8. session Tuesday, November 17, 1981, at 7:30 P.M. in the Commissioners'
9. Room, Orange County Courthouse, Hillsborough, North Carolina.

13. Agenda Item A: Board Comments
14. Commissioner Walker asked that the Eno Watershed item be dis-
-1 on the agenda; Commissioner Barnes added personnel and

16. property matters to the executive session and reserved the right of
17. the .Board to instruct the Manager following the architects' present-
l8. ations on the Old Courthouse.
19. Agenda Item B: Audience Comments
00 Ms. Evans wished to speak to the the architects' presentations;
Ms. Josephine Barbour and Mr. Ben Lloyd wished to address the Upper
22. Eno Watershed item.
23. Agenda Item C: Minutes--September 28, 1981
24. Commissioner Willhoit moved, seconded by Commissioner
25. Whitted, the approval of the Minutes of September 28, 1981, as
26. submitted.
27. Agenda Item D: Architects Reports
28. Burnstudio: Robert and Norma Burns gave the Board back-
29. ground on Burnstudio, noting the size of the staff as well as on-
30. going projects and the primary focus of the firm. The.firm said
31- it had extensive experience in renovation of courthouses. An approx-
,2� imate estimate for the Old Courthouse project is $163,000 to $230,000,
depending on exactly what the Board wished included or excluded.
34- Cogwell/Hauser: Mr. Cogswell and Mr. Haskins presented back-
35• ground information on this firm. They noted previous projects and
36. current projects and said they were of sufficient size to give ind-
37. ividual attention to the project as well as get drawings completed
38. quickly.

4. The Board thanked the architects for their presentations
S• and asked that this item be returned to the 4th Monday meeting for
5. discussion of the proposals thus far.
7• Ms. Onie Evans said she was interested in the Museum as it
8• was now in the Old Courthouse. She said the Old Courthouse needs
9. repair work. She suggested the Board consider extending the New
10. Courthouse toward the Board of Education and also asked the Board
11. consider the Firestation across the street as courtroom space rather
12. than using the Old Courthouse.
13• Agenda Item E-6: Upper Eno Watershed
14- Commissioner Barnes gave the history of the University Lake
15• Watershed moratorium :and noted that the Town of Hillsborough had
16. requested some provision of protection for its watershed. Commis-
17• sioner Walker protested that the County had no zoning ordinance for
18. that area of the Eno watershed which extended into Cheeks Township
19• and that this consideration of a moratorium on development in the
20. Upper Eno Watershed would extend zoning into an- area which doesn't
21. desire zoning. The County Attorney, Geoffrey Gledhill, said this
22. was a temporary action,pending permanent action and "if you place
23• a moratorium on all subdivision in the Upper Eno Watershed and the
24. amendments `incorporating the recommendations of the Water Resources
�5• Task Force Report% are adopted by the Board [of Commissioners/ then
�0• the zoning ordinance will replace the moratorium where it :exists and
27° if unzoned it the moratorium/ will no longer exist."
28. Mr. Ben Lloyd spoke at length. in opposition to extending the
29* moratorium into Cheeks Township. He expressed concern at the pre-
30• vention of industry locating in that area. `Commissioner Gustaveson
31• told Mr. Lloyd that the issue is the protection of the water supply
32• for the Town of Hillsborough; that the Board of Commissioners was
33* in favor of industry locating in Orange County and had encouraged
34• industry; however, the point was to set standards so that industries
35. locating in the watersheds would not pollute or endanger the drinking
36. water for the Towns:;of Orange County.
37• Commissioner Gustaveson went on the record saying the Board
38. was not opposed to industry locating in Cheeks Township; the Board

was concerned with getting the appropriate standards, land use
5. plan, zoning ordinance and subdivision regulations, in place prior
6. to the extension of water and sewer to those areas of industrial
7. locations.
g. Mr. Sim Efland also spoke in opposition to the extension of
9. the moratorium into Cheeks Township saying the Board was penalizing
10. those property owners. Ms. Barbour also protested the consideration
11. of the moratorium intobCheeks Township, saying there was not that
12. much growth in the area.
13. Commissioner Whitted said he felt there had been a good.
14. discussion tonight; however, he felt the issue was the development
15. of subdivisions occuring in the watershed. Unlike University Lake,Mr.
16. Whitted noted there was no public ownership of land around lake Ben John
17. son, development .occurred right up to the edge of the water. So,
18. with that preamble, Commissioner Whitted moved, seconded by Commissioner
19. Willhoit, to extend the moratorium on development in the Upper
?0, Eno Watershed until such time as the Water Resources Task Force
?1, goes through its process (that is, omiendments to the zoning ordinance
22, incorporating the recommendations of the Report and the public hearir;
23. necessary on those proposed amendments) and considered by this Board
24- for incorporation into the Zoning Ordinance.
25. Commissioner Walker asked if Commissioner Whitted would amend
26. his motion to extend the moratorium on development in the Upper Eno
27. watershed to those zoned areas only. Commissioner Whitted declined.
28. Vote Ayes, 3 (Commissioners Gustaveson, Whitted and Willhoit) ;
29. noes, 2 (Commissioners Barnes and Walker) .
30. For clarification, the Board noted that those eubdi.visions
31- in the process prior to November 17, 1980, is not active and any-
32. thing after November 17, 1981, is covered under the moratorium for
3. the duration of said moratorium. Those subdivisions falling within
34- those two dates are considered active for one year after their original
35. submission.
36. Agenda Item E-2- Social Services Budget
37. The Social Services Director, Thomas Ward, noted that due to
38. the uncertainty of Federal cuts last spki.ng, the Board had not approved

5. Fiscal 1981--82 and to authorize the Chair to sign it. Votet Ayes,

14. whitted to accept the certification of returns of the Special Fire
15. District Election from the Clerk to the Board_. Vote Ayes, 5; noes, 0.
16. Agenda Item E-5: Building Permit Fees Refund-Policy
17. Commissioner Gustaveson moved, seconded by Commissioner
18. Walker, to adopt the' b' iding permit fees refund policy and to
19. authorize the Planning Department to make refunds when eligible under
20. the policy. (See page of this Book for a copy of the policy) .
21. Commissioner Whitted offered a friendly amendment which was
22. accepted by Commissioner Gustaveson, to strike the service charge
2,. of twenty- dollars or 20% retained by the County when refunding building
24, permit fees.
25. Commissioner Whitted also requested the planning department
26. to make a disclosure of the County's refund policy at the time of a
27, building permit issuance.
28. Vote on Commissioner Gustaveson's motion to adopt the building
29. permit fee refund policy with :amendment by Commissioner Whitted: Ayes,
30. 5; noes, 0.
31. Agenda Item E-7: Clerical Position--Planning
32. Commissioner Whitted moved to approve the filling of the
33, clerical position in the Planning Department; Commissioner Willhoit

8. Barnes, to approve the Manager's recommendation to renew for six
9. months a lease for office space at 208 West Main Street, Carrboro,
10. North Carolina, to house the NC Driver's Examiner's office, the

14. The Board instructed the Clerk to return this to the agenda

17. Commissioner Whitted moved, seconded by Commissioner Gustaveson,
18. to convene in executive session to consider personnel matters, legal
19* matters and property matters. Vote: Ayes, 5; noes, 0.
