7. The Orange County Board of Commissioners met,in regular
8' session Tuesday, December 15, 1981, at 7:30 P.M. in the Superior
9. Courtroom, Orange County Courthouse, Hillsborough, North Carolina.
10• Commissioners present: Chairman Richard E. Whitted, and Com-
lie missioners Anne Barnes, Norm Gustaveson, Norman Walker and Don

16. Commissioner Willhoit moved, seconded by Commissioner Gustaveson,
17. to approve the Minutes of October 5, 1981 as- submitted. Vote: Ayes,

19. D. Resolution of Con ratulations--Oran a Dual Supply Panthers
20. Chairman Whitted read the Resolution of Congratulations to the
21. Orange County Dual Supply Panthers (a copy of this Resolution 'is on
22' page of this book) . Commissioner Walker moved, seconded. by

Chairman Whined to adopt the Resolution of Congratulations for the
24• Orange County Dual Supply Panthers. Vote: Ayes, 5; noes, 0.
25' E. Resolution bf Commendation--Anne C. Barnes
26. Chairman Whitted read the letter of resignation from'MS. Barnes;
27° Ms. Barnes resigned her seat from the Board of Commissioners effective
28' this date an order to accept appointment to the House of Representatives.

30' Gustaveson, to adopt the Resolution of Commendation for Anne C. Barnes

32' Representative Barnes voiced her appreciation for the Staff,
33' volunteers and Orange County Citizens. She invited everyone to

10. Mr. Ken Rohrbench said he spoke for a contingent of homeowners
11. who were present and all were in favor of the project.
12. Mr. John Silva--a new resident of the subdivision asked sev
13. eral questions regarding how the assessment was calculated, when the
14- petition was circulated and the percentage of homeowners who signed
15. the petition.
16. Ms. Susan Smith, Planning Department, answered Mr. Silva's
17. inqueries.
18. With no one remaining who wished to speak, Chairman Whitted
19• declared this public hearing closed.

Commissioner Willhoit moved the adoption of the Final Assess-
21. ment`Resolution for the Falls of New Hope Participatory Paving P--^-
22. ject; Commissioner Walker seconded the motion. Vote: Ayes, 4; r:_:

24- H. Board Decisions
25• 1. CBA Expansion Funds, 1981-82-- Orange County received
26. $5,782 additional funds from the General Assembly for this program-
27e The Youth Services Task Force is recommending the Board allocate
28. $3,000 to Shaffer House and $1,391 each to Janus and Tree House.
29. Commissioner Willhoit moved to approve, seconded by Commis-
30• sioner Gustaveson, the recommendation of the Youth Services Task
31• Force to allocate $3,000 to Shaffer House and $1,391 each to Janus
-32. and Tree House and to authorize the submission of a revised budget
33. to the State to reflect this unanticipated revenue. Vote: Ayes,

10. David Kleinbaum, Tax Map 87, Block E. Lot 6: This appeal was
11, originally heard on October 29, 1981; check the minutes of that
12. meeting for details of the appeal. The Tax. Appraiser said .he visited
13. the home and found several errors in the appraisal; corrections for
14- the errors would reduce the house value from $61,276 to $50,307,
15. making a corrected total valuation of land and improvements of

$89,307. Commissioner Gustaveson moved, seconded by Commissioner

3. Tax Refund/Release Requests
33- North Carolina National Bank, Account # 34791: The Tax
34- Appraiser said the bank had listed in error an automobile which was
35. leased to a Chatham County resident. Commissioner Gustaveson moved

to refund the taxes paid for 1980 and 1981 for a total of $382.02;

4. Hamrick, Thomas B. Jr. and Donna, Tax Map 113-A-4, Account
5• # 21478: The Tax Appraiser said that a commercial garage was erro-
6• neously assessed on the Hamricks' tract for 1979. Commissioner
7• Gustaveson moved, seconded by Commissioner Walker, to approve the
8. refund of $107.64 for taxes paid on property incorrectly assessed.

10• Marie B. and Arthur Crisp, Tax Map 40, Parcel 62, Tract #2507:

15• Jacqueline A. & Michael Resnick, Tax Map 41C, Block C, Parcel
16. 5, Tract # 14037: The Tax Appraiser said a clerical error in recording
17• the size of the house had resulted in an error of $7,400 over-
18. valuation for the home. The overvaluation had previously been released
19. in the name of the previous owner, Harriet V. Rothman; however, the
taxes for 1979 were paid from the Resnicks' excrow funds. Commis-
?1• sionex Willhoit moved, seconded by Commissioner Walker, to approve
22. the tax refund of $177.16. Vote: Ayes, 4; noes, 0.
23• Goldston, Inc., Account # 5619: The Tax Appraiser told the
24• Board this company had incorrectly listed two vehicles for taxes
�5• in Orange County when they should have been listed in Alamance
26. County. Commissioner Willhoit moved, seconded by Chairman Whitted,
�7° to approve the tax refund of $103.65 for the error in listing. Vote:

29• Zephyr Construction Company, Inc., Tax Map $B, Block C, Par-
30- cel 4, Tract # 7813: The Tax Appraiser said this property had been
31• incorrectly listed and paid in the name of Zephyr when the deed to
. 3 2• the property had been conveyed in October 1979. Chairman Whitted,
3° moved, seconded by Commissioner Willhoit, to approve the tax refund
34• of $48.38. Vote: Ayes, 4; noes, 0.
35• Alex D. & Eunice Hamlett, Tax Map 14, Parcel 16, Tract # 179:
36• The Tax Appraiser told the Board this property was incorrectly
37• assessed as having 159 acres when in actuality it is only 149.

5. the tax refund of $12.24. Vote: Ayes, 4; noes, 0.
6, Fraternity Housing Corporation, Account # 44475 (1979) and
7. Account # 34416 (1980) : The Tax Appraiser said the Corporation
8. owns a lot and house which it leases to a fraternity in Chapel
9. Hill and in 1979 it paid $2,534.79 in error on the personal pro-

perty tax account of the fraternity. The Corporation asks that
11. the amount' paid be transferred to its real estate account for 1980,
12.
this would result in a refund of $158.39 being due and the Tax
13.
Appraiser recommends approval of the transfer and refund. Com-

Tax Appraiser told the Board the bank had a leased vehicle which

had an incorrect rate code assigned to it and had been incorrectly

assessed Chapel Hill City tax and Chapel Hill--Carrboro School. tax.

The tax office discovered the vehicle for taxation for the year 1979

in 1981. The Tax Appraiser recommends the Board refund a total of

$144.60 for the. tax years 1979 and 1980. Chairman Whitted moved

seconded by Commissioner Gustaveson, to approve the tax refund for

$144.60. Vote: Ayes, 4; noes, 0.

Tract 7.13517: This request is for the prorated amount of the

1979 Carrboro City tax assessed in 1980 due to the annexation

8• in 1980 and based on the change of the annexation date by the

11. approve the tax release as recommended by the Tax Appraiser.

17• Calvary Missionary Baptist Church, Tax Map 105, Block A, Par-
18. cel 22, Tract # 14279: This is a lot and home adjacent to the
19• church; the church is seeking tax exempt status for the past
�0• three years under G.S. 105-278.3 (d) (1) saying the house hae
?1• been used as a residence for the church caretaker. Chairman
22. . Whitted moved, seconded by Commissioner Willhoit, to approve the
23. tax release and tax exempt status for the three years (1979,80,
24, and 81) . Vote: Ayes, 4; noes, 0 (Amount of taxes released is
25• $970.26) .
26• Colonial Hills Baptist Church, Tax Map 1, Block A, Parcels
27. 8A, 9A; Tracts #502762 & # 502538: The Tax Supervisor had denied
28• the timely application for 1981 exemption for the two vacant parcels.
29• The church is appealing that denial under G.S. 105-278.3 and 105--
30• 282.1.
31• Chairman Whitted moved, seconded by Commissioner Willhoit, to
"S2• approve the release for the taxes for 1981 in the amount of $3.96.

34- 4. Northern Fairview Redevelopment Plan: The Mananger asked
35• the Board to defer action on this until January 4, 1982.
36• G. Northside Building Report
37. Mr. Roman Kolodji and Mr. James Webb presented a report on

4• the Northside Center; the report included possible floor.plans.
5. Mr. Kolodji and Mr.. Webb said they had talked with the tennahts'i.n
6. the building to get some idea of the needs which now existed.
7. Some members felt that there needed to be an orientation center
8. of some sort and handicapped accessibility. There was some dis-
9. . cussion that the Department on Aging should be the lead agency in
10. the building. The Board suggested that the Manager and Departmeftt
on Aging should make recommendations on space allocations and_..the ._-... . -_
12. Board should make the final decision.
13• 5. Northern Fairview: Land Acquisition and Appraisals
14• Commissioner Willhoit moved, seconded by Commissioner Walker,
15. to approve the land acquisition procedure and guidelines for selecting
16. appraisers and to approve A.C. Robbins (First Appraisal) , Tom Heffner
17. (Second Appraisal) and George Meyer, Jr. (Review Appraisal) to per-
18• form the appraisals in Northern Fairview CD Project. Vote: Ayes,
19. 4; noes, 0.
20, 6. Naming of State Maintained Roads
21. Commissioner Willhoit moved, seconded by Chairman Whitted, to
22. approve the names of the State maintained -roads presented at the
23. public hearing on October 20, 1981, with the exception of those
24. roads names receiving concern and those road names with "Circle" as
25. part of the name. Vote: Ayes, 4; noes, 0.
26. Those names excepted should go back to the Road Naming Advisory
27. Commission.
26. 7. Title III-B Contracts
29. Commissioner Gustaveson moved, seconded by Commissioner Willhoit,
30* to approve the Title III-B contracts with.Triangle J Council of
31. Governments and to authorize the Chairman to sign the contracts.

33. 8. JOCCA Transportation Agreement

25• appointed to the Personnel Advisory Board on December 7, 1981, on
26• slips of paper and put those slips into a cup; Commissioner Willhoit
