7. The Orange County Board of Commissioners met. in regular
8. session Tuesday, October 20, 1981, in the Superior Courtroom,
9. Orange County Courthouse, Hillsborough, North Carolina,
10. . Commissioners -present: . Commissioner Anne Barnes, Chair, and
11. -Commissioners Norman Gustaveson, .Norman walker, Richard Whitted
12. and Don Willhoit - -- - - -
13. Agenda Item 1: Board Modification
14. Commissioner Barnes- moved the swearing in-ceremony- of the
15. netii.County Manager to 'follow this agenda item;-,and corrected
16. agenda item number 6 to include public non-state maintained
i79 roads.
18. Agenda Item 12: Oath for County Mana5jer
19. The Clerk of Court, Mr. Frank Frederick, administered the
20. oath of office .to Kenneth R. Thompson, Orange County Manager.
21. (A copy of this oath is on page of this Book; the original
22. is on file in the office of the Clerk to the Board of Commissioners.)
23: Commissioner Barnes, on behalf of the Board, thanked Mr. Laws
24. for the dedication he demonstrated during his term as Acting County
25. Manager.
26. Agenda Item 2: Public Comments
27. A. On agenda: There were no public comments for items on
28. the agenda other than the public hearings. .
29. B. Not on the Agenda: There were no comments.
30. Agenda Item 3: Public Hearing--DOT's Proposed
Secondary Road Program for 81-82
31• in Orange County
32. Mr- Watkins, Mr. Jones and Mr. Sanders Dallas represented the
33- North Carolina Department of Transportation and presented the
34- proposed, Secondary Road Program for Orange County for 1981--82. -
35. Mr. Watkins said the DOT had $963,000 to spend in Orange
36. County over.the next two years with $361,249 allocated for this
37. year, due to the $.03 tax on gasoline passed by the Legislature
38, this year.

The Board expressed concern over .the number of unpaved
5e miles in Orange County and noted that the Department of Trans-
6. portation planned to spend $101,249 (including contingency) for
strengthening paved roads. Mr. Watkins said the decision for
8. selecting roads to be strengthened was strictly judgmental on
the part of DOT. Commissioner Walker said the paved roads should
10. not be allowed to fall into disrepair.
11. Commissioner Whitted moved; seconded by Commissioner Willhoit,.
12. "that the Department of Transportation be requested to consider
3-3- substituting unpaved roads for the proposed paved Secondary Road
14. Improvements using the point .system list as far as the.money
15. wi'll .go .and to-improve the spot improvements and the. paving of
16. unpaved::.roads ,as .they are proposed." Vote: Ayes, 4 (Commissioners
17. Barnes, Gustaveson, Whitted and Willhoit) ; noes, 1 (Commissioner
lg. Walker) .
19. Commissioner Anne Barnes asked those in the audience who
20. wished to speak regarding the Department of Transportation's
Proposed Secondary Road Program for 1981-82 to do so at this
'cam time.
23. Dr. Charles Blake: Was opposed to the cutting of vegetation
24. along the road to prevent frost on the highway; he also was .
25. critical of the DOT's failure to properly maintain culverts,
26. mentioning an area along Faucett Mill Road in particular.
27. There were no other citizens who wished to .address the
28. Board regarding the Department of Transportation; Commissioner
29. Barnes declared this portion of the Public hearing closed.
30. Agenda. Item 4:. Abandonment of SR 1569
31. This item was returned from the October 5th agenda; the Board
32. raised questions regarding the maintenance of the road which is
"3 within the Eno State .Park and also the absence of the accompanying
petition requesting abandonment. Mr. Watkins of the DOT said
35- the road (Cole Mill Road) will continue to .be a public road up
36. to the point where the Eno State Park begins; he understands that
37. the State Park Service will install a gate at that point and maintain

4• the road within the State Park. Commissioner Whitted noted the
5• reception of the petition requesting abandonment and moved, seconded
• by Commissioner Gustaveson, to approve abandonment of that portion
76 of SR 1569 (Cole Mill Road) within the Eno State Park. Voter Ayes,

9•. Agenda Item 5: Addition of Hepowil Trace. Malvern Lane
and Gentry Lane to Secondary- Roads

to add Hepowil Trace, Malvern Lane, and Gentry Lane in Saint Mary's

Subdivision to the State Secondary Road System. Vote: Ayes, 5;

Agenda Item 6: Public Hearing on Naming of State•and
15• Non-state Maintained Roads
16• Mr. David Shanklin, Chair of the Road Naming Advisory Com-
i7• mittee, presented a brief review and the recommended names to the
18. Board for both State and non=state maintained roads (See page
19. of this book for the list of names) . Ms. Iris Jacobs,who lives
20. on Alpha Drive, noted a discrepancy in that her road is listed on
21* both the State and non-state maintained lists; she further Asserted -
22. that. her road was named Taylor Road. Mr. Shanklin withdrew Alpha
�3• Drive from both lists and said the Road Naming Advisory Committee
24• would clarify the problem and return to the Board on this.
�5• Commissioner Willhoit
questioned the necessity of naming ,
26• a spur off a main road the same name as the road with the addition
27• of .Circle to the name (example, Lexington Circle off Lexington Road)
28. and suggested the numbering of houses be consecutive., Mr. Shanklin
29• said .the house, numbers would be consecutive however, this method
30• served to alert emergency personnel that the house sought was not
31• immediately on, for example, Lexington Road but off Lexington Road
32. on Lexington Circle.
33. Mr: Shanklin struck four names from the list submitted:
34. SR 1393, Alpha Drive; SR 1877, Celastrus Drive, SR 1389, Revere
35• . Road; SR.1599, Athens Drive.
36• Mr. ,Tim Polatty, Planning Director, told the Board the road
370 names for the public non-state maintained roads had not been posted
380 but the County had fulfilled legal requirements. Mr. Shanklin said

4• those living along these roads had been contacted with regard their
5. agreement on the suitability of the names chosen for those roads.
6, He further added that the action of the Board, should it choose to
7* do so, adopting these names, would protect. those names from being
8. allotted to other roads in the County.
9. Commissioner Walker moved, seconded by Commissioner Gustaveson,
10. - to approve the road names for the public State ,and public non-
Ile State maintained roads"as presented by the Road Naming Advisory - -.
12. Committee tonight and excepting those struck by Mr. Shanklin.

15• complimented him.on how .nicethe.new.::road.:.signs.were.They asked
16. the Manager to check into maintenance of the road signs after
17. State maintenance was discontinued.
18. Commissioner Barnes declared that if there were no others who

-20• Agenda Item 7: Dr. Mike Simmons
Dr. Mike Simmons, Superintendent of the Orange County Schools,
22• presented a brief report to the Board on that School system. He
23• noted that Federal cutbacks had hurt an already .troubled Exceptional
24• Child program and that some aide positions were eliminated to save
25• teachers' positions. He added that due to enrollment figures, the
26• school system had lost money from the State also. He enumerated
27, the effects of fewer Federal dollars on the school lunch programs.
28. The Board thanked Dr. Simmons for his presentation.
29. Agenda Item 8: Reguest for Variance
30• Ms. Shirley Burton requested the Board grant a variance to
31• the moratorium on development in the University Lake Watershed.
32• Commissioner Walker moved to grant the exception to the moratorium
3. on the basis of hardship; Commissioner Whitted seconded the motion.
3=�• Commissioner Willhoit offered :a,,substitute motion: He moved
35• than a finding that the process of 'subdivision had begun prior to
36• the impostion of the moratorium on August 24, 1981, and therefore
37. Ms. Burton's subdivision is exempt. Commissioner Barnes seconded

17. Whitted moved, seconded by Commissioner Willhoit, to approve the
18. budget amendments for the Planning and Health Departments . (see
190 page of this book for those amendments) . Vote: Ayes, 5;noes, 0.
20. Agenda Item 11: Appointments
21. The Board requested the Personnel Advisory Board, Orange County
22. Board of Adjustments and Triangle J EMS Council appointments be
23.. returned to a later agenda.
24. C. Youth Needs Task Force: Commissioner Willhoit moved,
25• seconded by Commissioner Whitted, to appoint Belinda Jones, re-
26. placing Lisa Berblzheimer as the Health Department representative'
270 on that Task, Force.. Vote: Ayes, 5; noes, 0.
28•. Agenda Item 13: Executive Session
29. Commissioner Whitted moved to convene in executive session
30• to discuss personnel; Commissioner Walker seconded the motion.
