' (NCOOT) recommendations.
• Mr. Freeland continued saying that he planned to pave the interior streets and provide
' open space for recreation; he had not given any thought, however, to placing utilities
' underground.
• Planning Board Member Lunsford: Asked if the entire area south of the railroad
• track was to be zoned residential .
Mr. Freeland replied that a portion of it was requested for industrial with the
• area north of the rdiiroad rack to be zoned commercial. However, he added that
• he would be willing to have the entire southern portion residential with the area
• north of the railroad track industrial.
Ms. Lunsford expressed concerns regarding traffic safety in the area.

Planning Board Member Shanklin: Said that a layman (referring to the letter
from the Town of Hillsborough Planning Board) had said the package treatment plant
would be insufficient; Mr. Shanklin asked if the expert (consultant from Charlotte)
would clear up the question of its (the package treatment plant) efficiency.
Mr. McCall : Said that since the letter writer was not specific as to the
deficiencies in such a package treatment plant his only comment would be to reiterate
his earlier statement, i.e., those "same State agencies which would regulate dis-
charge from municipalities under the guidelines of the EPA in the Federal Government
as well as the State. The same agencies regulate it all so the effluent or dis-
charged waters from a package plant would be equal to or better quality than anything
that is going into the stream already."
Mr. Shanklin: "So in your opinion, the package treatment 'plant would be sufficient?"
Mr.. McCall: "Yes. It would have to be."
Planning Board Member Gordon: Asked Mr. McCall if he didn't know what the
requirements would be how could he know the package treatment plant could meet them.
Mr. McCall: Said that waste water could be treated to any degree that you
wished. He added that "filtration is the key to it."
Commissioner Willhoit: Noted that the County planned to solve the Efland Estates
septic tank problem with a similar package treatment plant so there was no question
of such a plant's efficiency. He did, however, address a question to Planning Staff:
to wit, had the Staff ever looked into allowing package treatment plants as interim
solutions until water and sewer lines could be extended.
Ms. Smith: Replied that such an interim solution had not been considered
specifically. With regard to this specific proposal, there was reluctance on the
part of the Staff to see "a number of package plants" placed there to serve the
scope of the development. Staff preferred to see water and sewer lines extended to
serve that development.
commissioner Willhoit:. Reflecting that Mr. Freeland had indicated that when the
development reached a certain size he would tap on or extend the lines to serve the
development. He wondered how large that size might be; what number of units might
make such a tie on feasible.
Ms. Collins: Referred to previous discussions with Mr. Freeland and said that
this particular treatment plant would support "up to 125 dwelling units." He added
that "a twin" plant next to the proposed one would increase the capacity to 250
dwelling units. The Planning Staff's concern is that prior to completion of the
development, which could be "covered with two twin" package treatment systems,
that plans be made to tie on to the Hillsborough system.
Commissioner Marshall: Asked if we shouldn't have standards for a cut off
point for interim use of package treatment plants.
Mr. Collins: Said that at present we had no such standards or policy on what
a cut off point might be.
Ms. Gordon: Asked why the staging of the development was being planned from
south to north rather than north to south where initially you would be nearer the
sewage lines.
Mr. Freeland: Replied that the financing agreement released the land from south
to north and that was the reason for its development in that direction.
Ms. Gordon: Asked for the credentials of Mr. Freeland's consultant, Mr. McCall.
Mr. McCall: "I'm Buck McCall, Vice president of McCall Brothers Incorporated,
from Charlotte. We've been in business thirty-six years, in the water sewer business,
general contractors, unlimited license."
There were no others who wished to speak either in favor or opposed to the
rezoning request from Mr. James Rae Freeland. Mr. Irvin turned the floor over
to Commissioner Whitted to chair the Special Use Permit from The Timbers.
0-3 The Timbers--Amendment and Addition to the Planned Development, Rezoning
and Special Use Permit.
Both Mr. Collins and Mr. Fred Cates were sworn.
Mr. Collins made the presentation to the Boards. He said this was a request
from Mr. Cates for an amendment and addition to the Class A Special Use Permit
for a Planned Development-8 granted to The Timbers last February. The amendment
will allow, by realignment of one of the roads, an additional ten mobile home units.
(For specifics see the abstract page attached to these minutes on page,4,4 of
, this book.) Mr. Collins said this request, if approved, would increase the number

, of units from the 76 approved by the Board on February 1, 1983, to 88; some of these
additional units are to be double wide units. The site plan has been revised to
accommodate these changes. Staff thinks the revision is consistent with the original .
, request, said Mr. Collins. Mr. Collins listed conditions which Staff recommends be
placed on Phase IV of The Timbers if the Board grants the request:

in Phase In and th? -,,"ile homes on Timber Drive;
2) a four foot walkway be shown on the east side of Timber Drive on the final
plat;
3) Phase IV be completed prior to June 1, 1983;
4) thirty foot drainage easement be shown on the final plat between
units 83 and 84;
5) a final site plan showing the existing three Phases and the proposed
fourth Phase be submitted to the Planning Department prior to the
issuance of the revised Special Use Permit;
6) the developer resubmit from a qualified engineer a construction estimate
for Phase IV to insure adequate escrow for the required public improvements;
7) that the pond shown on the revised site plan be included in Phase IV and com-
pleted prior to June 1, 1983;
8) that single wide units be allowed where double wide units are shown on
on the site plan but that no double wide units be allowed where single
wide units are shown on the site plan. This is to ensure compliance with
set back requirements.
There were no questions from either Board on the presentation.
Mr. Fred Cates, developer, said that he agreed with all the stipulations as
outlined by Mr. Collins. One addition concerns 1 6, said Mr. Cates, regarding
a letter of credit or bond; he said that he had just received a commitment in Phase
IV for that money "and we can get a letter stipulating that so that will be the
same purpose and release the bond that we already have. That's what we'd like to
do, rather than having two bonds."
Mr. Cates showed the I-40 right-of-way to the Boards as requested by Ms. Pilkey.
Commissioner Willhoit moved, seconded by Commissioner Marshall, to adjourn this
public hearing on the Class A Special Use Permit amendment and addition for The
Timbers to 10:30 A.M. on March 7, 1983, for the purpose of receiving the Planning
Board's recommendation on this request. Vote: Ayes, 5; noes, 0.
This concluded the Joint Public Hearing of the Board of Commissioners and
the Orange County Planning Board. Following a five minute recess the Board of
Commissioners resumed its regular agenda with all members present.
A. BOARD COMMENTS
Commissioner Whitted added two addenda: Drivers' License Space and Latimer Street
Petition. Commissioner Willhoit added consideration of the numbering of streets in
southeast Orange County.
B. AUDIENCE COMMENTS: There were no persons who wished to speak to the Board
regarding items either on or not on the printed agenda.
C. MINUTES
Commissioner Willhoit moved, seconded by Commissioner Marshall, to approve the
Minutes of January 4, 1983, as corrected. Vote: Ayes, 5; noes, 0.
E-5 LATIMER STREET-- PETITION
Ms. Susan Smith presented details of the residents' request to the Board of
Commissioners (see the abstract attached to and part of these Minutes on page.#,0 1�3 6
of this book). Mr. Larry Carter, spokesman for the residents, told the Board
that since none of the residents owned the property that fronted on the unpaved
2/10 mile of Latimer Street they felt they should not have to pay for its being
paved under any of the NC DOT's paving programs (for example, Participatory
Paving Program or Property Owner's Participation), Commissioner Whitted reminded
Mr. Carter that, unlike the Town, the County does not have a road paving program.
Mr. Carter added that the 2/10 mile unpaved portion of Latimer Street is in poor
condition and not properly maintained by the State. He asked the Commissioners
to petition the State to pave that portion of the road at no cost to the people
who use the road; adding that the majority of residents are on disability or fixed
incomes.
Commissioner Willhoit moved, seconded by Commissioner Walker, to petition the
State to pave the 2/10 mile section of Latimer Street (SR 1162). Vote: Ayes, 5;
noes, 0.
The Board added that the letter to DOT would include a request for regular
0 maintenance to Latimer Street. (Petition presented by Mr. Carter is on permanent
file with the agenda attachments for the date of this meeting in the Office of the
Clerk to the Board.)
E-1 BUDGET AMENDMENTS
Commissioner Willhoit moved, seconded by Commissioner Marshall, to approve
the budget amendments as recommended by the Manager. Vote: Ayes, 5; noes, 0.

of these Minutes.)
E-2 DISCRETIONARY GRANTS PROGRAM

Commissioner Marshall moved, seconded by Commissioner Willhoit, to approve the
0 submission of a preapplication to the U.S. Department of Health and Human Services
for a grant for funds to define ways to strengthen the current annual planning pro-
9 cess for the Department of Social Services. Vote: Ayes, 5; noes, 0.
E-3 SURVEYING CONTRACT AWARD
The Manager told the Board that the County had requested three bids for the
cost of surveying the 67 acre landfill tract in the Northern Fairview Community be-
fore- the purchase of 41.6 acres for the Community Park. The results are:

Commissioner Willhoit moved, seconded by Commissioner Marshall, to approve
the Manager's recommendation to award the contract for the survey of the Landfill
site in Hillsborough to John McAdams Company for $14,050 as the lowest responsible
bidder. Vote: Ayes, 5; noes, 0.
E-4 DRIVERS' LICENSE OFFICE
Commissioner Walker moved, seconded by Commissioner Lloyd, to authorize the
Manager to initiate renovation and to negotiate a lease with the Town of Carrbbro
for space for the Drivers' License Examiner's Office in southern Orange. Vote:
Ayes, 5; noes, 0. (See abstract on page /l of these Minutes.)
E-6 NUMBERING OF STREETS IN SOUTH ORANGE
Commissioner Willhoit said citizens in south Orange had told him that the Post
Office was re-numbering the rural routes in that area again. Commissioner Willhoit
requested the Manager to check into the possibility of having the Post Office assign
street numbers or lot numbers at intervals to these homes. Commissioner Willhoit
' said this was a charge to the Road Naming Commission but had not been done yet; he
' asked the Manager to get this information from the Post Office and to schedule this
' topic on a third Tuesday meeting and to advertise it in order to ascertain community
interest in having street/lot numbers assigned. The Board requested the Manager to
follow through on Commissioner Willhoit's request.
F-REPORT
Mr. Ray Green of the Triangle J Council of Governments presented a slide show
' and oral report on the Triangle Area Development Plan. Following the presentation
Mr. Green told the Board COG planned two conferences: 1) a Regional Forum to produce
a draft document on problems, solutions.-and actions for specific local governments;
' and, 2) a Regional Retreat which will take the draft document produced at the first
' Forum and refine it into a consensus document on problems, solutions.and specific
' actions for local governments in the Triangle area. Mr. Green said the Triangle J
is not asking for financial support but is asking that Orange County co-sponsor both
' conferences, thereby lending its support.
Commissioner Willhoit moved, seconded by Commissioner Marshall, to adopt a
Resolution pledging Orange County's cooperation and participation in the conferences
agreeing to be a co-sponsor. Vote: Ayes, 5; noes, 0.

RESOLUTION
WHEREAS this region is the fastest growing in the State of North
Carolina, which is itself one of the more rapidly-growing states, and
WHEREAS rapid growth is expected to continue for at least the next. _
two decades, bringing a mixture of opportunities and problems which need
to be addressed now if the quality of life in this region is to be
preserved, and
WHEREAS the Triangle J Council of Governments is drawing up plans
for a conference or conferences in the Spring of 1983 to explore the
development-related issues and assist city and county officials in
reaching a consensus on goals and strategies to preserve our quality of
life,
NOW, THEREFORE be it resolved that the Board of Commissioners of
the County of Orange pledges its cooperation and participation in the
conferences and agrees to be a co-sponsor.

The Manger told the Board he had one additional item: a request that the Board
approve a preapplication from the Department of.Social Services for State HDS FY1983
Coordinated Discretionary Funds. Social Services Director Tom Ward said there was
no cash outlay required from the County for the program for "Comparing Two Models
of Parent Education for Abusing and Neglecting Families. Commissioner Marshall moved,
seconded by Commissioner Willhoit to approve the preapplication for the above project.
Vote: Ayes, 5; noes, 0. The Board requested a copy of'the program.

To receive citizen input and comments on the proposed change to the Land Use
Plan for 149.3 acres in Hillsborough Township from Twenty Year Transition
and Rural Residential to Ten Year Transition.
N m: The applicant has requested that 149.3 acres located at the southwest inter-
section of I-85 and NC 86 in Hillsborough Township be redesignated as Ten
Year Transition. The tract is bissected by the main line of the Southern
Railroad. The portion of the tract north of the Southern Railroad line is
presently designated Twenty Year Transition Area. The portion of the tract
south of the Southern Railroad line is presently designated Rural Residential.
The entire portion of the tract north of the railroad and the northernmost
portion of the tract south of the railroad are within the Harmon Young (HB-4)
activity node.
The 149.3 acre tract is bounded on the north by I-85 and NC 86 interchange;
on the east by the properties of Paliouras Enterprise, Paul T. McAllister,
Josephine Harrison, James Ervin Rigsbee, DeWitt Lassiter, Joseph Lassiter,
Meadie Arnold Turner, and Joppa Oaks subdivision and Piedmont Power; on the
south by the properties of Archie E. Millis, Woods Brothers, Ine. .and
Stagecoach Run subdivision; and on the west by the properties of Amy E.
Burcham, C. T. Cook, Wachovia Bank & Trust Co., and Central Carolina Farmers
(FCX Inc.).
The applicant has also submitted a request that the southernmost 10 acres be
rezoned from R-1 to R-4 medium intensity-residential. The proposed amendment
to the Land Use Plan would allow for the proposed use of the southernmost 10
acres.
IMPACT: The proposed change to the Land Use Plan would extend the 10-year Transition
Area for Hillsborough from the northwest intersection of I-85 and NC 86 south
to encompass the entire 149.3 acre tract. The proposal would not be incompatible
with the existing development in the area. The tract has frontage on NC 86 at
the northeastern and southeastern corners of the property and is readily accessible
from the I-85 and NC 86 interchange.
UCOMMENDATION: The Planning Staff recommends approval of the requested change to the Land Use
Plan. For the Board's information, staff will be reviewing and revising the
HB-4 activity node and vicinity at a later date as part of the annual work
program. Staff also recommends that prior to development of the tract that a
sketch plan for the entire tract be submitted indicating the approximate locaCion
and density of proposed uses and that development of the tract at densities
greater than one unit per acre be conditioned on the provision of public water
and sewer facilities.

'K � To receive citizen input and comments on the proposed zoning change for ten
acres of property from R-1 to R-4 requested by James Freeland.
The property is located in Hillsborough Township and is shown as lot 4 on
Tax Map 45 adjacent to N.C. 86 and Wood Brothers, Inc. An R-4 zoning
classification would allow the development of a subdivision with a minimum
of 10,000 square foot single family lots. This medium intensity residential
district would require that public sewer and water exist at the site or be
proposed as part of the development. The developer proposed a package
sewer treatment plant to handle the first phases of development and extension
of city water lines also. The site is located in the 'Orange Rural Fire
District. The rezoning request covers the southerpmost ten acres of this
tract.
IMPACT: the property is located in a Rural Residential area as designated by the
Land Use Plan. For the proposed rezoning to conform to the Land Use Plan,
the ten year transition area would have to be extended south from I-85 to
encompass this area. Residential development at R-4 would not be incompatible
with the existing development in the area or with possible future development.

provided that public water and sewer are provided as part o.f the development

The site is located in the Orange Rural Fire District.
IMPACT: The property involved is located in a ten year' transition area as designated
by the Land Use Plan. Floor area, open space and livability space requirements
are shown on the site plan for the total development. Privacy of each unit
is minimal due to close proximity of the mobile homes and minimal building
setbacks. A private paved road will be provided with public water and sewer.
All traffic'will.enter onto Orange Grove Road which is designated as a Collector
Road in the Orange County Land Use Plan.

INTRODUCTION
The Timbers Planned.Development was approved by the Orange County commissioners
in February, 1982• This is an application for a revision to that development,
Specifically to Phase IV, to realign one of the roads and create 10 additional
mobile home spaces (for a total of 28 spaces in Phase IV, and 90 spaces in the
total development,)
This revision is occasioned by our discovery that the base map upon which we
designed the original layout is in error; there is actually more property in
the tract than our original plat showed. This revised layout covers more land
totally, and the' density of the development is still about the same as was the
case in the approved layout (4.93 units per acre).
LOCATION
The Timbers is located in Orange County, about one mile southwest of the Town
Of Hillsborough. The site is to the northwest of Orange Grove Road and has
access Off of Orange Grove Road, and is located immediately south of Interstate
85 and immediately east of the designated right-of-way for the proposed Inter-
state 40. The site occupies the western 16.5 acres of a tract of land that is
totally about 44 acres in size (after a 15.5 acre taking for the I-40 right-of-
way)
DESCRIPTION OF T= DEVELOP..MENT
The Timbers will consist of 90 mobile homes, all of which will be on lots 40
feet wide. . At the north end of the development is a 5.4 acre area reserved as
open space, in which will be built a small pond. Access to The Timbers is off
Of Orange Grove Road, and public water and sewer will be provided. All of the
land will be under common ownership, with spaces rented to the tenants. In
most cases the mobile homes themselves will be owned by the tenants.
ACCESS TO THE SITE
The Timbers is located about 900 feet off of Orange Grove Road, which is a
State-maintained, two-laved secondary road. Traveling northeastward on Orange
Grove Road, it is only 3/4 of a mile to reach the Town Limit line of
Hillsborough. By traveling northeastward on Orange Grove Road and then taking
Old NC 86 south, one can get on 2-85 about two miles from The Timbers. By
traveling southwest on Orange Grove Road and taking two other State roads to
the west that doss under 1-85, one can get into west Hillsborough in the area
of Hillsborough Textiles with about three miles of travel.
The traffic generated from The Timbers will not overload Orange Grove Road.
?Although the current traffic ;oad on Orange Grove Road is not now known to the
Developer, The Timbers Development should add only about 100 vehicles per hour
to the peak hour traffic. (The average traffic generated by The Timbers
would be only about 30 vehicles per hour.) The peak hour capacity of Orange
Grove Road, assuming about 40 mile per hour traffic and typical delays for
turning onto Orange Grove Road, would be about 1600 cars per hour.
UTILITIES
Water and sewer service will be provided by connection to the Town of Hillsborough
systems. In the case of sewer, Hillsborough has a rather new 2.0 MGD wastewater
treatment plant that is currently operating at only 30 percent capacity. There
is an existing sewer force main that runs along Orange Grove Road from a pump
station at Grady Brown School and that force main has considerable excess
capacity to receive the wastewater flow from this development. The Developer
proposes to install a sewer pump station at the north edge of the mobile home
lots, and pump the wastewater south along the entrance drive to a connection
into t'ze existing force main at Orange Grove Road. Between the pump station and
the mobile home, all sewer service will be by gravity flow.
As for water service, the Town of Hillsborough has a rather new 3.0 MGD water
treatment plant facility, which is currently operating at only 37 percent
capacity. There is an existing waterline on Orange Grove Road which runs from
Hillsborough to the Grady Brown School, and this line also has considerable
excess capacity and can be tapped to serve The Timbers. The elevation of this
development is high relative to the elevation of the Town of Hillsborough, but
the waterline already has a booster pump station located approximately 2000
feet northeast of the site, which increases the pressure in the maximum sur-
face elevation in the area of The Timbers and Grade Brown School. The existing
waterline is 8 inches in diameter and the demand from The Timbers will not
place a significant burden on the line.
The streets will be maintained by the Developer, or his successor in ownership,
who will retain ownership of all of the land. The streets will be graded and
drained generally in accordance with NC DOT Subdivision Roads standards. Base
course will be 5 inches of ABC ("crusher run") , and then asphaltic surface
treatment will be applied to the surface.
EROSION CONTROL PLAN
An erosion control plan for development of The Timbers has been submitted to
and approved by the Orange County Erosion Control Officer.
FUTEME IMPROVEMENTS
The site plan submitted for this application for The Timbers indicates certain
areas of possible future development on the balance of the total 44 acre tract
of land. At the present time, the applicant intends neither to develop that
por`.ion of the land indicated as "Possible Future" nor seek approval of that
possible layout as shown on the plan. The layout is presented simply to comply
with the County application requirements, and to indicate that a coordinated
development on the balance of the property is possible. The current portion
Of the development for which approval is now sought is only that portion of
the development at the west end of the property which is bordered by a heavy
line and indicated to be The Timbers.
APPROPRIATENESS OF THE PROPOSED DEVELOPMENT
The Timbers Mobile Home Park will be developed to a density of about 6.2 units
per acre. The balance of the total tract is shown with development in the
range of 6 to 8 units per acre. Development to this density is appropriate
for this site for several reasons. The site is extremely well located from the
standpoint of access. It is very close to Orange Grove Road, yet it is
buffered from the road by Some internal buffering as well as some existing low
density residential uses to the south of the site. Orange Grove Road leads
directly into Lillsborough. Access to I-85, or travel to Durham to the east
Or Burlington to the west, is excellent. Access on State roads to west
Hillsbarough, where several of the residents are likely to be employed, is also
quite good.
The site is also very well located with respect to utilities. As described
above, the Town of Hillsborough water and sewer already exist on Orange Grove
Road, and this development will not over burden those existing utilities.
Because of the existence of these utilities, and the considerable difficulty
with respect to providing sewer service in so many other areas of the County,
it is particularly appropriate that this site be developed for high density
residential use.

?�J TWE: To consider the concerns of residents of Latimer Street and Kingsboro Estates
regarding the paving of two-tenths of a mile of Latimer Street.
The unpaved portion of Latimer Street connects two paved sections of Latimer
Street. The unpaved portion is fairly steep and in poor condition for travel.
NEm: Latimer Street extends from inside the corporate limits of Hillsborough to
Kingsboro Estates subdivision within the extra-territorial limits of Hillsborough.
The developer of Kingsboro Estates subdivision paved the streets within the
subdivision, including a portion of Latimer Street which serves the subdivision.
The Town of Hillsborough contracted with DOT to pave the one-tenth portion of
Latimer Street which extends to the corporate limits after many requests from
residents served by the road. The Town encumbered funds from Powell Bill monies
to pay for this work. However, the General Statutes restrict the use of these
funds outside of municipal corporate limits. Therefore, the Town could not use the
funds to pave the remaining length of road within the Town's extra territorial
area extending to the paved portion within Kingsboro Estates subdivision.
The residents of Latimer Street and Kingsboro Estates presented the attached
petition to the Town of Hillsborough at the Town Board's December 13, 1982
meeting requesting the Town to pave the unpaved portion of Latimer Street-. The
Town considered the item but referred the residents to the County for action.
The Town also sent a letter to DOT endorsing the request for paving. DOT indicated
in a letter dated December 21, 1982 that the road was eligible for paving through
either the Participatory Paving Program (P.P.P.) or Property Owners Participation
Program (PAP.).
DOT maintains the entire length of Latimer Street including the unpaved two-tenths
of a mile outside the Town's corporate limits. DOT has indicated that Latimer
Street is considered to be a residential and subdivision street and, therefore,
the unpaved section is only eligible for paving under either the Participatory
Paving Program (P.P.P.) or the Property Owners Participatory Program (POP.). DOT
estimates the cost to grade, drain and pave one mile of road is $120,000. The
approximate cost to pave the two-tenths of a mile section of Latimer Street
would be $24,000. Under either the PPP. or PO1? program, the local share would be
$4.00 per linear foot or $4,224.00. The local share may be paid by the residents
of Latimer Street adjacent to the unpaved portion of road; by the residents
of Kingsboro Estates; or by the County. Payment by the residents adjacent to the
unpaved portion of road could be made under either the P.P.P. or PAP..programs. Payment
by the residents of Kingsboro Estates or the County could be made only under the
P.O.P. program. Mr. Larry Carter, spokesperson for the community served by
Latimer Street, has indicated that the majority of the residents served by the
unpaved portion of Latimer Street are unwilling to participate in either program.

IMPACT: Paving of the unpaved portion of the road would substantially improve the
access for all residents served by the road, as well as those residents of
Kingsboro Estates who use the road for access to the subdivision.
ECOMMENDATION: The following options are available for consideration by the Board;
a) participation by the residents adjacent to the unpaved portion in
the P.P.P. or P.O.P. programs; b) participation by the residents
of Kingsboro Estates in the P.O.P. program; c) participation by
the County in the P.O.P. program; d) request DOT to reclassify the
road for paving under a non-participatory program.
As the Board decides.

of Health and Human Services (HHS) for funds to define ways to strengthen
the current annual nlanning process of the Department of Social Services.
NEED: With counties having to assume more responsibility for managing social services
while at the same time suffering cutbacks in funding, there is a greater need
to target resources to the most needy and to deliver services in the most
cost-effective manner. The Social Services Department has made nronress in
recent months to measure staff output in relation to client data in order to
judne the meeting of mandates in the areas of adult services and abuse and
nerllect cases. Building upon the experience there is a desire to design an
annual planning process for all of the denartment's programs.
Enabling funds have been found which, if apnroved, would nav for technical
assistance necessary to work with the Social Service Board, Director, staff
and County Manager's Office in developing the plan elements. Specific content
of what the elements would consist -is in the process of being drafted.
However it is expected to include: "
1. Analysis of current data generated by DSS and its utility in
an improved planning process.
2. Analysis of additional data required.
3. Determination of how the data will be used and what will be
required organizationally for the input, analysis and rank-
ordering of the data for decision-making.
4. Evaluate the impact of the planning process on a before and
after basis.
IMPACT: Project cost is exnected to be about 520,000. The HHS portion would be
$15,000 and $5,000 County in-kind (non-cash).
If the oreapnlication is approved by HHS, the County will then need to submit
a more thorough annlication on a competitive basis.

NEED: In June of 1982, plans received Board approval for several agencies, including
the Driver's License Office, to occupy the Old Police Building once the Central
Communication's Center was relocated to its own facility. Two developments
during the intervening period have had a bearing on the plans. First, the
lease for Driver's License and the Denartment on Aging at its present location
had to be extended to February 15, 1983. Secondlv, M1 . Neil R. Shelton of the
NCDOT found the Old Police Building to be unsuitable for conducting driver
examinations because of the volume of traffic on Columbia and Rosemary Streets
and insufficient narking spaces in adjacent lot. This caused a search to be
mounted for a different oermanent site than the Old Police Building or con-
tinued lease at the present site.
The Town of Carrboro offered sa_ ace which could be rented in the Town Hall
basement. Inspection revealed that snare could be suitable if the open space
were partitioned and equinped for office occupancy.
I1PACT: Cost for improvements would be approximately $5,100 in material and $3,000 in
County in-kind labor. Carrboro would provide 800 square feet, rent, utilities
and custodial service as a credit for 2.7 years rent for the improvements made.
This would be equivalent to $3.75 per square foot for the period compared to
$7.50 per square foot under present leasing. The saving over the period would
be $23,900.
Funds are available under--the ecuinment and repair account of Public Works so
no new aonropriation would be necessary.
A lease with Carrboro specifying the rent credit would be presented at the
February 7 Board Meeting.
RECOMMENDATION(S):
Authorize Manager to initiate the renovation and to negotiate the lease
according to the above terms with formal lease approval at a subsequent
meeting of the Board.
